Exclusive: D.A. Will Decide Harrelson's Fate

TMZ has learned the L.A. County District Attorney is in the process of deciding whether to prosecute Woody Harrelson over an altercation with a TMZ cameraman.

The incident occurred on June 30 on a public street outside a Hollywood nightclub. Harrelson became irritated with Levine and asked him to stop shooting. When Levine continued to roll, Harrelson walked over to him, put his hand on the camera and again asked Levine to stop. Levine responded, "All I'm doing is my job." After another exchange, Harrelson broke the camera.

A second video, obtained by TMZ, shows Harrelson then grabbing Levine by the neck, causing a laceration.

We're told the LAPD interviewed Harrelson Monday and then referred the case to the D.A. later in the day. Shortly after the incident, an LAPD Detective John Padilla told TMZ "With the tape and all, it's pretty good evidence."

The D.A. could file vandalism and assault and battery charges against Harrelson or reject the case and refer it to the L.A. City Attorney for possible misdemeanor prosecution.

17. I am a peaceful american male, but if someone,(were I celebrity or not!) kept following me and filming me, I would be inclined to get very upset at the intrusion or my privacy, in public or not.......
Are not all americans insured some peace and civility???? There should be a harrassment charge filed on all popparatzi!! Yes, thier job is to take photo's of celebs, or to film them, but there does come a time when ENOUGH IS ENOUGH!!!

18. If I had been Mr. Harrelson I would have knocked his head off. It is one thing to do your job, but to aggravate people to the point that you could call it STALKING is a bit rediculous! Famous, or not you should have a right to your privacy after saying STOP. People put the almighty dollar above everything, and nothing seems to matter to people more than money. This world has become a terrible place where money rules, and the poor are forgotten. Anyhow, Woody should be able to walk free, and if anything, the camera man should be arrested for stalking, and aggravated assault with a camera. GO WOODY!!!!!!!!!!

19. Celebs are or do have a public persona, but they do have a right to privacy as we all do. Should these No real job having, money grubbing photogs get paid for getting up in anyone's face with a camera especially after being asked to stop? Hell No!, Woody asked him to stop twice, 3 strikes and he was out, the photographer,that is. He got well short of what he deserved and there should be a law where the papparazi isn't allowed 50 ft. from anyone .they have telephoto lenses, They're worse than the police. I agree with ealier post, princess Di would still be here.And continuing her good works and giving hope to people worldwide.
It seems this was a lesson not learned. Booo Cameraman in Woody's Face...Hooray Beer and Woody Harrelson.
And don't judge a book by his fathers deeds., stupid.If you knew, Woody doesn't even have a relationship with his father.For killing a Federal Judge in Texas for a drug defendant.
It is better to keep one's mouth shut and appear stupid, than Open it , and remove all doubt.

It's not like it never happens, and he asked politely before. Sure its his job, whatever. He should know that's prepared to happen though. F*** implied consent.

22. My husband has shot some papparatzi jobs before and has never been so disrespectful. I think the media in general is filled with way too much of this type of junk. Shooting a few pics of a celebrity leaving an event is one thing but a full on personal assault of a peron's privacy is just WRONG. Too much reality TV, too much criticism of Britney's parenting skills, too much! It seems like a setup just to cause some nasty footage.

Charge him for the friggin camera and DROP IT!

I was scratched on my face by a stranger in public but the police never even took a report. The only reason the report was filed was because he's a celebrity...Gimme a break.

23. Time to make some laws! Sorry, just because you have celebrity status doesn't make having cameras flashing or rolling 24-7 right. If I say stop it should mean stop. I have a feeling alcohol played a major rolle in Woody's actions. Unfortunately you can't put your hands on someone else, that's a law that won't change. I love Woody Harrelson, I hope they can settle this.

OK...well, Woody was iritated...he asked the guy to stop filming....both were in a public place....gives guy right to keep rolling film...gives Woody right to ask him to stop...BUT, doesn't give Woody right to physically abuse guy....If guy with camera was invading Woody's private property (house, car, etc) then a call to police would be warranted....still no violence. Guy was not injuring Woody in any way by filming him, it's basically part of being a "public figure" (get it, PUBLIC FIGURE !!).
Woody didn't mind being photographed when it was advantageous to his career. Now when he's a weird, hemp advocate he cares.
Woody was WAY out of line, and should be charged. If you or I did anything even remotely such as this, you can damn well be positive we would have our butts thrown in jail and have charges brought against us !!!

25. Oh he'll get away with it. As we've seen in other TMZ reports., video footage doesn't mean diddly when it comes to prosecuting celebrities. The law just doesn't apply to them. The D.A. will never prosecute a celebrity.

26. Hurrah for Woody. He has been the guy who stands up for what he believes. He took on the Hemp issue in the past and is a good spokesman for anti Papparazzi sentiment. I hope he gets off and will make a huge statement on the right to not be bothered if you do not want to be. This is still America and the right to be free should extend to the right to be free of Papparazzi. Go Woody.

27. It's actually "prima donna", not "pre-madonna". And Woody is a celebrity. Paparazzi comes along with the territory (pondscum that they are). Even if he had a bad day and told them to bugger off, he had no right to get physical with the camerman.

30. Woody had every right to do what he did. "You're just so sexy" was a comment that was clearly sarcastic and intended to provoke him. Aren't there any laws against being harrassed and/or videotaped against one's wishes? I wish Woody would have slugged that little punk in the face and smashed the camera on his head, because that is what he deserved.
