Celebrity Law Breakers -- Why They Get Off (2)

Britney Spears driving with Sean Preston in her lap.Incident: Britney Spears drove last February with her 4-month-old son, Sean Preston, sitting on her lap, without a child restraint.  (Read the article: Exclusive: DCFS Investigates Britney)

Stakes: California law requires drivers to secure children sitting in the front seat who are under a year old or under 20 pounds.  A violation is punishable by a fine of $100, except the court may reduce or waive the fine if the defendant is economically disadvantaged. We're pretty sure Britney isn't.

Dispo: The L.A. County Sheriff's Department did not pursue the case against Spears, because the offense requires that an officer witness it and that didn't happen.  The Department of Children and Family Services paid a visit to Spears after the incident but we're told no formal action was taken.

Britney's child mishaps continued, the latest being an incident in which Spears stumbled outside the Ritz Carlton in New York City and nearly dropped SPF on the ground. She then muttered, "This is why I need a gun."

Britney is now expecting child number two.

Jesse McCartneyIncident:
Jesse McCartney, 18 at the time, photographed clutching a Corona in the 21-and-over Hollywood club Mood. (Read the article: Exclusive: Underage Stars Party Illegally at Clubs)

Stakes: For a minor in possession of alcohol -- are you listening Jesse? -- it is a $250 fine or as much as 32 hours of community service.

Dispo: Jesse wasn't cited.  We wanted to know why.  The California Alcholic Beverage Control (ABC) told TMZ that in order to nail Jesse, someone from the agency must witness the incident.  A photo isn't enough.

By the way, Mood risks losing its license when it serves to underage patrons or even allows them into the club.  Although TMZ has video of underage celebs entering the club, including Mary-Kate Olsen, Lindsay Lohan and others, Mood has never been cited by the ABC.  An ABC spokesman tells TMZ they have now launched an official investigation.

61. actually you cant drink if your 18 on a military base, i live on one you have to be 21. i do believe everyone should be treated the same but i also think that if you are risking your life for your country you should be able to sit down and have a beer when you feel like.

62. To Everyone... Get over it.. Life isn't fair.. accept it and move on... celebs are stupid and everyone is addicted to thier gossip whether one wants to admit it or not... if they were not celebs we would not even know that Spears was driving with her baby on her lap or McCartney was drinking underage or that Paris Hilton hit a car and then fled the scene... its ridiculus .. but everyone has taken this argument to completly different level... its just an article.. why let it bother you so much??? ALL of you GET OVER IT!!!!

63. Two points, both of which are directed to Donnie: First of all, marijuana can (and I guarantee has) kill people. I would be willing to bet that just as many people get into their car & drive after smoking marijuana as those who do after drinking too much alcohol. While I am no expert on 'weed', I also feel certain that you can "overdose". Secondly, if you think these people and their site "suck" so badly, then why are you spending all this time looking at the site and leaving messages?

64. Everyone is entitled to their own opinion so I dont think people should be yelling at other people just because they dont agree with what someone has to say. I think thats ummmm called oh whats that thing FREEDOM OF SPEECH! and I am sorry I dont know I am about to go against what I just said but some of you must live a very sheltered life if you dont see what Donnie was saying. I think Donnie understands what is really going on in this world and no I dont think he has one too many brain cells missing. He brings up a very valid point. The debate as to whether marijuana should be legal or not is a long one with valid points on both sides. I have to agree that its crazy that you may die fighting (im not even going to say for your country) in a war but you are too young to drink.. I am personally against drinking but those 2 things compared to eachother dont make sense at all. Tere you got the right idea everyone should be treated the same weather rich famous mexican, puertorican, asian, black, white, whatever. Unfortunately I dont see that happening anytime in this day of the world. If everyone could just fugging get along and work together things would be so much easier but we cant just be happy can we? We always need to be mad at something or not like someone.

65. OK. Yes, celebs get special treatment. But how many of you have never been just 'let off with a warning' for a moving violation? How many of you never snuck a drink before you were 21 and got away with it? Fact is, almost everyone has gotten away with something, whether they were caught or not, it just wasn't caught on film. Celebs get caught doing stupid stuff because the cameras are there 24-7 to capture it. I could care less about what a bunch of celebs do. It is when an empty headed baby-factory like Brittney endangers the life of a child that I have a problem. So Paris stole a tape. If the person she stole it from does not press charges, who gives a flying leap. So Jesse had a beer. OH MY GOD! Lets arrest everyone who drank before the age of 21. Well, there goes 90% of our nation. Better build some bigger jails. So some other stupid celeb took pot and smoked it. If we are arresting people for stupid decisions, we are in big trouble.
As far as the thread started about pot vs alcohol, 6 of my friends died before age 18 from doing stupid things while smoking pot. None died from alcohol. Both my parents died from alcohol after age 21, but nobody I know has died after age 21 from pot. Legal or not, regardless of age, they will be used and abused by those without the willpower or intelligence to use them with discretion and moderation. And that has nothing to do with being a celebrity.

66. Dan,..."let them drink and drive"?? and let them kill others? what is wrong with you??

67. We shouldn't be blaming the stars for getting away with things. We should blame the LAPD for not enforcing things. Saying they are conducting an investigation is just a COPOUT for not wanting to be straight and basically saying they don't give a flying flip because they're afraid one of the stars might sue the LAPD! The stars CAN be blamed for their ability to influence younger kids. Jesse McCartney used to claim he was this innocent guy but he's just like the rest of the star society. He's been sucked in and I guess that's the price he's paid for stardom. We
all know Paris' family has enough money to wipe out the LAPD so is anyone really surprised that she gets special treatment?!

