Reese Says 'I'm Not Pregnant' -- Sues Star Mag

TMZ has obtained a lawsuit filed by Reese Witherspoon claiming Star Magazine invaded her privacy by publishing a "fictional" story that the actress was pregnant.

In the lawsuit, filed Wednesday in Los Angeles County Superior Court, the Academy Award-winning actress claims the magazine published a false story that she was pregnant "in a callous effort to boost the tabloid's sagging sales."

"Contrary to the fabricated Cover Story," the lawsuit says, "the true facts are that [Reese] is not pregnant, does not have a 'baby bump' and has not otherwise gained weight such that she has had to resort to wearing 'Empire-waist dresses,' 'baggy clothing,' or an 'old-fashioned 1920's bathing suit.'"

Reese also alleges in the suit that "this fabricated tall tale was brazenly published as a prominent and conspicuous cover story for the purpose of garnering the maximum attention to the tabloid..."



The lawsuit claims the story was a violation of Reese's privacy and portrays her in a false light. It seeks unspecified damages.

Mike Kahane, General Counsel for American Media, told TMZ, "It is a frivolous lawsuit. It has no legal merit and we intend to vigorously defend it and have every confidence that we will prevail."

We asked Kahane if Star believes Witherspoon is pregnant. He said, "The article asks the question as to whether or not she is pregnant based on her physical appearance and clothing that she was wearing and we believe we have every right to ask that question."

Witherspoon's publicist issued a statement, claiming the tabloid lied by saying "...she has been withholding or concealing this information from producers of upcoming films." The statement says Witherspoon's lawyers notified Star before the article was published, warning that the article was "...absolutely false and that it would be damaging to Witherspoon professionally as well as very distressing personally."

31. What I find funny is Star is trying to say they were asking a question...
Last time I checked, the phrase "Reese & Julia, Baby #3!" is not a question!!!
And of course the letters and exclamation mark are about 2 inches tall with pictures, on the front page...hopefully next time they are asking one of their "questions" they will learn how to punctuate properly!!

32. I think there is way too much invasion of peoples private lives going on,I dont care who you are.No one has the right to invade,harass or disrupt the lives of others. I think some of our noses have grown way too long,and need,s to be bobbed off, by paying out the nose for such invasion.

IF SHE IS ACTUALLY PREGNANT, A FILM COMPANY MIGHT NOT WANT TO SHOOT AROUND THIS SITUATION OR DEAL WITH HER BEING ABSENT FROM THE SHOOT DUE TO ILLNESS. IF IT'S NOT TRUE, SHE SHOULD SUE AND WIN A BUNDLE. THE PRESS HAS NO RIGHT TO PUBLISH ITEMS ABOUT ANYONE THAT ARE UNTRUE.

35. Reese has every right to keep people from using her FACE and NAME to sell their gossip! I can see this from SO many angles. Here's a thought: what if she and Ryan had been secretly seperated for the last 6 months and here the "mag" has her pregnant? Now it's not ONLY professional jeopardy with certain film producers BUT she could be looking at a divorce as well.
Actors have a right to their privacy until they release personal infomation..then it's fair game.

I think tabloids are trash and when they make up false stories about real people it can be hurtful.

People today think "well that is the price you pay for being a star" BULL!! that is the price we all pay for letting gossip pass fro news, and the reason you see such a shift in the way TV news is done today

37. It's unfortunate, but being a celebrity means having the media follow you around snapping pictures and writing stories about every little thing you do. Is is right? No- because even celebrities are entitled to their privacy. I do like Reese Witherspoon and respect her as an actress and a mom. She doesn't have nannies doing all the "mommy" duties like many of the other female stars our there who have babies only to allow them to be raised by a nanny. If Star magazine published a story that was not true about her then she has a right to sue. It's called slander and it's against the law. How many of us have had someone tell a lie about us? It doesn't make you feel good, and it makes you want to defend yourself and your reputation (most people do), so Reese has every right to do so herself if what Star Magazine printed is lies.

38. Speaking of law suits....does anyone have a good attorney? I want to sue Ja$mine for slaughtering the English language and for being too lazy to type out her thoughts in a complete sentence. She should know better than to annoy me before I have my coffee! If there isn't already a law against ignorance I propose that we campaign for one!

As for Reese, I can only guess how tired she must get of being in the spotlight even though it is "part" of what comes along with being a star. Since it is illegal to "blow up" the offices of the magazine what other legal recourse does she have than to file suit? I think that it will cause the Star and other publishers to think twice about reporting false stories about her in the future. The best defense is a good offense!

P.S. Please forward those attorney names!

39. From that cover, it is not asking if she is pregnant, it is flat out saying she is. There is an exclamation point and not a question mark, so for them saying, we were just asking and we have every right to: yeah you do BUT ON THE FRONT COVER OF YOUR YELLOW JOURNALISTIC MAGAZINE??? If they really wanted to know if she was pregnant, they would have asked her or her representatives FIRST and gotten their facts straight BEFORE printing a false-hood. Reese should sue and so should anyone else who has had false stories written about them and they should win. This era of "paparazzi" media just takes things too far. Then again, noone is probably reading that garbage magazine anyway so perhaps its not as big a deal as I think.

41. this is not right 4 magazines to write false articles! good 4 Reese to sue! see does'nt care about the money,just the truth! i do think it hurts or makes it more difficult 4 her to be offered a leading role too?!? seeing the article on the grocery stand tonight, i did think she was pregnat?

42. The stars/public figures of today are fortunate that they have recourse when falsehoods are printed/stated. Retractions should be mandatory .. along with the outrageous amount of money awarded. Carol Burnett sued a magazine years ago; that should have sent a message to those who publish inuendo and lies. Apparently it did not. And to Reese: you did the right thing.

44. I absolutely LOVE Reese... she is a great Mom with a great hubby and a great career!
I can see how she wouldn't want to be accused of being pregnant just because of her clothes choices...lol
She is one of the lucky ones with a good pre-preggo body.
I too was hoping she was preg again. It's nice to see a stable Hollywood marriage with loving kids.

Star should stick to the "Loving Couple Sex Ed" stars and the homewreckers...lol
