Bulletin -- Prosecutors Reviewing Gibson Case

Mel GibsonTMZ has learned the Los Angeles County Sheriff's Department has sent the L.A. County District Attorney the Mel Gibson case for review. The D.A. will decide whether to file driving under the influence charges, a misdemeanor, against Gibson.


The D.A. could also file charges of resisting arrest if the evidence warrants. That charge could be filed as either a misdemeanor or a felony, depending on the circumstances. As TMZ reported, Gibson attempted to flee the scene of his arrest but was subdued by the deputy.

Gibson's next scheduled court date is September 28.

No timetable on when the D.A. will make its decision.

63. If I could get 1/10th of the publicity this story has generated for MEL GIBSON
I wold be well on my way to making my MEMORIAL GARDEN a realty.
The Memorial garden is an project I statrted almost therr years ago to pay tribute to the now 2500 GIs who have paid the supreme sacriifice. in the war.. The press won't touch it.
Even our MAYOR always ready for a new idea won't be bothered with it. One of his assistants says I will get into trouble if I continue.to collect money for it.

64. The core issue is not Mel’s comments or his actions, but the fact a government agency decided to undermine the Constitution. The Constitution guarantees Freedom of the Press, BUT the LA County Sherriff decided that if was greater than the Constitution and decided to “scrub” a public document (police report). 69. Mel Gibson Is a great actor and director, and now he is a drunk driver. President Bush is was one too. We all make mistakes and his BAC was .012 . The limit is .08 so he had like a beer and a half. His tantrum however suggests he had more. Anyway he shouldnt have been driving and he does have freedom of speech..God bless the soldiers.

71. Just because he is a famous actor, he should not get any better treatment from law enforcement. But he still got charged with a DUI, so I guess he got the same as anyone else. Most people are not aware of the real evils of alcohol, and certainly not to the extent of Mels alcoholism. If he blew a .12, he was hammered. And that content, if he recently fell off the wagon, is extremely high. It's lucky he did'nt kill someone driving his car. But the real problem here is that people got offended by his statements, and whether he meant them or not does not matter. I dont believe he did. I believe he is far too intelligent to spend his life hateing others. If you knew the temporary changes that can occur when someone is under the influence you would have a better idea of the truth. Leave the man alone and get a life. There are more important things to pay attention to.

73. So it seems Mel Gibson is an arrogant, self-indulgent jerk who thinks he's the untouchable king of Malibu. He made a public apology; it seemed sincere, but then he's an actor. He's disappointed many people with this incident after the world embraced his movie "POTC". Mel Gibson has been given such a unique position that most of us can only dream of. He needs to always be aware of that. The woman whom he made the sexist slur to should have stood up in his face and slapped him across the room; but then more than likely she would have lost her job. Or maybe Gibson was trying to provoke her into reacting in such a way that the whole thing would have been dismissed. What's most unsettling is how he's hurt the people he loves most, his wife and kids, and his extended family. Mel Gibson is a delightful entertainer, and I for one will overlook this incident and still be Mel's fan; however, he needs to clean up his mouth and take responsibility for his actions and set good examples; especially for youngsters who think he's so cool. I believe he's a good person who just needs to take a good long look at himself and not forget that we the fans can turn our backs on him if he doesn't act responsibly. In a town not far from me a 19-year-old boy was killed today because he had pulled over to the side of the road to help someone whose car was stalled. In the process of doing this the boy was killed by an oncoming vehicle. It turned out that the man in the stalled car whom the boy had stopped to help was inebriated. I'm glad nothing bad happened to Mel Gibson that night, or anyone else. I'll keep supporting his movies if he'll get the help he needs to grow up and show the public what they deserve to see from him.

74. Why is it that the average citizen is subjected to a different standard of the law than celebrities. Any average person would have ended up in the slammer in a nano second.

Case in point:
1. Mel Gibson was let go in TWO previous DUI stops.
2. He was offered to be transported for his booking in this incident with no
handcuffs if he cooperated. Anybody else would be in handcuffs regardless
if they cooperated or not. This was a DUI PERIOD.
3. An attempt was made by the sherrifs department to remove some of the
remarks made by Gibson.

Therefor an immediate investigation of the Sheriiff's dept. and LAPD should be launched in regards to their special treatment of celebrities and the like.
We live in a democracy in which the law should be blind to the status and position of the law breaker. Obviously it is not so in Los Angeles which in effect makes the average citizen a second class citizen.

Ofcourse we should make one exception for Mel Gibson because "HE OWNS MALIBU."