68. OK, not that I don't enjoy getting dirt on these people (especially since I don't like these preppy morons), but honestly... the people from TMZ are nothing but muck-rakers. They love exposing truths without proposing a solution. It's like they're TRYING to get these people in trouble. What bothers me the most is that they'll charge you $1,000 for hitting someone's car and petty theft, plus 6 months in jail... but they'll only make you pay $100 for endangering your child's life (or posessing an illegal substance). Nice going Cali. As for the "underage drinking"... The U.S, is the ONLY country in the world that has 21 as the drinking age. Most of the other coutries in the WORLD have it at 18. What makes the U.S. right and the rest of the world wrong? There are worse things in existence than indulging yourself with some beer and a little pot, but no one bothers to set such high standards for those things. Like irresponsible people like Britney Spears becoming a parent.

"OMG! she scratched a car! *high-pitched scream* alcohol, pot... Off with her head!"

Yet any idiot can become a parent.

69. OK, WHO ARE THE MORONS SAYING YOU CAN OD ON MARIJUANA?, LOOK IN TO IT AND TELL ME HOW MANY PEOPLE HAVE OD'ED ON POTM, ANYWAY.. YES, CELEBRITIES SHOULD BE TREATED THE SAME WAY WE ARE TREATED WHEN IT COMES TO CRIME AND PUNISHMENT BECAUSE OUR JUDICIAL SYSTEM IS SUPOSED TO BE EQUALL FOR EVERYONE, BUT DUE TO THE CORUPTION IN OR COUNTRY... IT AINT, SO WAKE UP AND SMELL EL CAFE, O YEA- 1- PEOPLE LIKE TMZ SHOULD FIND BETTER JOBS THAT ARE MORE DIGNIFYING, LIKE CLEANING TOILETS, 2- THE 18 21 DIE FOR YOUR COUNTRY DRINKING ISSUE, ITS REDICULOUS TO BELIVE A COUNTRY CAN HAVE THAT MUCH CONTROLL OVER YOU, AND WERE DID THE NUMBER 21 COME FROM? 3-ROCK ON STEVE-O

70. I am not suprised that celebrities get off easier. I am suprised that the fine for minor in possession is $150.00 higher than not having your child in a car seat. Crazy.

71. Ok. Comment number 15. Just so you know, you can't drink on,post. I am in the military and it is illegal in the military on of off post to drink under 21 stupid ass. I don't know where you got the information that you could drink on post but the only way to do that is if you have someone over 21 buy you th booz just like every other underage drinker. You used to ba able to drink on post untill it became a national aggenda not to permit it or cut off federal funding to states who don't follow the ruling by the federal government. Man look up you information before saying shit like that. Go on guys continue to say it's unfair for me or anybody else to fight for my countray and not be able to drink legally because you are right to do so and it does fly. I joined at 18 and I fought at 18 in iraq. You know whats even funnier is I don't even drink at all but I still would like the option to be able to.

72. i'm a little confused about the whole britney thing...the car seat thing, yeah...that was stupid and dangerous, but stumbling and almost dropping him? What's the deal with that? If anyone knows any more about that story, please let me know, because I've caught it on tv or on the web several times, and no one has ever said she was drunk or high or anything...I just don't see what the big deal is. I tripped over my dog once, with my 4-month-old in my arms and landed half on top of her...she was ok, thank god, but sh*it happens...I'm a good mother, and I didn't "almost drop my baby"...I fell flat on top of her! people trip, babies get dropped occasionally. the comment about the gun was probably just because she was embarrassed...Now before anyone goes off half-cocked, I am NOT endorsing Britney Spears as the world's greatest mother by any means, I think she has some serious issues, and needs some guidance, but I just have a problem with this particular story...it seems like picking to me. anyone with more details as to why this is a big deal, please post...thanks.

73. Holy crap! ya'll are all worked up over this huh? I am currently in the military and although I generally disagree with bashing this country such as Danny did, I put on this uniform everyday so someone like Danny has the right to voice his opinion good or bad. We don't have to respect his opinion but we should respect his right to have one seperate from ours.

74. I did not read all the comments but enough. It is a FACT that the brain is not done developing by the age of 18 and any alcohol disrupts that development. Fighting for OUR country does not impede that same development. I understand why so many stars get such opportunities for rehab as opposed to jail, because their success in rehab will be out there for all to see. Hopefully it will reach those in need. But to continue this manner on and on with those same stars that don't get the program it really is unfair to those who won't catch a break because of their personal status in life. As for Britney, well I fell while holding my baby once. I protected his head while ripping off the top of my thumb. I cried for weeks thinking it could have been his head. But does that make me a bad mother. NO it does not, I was simply trying to get him into shelter from the cold rain. Now I know, a little cold rain is not worth running from with a baby in your arms. Britney just needs to get in touch with her "mother bear wisdom" and thats all it is. She'll be fine. As for Steve O he needs a good psychologist. I think the media should hang out in front the homes of pedifiles/priests who commit crimes against our young. Now talk about breaks......Hey maybe someone will do a new reality show on that.

75. I ask the question, were you ever in a bar or have you had a drink before you were the legal drinking age? I've been going to bars since I was 14, nobody ever fined me! Let these kids have fun.
