Sheriff in Mel Case -- Pants on Fire

This past Friday afternoon, I landed in Los Angeles after taping my "People's Court" segments in New York. I checked my voice mail at work as we taxied to the gate and the first message was from an L.A. County Sheriff's sergeant. He wanted to talk to me about the Mel Gibson case.

I sort of knew why he was calling. The Department is obsessed with finding out who gave me the arrest report in the Gibson case. I've made it clear that I will not tell them and, besides, the law is on my side. Nevertheless, I wanted to play it out so I called him back. He was nice enough, telling me he was in charge of the "criminal investigation" into the leak and wanted to know if the rumors were true that I paid someone off for the documents. I told him I would not tell him anything about how I got the report, but I did mention that I have said on TV several times that we absolutely did not pay anyone for the documents. He thanked me, saying that I answered 80% of his questions, and that was the end of it.

Do you think the Sheriff's Department might also spend a little time figuring out why officials blatantly tried to cover-up the incident by repeatedly lying to the public the day of the arrest? Please understand, this is not about Mel Gibson. Frankly, I think given what went down, his punishment was far more severe than any other drunk driver in 2006. I can't think of anyone who was put under as much scrutiny after a DUI. This is not about Mel. It's about how arrogant the Sheriff's Department is and how officials clearly feel empowered to violate the public's trust again.



I think I've finally figured out the Sheriff's shenanigans the day of Gibson's arrest. As we reported, the Sheriff sanitized the arrest report and took out all references to Gibson's attempted escape, his anti-Semitic remarks and his bad behavior. It was done at the behest of the brass in the Sheriff's Department, and, even though he denies it, I'm told Sheriff Baca was involved in the decision. So officials told me and the rest of the media the day of the arrest that it occurred "without incident." A lie. I was told by a Sheriff's spokesperson that my information about what really went down was false. Another lie.

At the time, I felt the Sheriff, who is quite friendly with Gibson, didn't want to expose what happened on his watch, so he would arrange it so that if it came out, it would be the District Attorney's responsibility. Now I realize how dense I was -- I was totally off base. The Sheriff knew this case was going to be plea-bargained. No way would it ever go to trial. If it was plea-bargained -- as it was -- the arrest report and the incendiary video of Gibson at the station would never be admitted into evidence. It would be part of the Sheriff's investigatory file and as such protected from disclosure. In other words, Sheriff's officials clearly felt the public would never know what really happened with Mel and that they could lie and get away with it. Clearly, they didn't count on me getting the arrest report. That busted them big time. And now other lawyers have told me they've seen this happen before with other celebs.

So the Sheriff's Department is investigating why they got busted, not the corrupt process that officials sanctioned. And an "independent" commission is now investigating whether the Sheriff followed proper procedure. Well, let me tell you something about this commission. Three days after the arrest, I called the head of the commission twice -- you would think I'd get a call back if he were serious about getting to the truth. I'm still waiting, but I'm not holding my breath.

Don't get me wrong. This is not a slam on the rank-and-file in the Sheriff's Department. This is about the officials who feel they have a right to pick and choose who gets special treatment. Of course, they will do it again, and again. It's the way it works in L.A. It's just another example of "Celebrity Justice" in Tinseltown.

Your words are a thinly veiled attempt to admit that you really messed
up this time, and you want to cover yourself, so that you can continue to
be adored and further your revenue stream.

The truth is, you are an unreformed, unrepentant anti semite of the
worst kind, and your hollow outreach is worth less than the price of your
next drink, which will surely find itself in your hands before long. I'm
buying.

Of course, if I am wrong, you could start by donating $1,000,000 today
to the State of Israel in her time of need.

Surely that is a small public relations price to pay for a man of your
stature who "honors all of God's children".

47. Harvey, how about the corruption on your own People's Court TV show? "Just like real court" NOT! The shows are rigged, edited for a pre-determined result, and participants are encouraged to go for sleaze and drama. It is a "legal" show that demonstrates that crime does pay! The defendants go on the show because if they lose, they don't have to pay a thing. The show pays the plaintiff.
AND...the defendant gets paid for appearing. GET OVER MEL, at the very least move into the Jonbenet scam and milk that one dry. Mel's DUI story is OVER,
finito, case closed. Your 15 minutes have ended, Kato. Oops, I mean Harvey.

48. Cops routinely do not quote the entire dialogue of a drunk driving arrest. That is why he said to clean up the report. He knew it would get blown way out of proportion, as it has. Get over it!

IN RESPONSE TO "MR SPEILBERG" ..........you need to address your fellow jewish writer , MR BERSTEIN... who also wrote in the los angeles times last week about how all of your "heros" the thalbergs...ect... and all the other jewish entertainment community sat on their rich fat asses while millions of their fellow jews were gased and tortured..MR BERSTEIN goes on to say ...no movies were made about the plight of the jews until 50yrs later when millions had already died...the jewish movie community did nothing but sit back and make their millions in hollwood......oh, at this point MR. SPEILBERG... i would also like to ask you a question,,,,since you are now posting on TMZ...how did you mangage to get the fellow who you had an affair when 6yrs ago...locked up in jail for 25yrs under an attempted kidnapping and attempted rape charge....how did you keep the story out of the papers when you had seen both he and his brother who were know to escort around los angeles with older rich gay men.........thank you

Perhaps nationwide arrest and punishment stats prove your case, but perhaps it's not clear HOW MANY ACTUAL

52. Mel is not like anyone else. If he was, he would have been charged right away. I am more upset that he wasn't cited the 2 times before when he was stopped for speeding way over the limit. If he had been cited before and maybe had his licence taken away, this time might not have happened. Why isn't anyone upset that he could have killed someone in his drunken state? As far as I'm concerned, he should be relieved of his drivers license. It's a privilege to have one and he doesn't deserve one. That is the way Justice should be dealt out to him.

53. I have been in Mel's shoes. In most states anything below a 1.0 is legal. In California it's .08. I blew a .09. Im just a regular person so was told no toleration, even though in most states i would of been considered sober. I do believe when you play you pay, and so should Mel. The only thing i feel sorry for is just because he is someone he has no privacy. We all know how corrupt the police can be, through them some money and you can get what you want. (for the most part). Sorry Mel, too bad people have nothing better to do than plaster you all over the tabloids, so much else going on in the world. And to top it off, have people make nasty comments. So sad. . .

57. It is unfair how every move a celebrity makes get exposed. Are they not entitled to the same privacy as anyone else? I work 3rd shift in a county jail, in the booking area. If videos were shown of “regular citizen” that are arrested for the same charges as Mel, you would not see much of a difference. Alcohol brings out a side of many people that should not ever be exposed. When they are sober they would not in a million years do or say the things they do under the influence. People are human and all make mistakes. This is a free country and we need to give everyone their privacy. Mel’s behavior should have been kept out of the news except the 1 line that everyone else gets. His comments should not have been public. I have seen many decent people at their worst. If tapes of their behavior were released the public would be appalled. I feel the press is just trying to destroy someone for personal gain. This makes you worse because you are knowingly doing it.

58. i was parked on pch hwy ready to to a job and a police car pulled over in front of me and the officer got out of the car and he had some one in the back seat so i waited in my van to see if i could see who was in the back seat but when the officer got out of the car he opend the back door and told this person to turn side ways so he could put the hand cuffs on.since when do cops roll with some one in the back seat thats been arested with no cuffs on??? only in malibu because were i live that the first thing cops do is put hand cuffs on you ohhh i stay in south central los angeles....
