EXCLUSIVE: Video of Mel at Moonshadows

TMZ has obtained exclusive video shot on a cell phone by a patron who was at Moonshadows Malibu the night of Mel Gibson's arrest for DUI. The video was shot in the patio-bar area of the restaurant just after midnight, approximately two hours before Gibson was arrested.



The video shows a jovial Mel talking and laughing with patrons. He is holding what appears to be a bottle of Pellegrino sparkling water.

No, he wouldn't be in jail. You get held for a period of time and then you are out. Yes, celebrities do get breaks that they don't deserve, and yes it pisses me off too, but the reality is NONE of us goes to jail...boom...just like that!

170. Harvey, it's called 15 minutes of fame, not 15 days!!! We get it already!! We know you and your little website broke the story and are suddenly getting your name and website talked about everywhere. But for the love of God, is this all you can come up with as a "journalist?" Are there no other stories out there? Unless there is some additional outlandishness to this story, like maybe a cover up of Mel sh*tting in the sheriff's mouth, I really think it has run its course and then some.

172. Intellgent peple with wealth who wish to get stoned should have the common sense to use a limo. I guess Mel Gibson gets a thrill out of driving stoned. If so, he should buy a racetrack, and curse all he wants to in the privacy of his own playland, sounds like a Michael Jackson scenario, doesn't it? Take it from Michael, stay off the streets. By the way, regarding City of Angels, ( not regarding Mel the retard), why does Nick Cage say "The enduring myth of heaven", instead of "The enduring promise of heaven"? Good movie.

174. Mel was drunk. Got caught. Was beligerent. He should appear in court. DWI school. Lawyer's fees. Liscense revoked. After completion of classes and whatever else is required he do, his liscense is returned. 6 mos. probation. End of story!! Oh, and isn't freedom of expression legal no matter what one's feelings are?

179. If he was Mel Smith from Somewhere USA this would not be a big deal. Worse cases are dealt with in the streets and the courts all the time. He's said he was sorry, he's working on a solution. End of story.

I can't imagine anyome waking up the day after, remembering what they did, seeing where they are, knowing what kind of trouble they are in and in Mel Gibson's case he has the nightmare of saying some not so nice things because drunk people act like fools, *as he admitted to doing, time after time*.
Why can't you leave the guy alone?
My God, we have so many more things going on and you can't let go of this one teeny bone.
Bury it and find something bigger, better and jucier.
