Paternity Suit Filed Against Anna Nicole

The Anna Nicole baby drama just got legal as Larry Birkhead filed a paternity suit against Anna Nicole Smith, his lawyer said Monday. The suit is requesting a judge to order Anna Nicole return her daughter Dannie Lynn to California, submit to a paternity test and have mother and child tested for drugs.

In a statement released tonight by Birkhead's high-powered attorney Debra Opri, Birkhead is asking for legal and physical custody of the little girl, born September 7th.

According to the statement, Birkhead is "a first time father and he is responding to allegations made by attorney Howard K. Stern on behalf of Anna Nicole Smith" and "believes beyond any doubt that he is the father." Smith's lawyer Howard K. Stern announced last week on CNN's "Larry King Live" that he was the father of the child and that he and Anna Nicole had been in a relationship for some time.

Birkhead appeared live on with Rita Cosby on MSNBC tonight and declared, once again, that he is the father of the little girl. He told Cosby that he is "outraged and angry" and claims that Anna Nicole deliberately fled to the Bahamas to avoid custody and visitation discussions. Cosby also asked Birkhead about unsubstantiated claims that Anna Nicole was pregnant once before with a child of Birkhead's but then miscarried, but Birkhead refused to comment.

6. Who in here really thinks that kid is Howard's? If it is, then there is no reason they can't come back and shove Larry Birkhead's allegations back down his throat. If they decide not to come back to face him, then we can all guess the truth....

7. I'm a mother and grandmother and am very proud of Birkhead for taking action against these nutty people. It is outrageous what this woman and unethical lawyer are doing. If Birkhead is the father, let it be determined. If he is not, then he'll go quietly someplace else. But if he is the father, for the love of God, let him have the child. Get her away from crazy and crazier. And before some self righteous nimcompoop starts attacking and bashing me, let me state that I grieved for a week over Daniel's death. This insane behavior in the last ten days has washed all that away. I don't care what ANS and HKS do with their lives; they don't deserve to have another child's life wasted by their selfish antics.

9. you know, anna nicole doesn't know if her son is dead or alive, whether babydaddy #1 or babydaddy #2 is the father, whether she's married or just committed, is she an american living in the bahamas or a bahamian who works in amercia, sells birth or are they death pictures for a memorial - his or a celebration =hers. IF LARRY INDEED SLEPT WITH ANNA NICOLE AROUND THE TIME THAT SHE BECAME PREGNANT AND THINKS HE COULD BE THE FATHER, HE HAS ALL THE RIGHT AND HE SHOULD DO A PATERNITY TEST TO SEE IF HE IS THE FATHER. THAT WOULD STOP ALL OF THE SPECULATION ABOUT WHETHER HE IS THE FATHER OR NOT. IF HE TURNS OUT NOT TO BE THE FATHER, THEN HE SHOULD BOW OUT GRACEFULLY AND STAY AWAY FROM ANNA NICOLE'S LIFE, BUT IF HE IS THE FATHER, THEN HE SHOULD STEP IN AS A FATHER AND DO WHAT'S IN THE BEST INTEREST OF THE BABY GIRL. HE SHOULDN'T MAKE ANY DECISIONS ABOUT THE CHILD OUT OF SPITE OR TO GET EVEN WITH ANNA OR HOWARD. HE SHOULD ONLY DO WHAT IS BEST FOR THE CHILD.

Post #7--I agree with you wholeheartedly. If he is willing to step forth and BE A PROPER FATHER, by all means, BE A DAD. No telling what will happen to this poor girl left in the hands of Anna and her crazy attorney.

15. He just wants a check...he doesn't care about the baby, just the dollars she might produce for him. What an a**hole in the wake of the loss of Daniel. He's such a flash in the pan...sad when this is the only 15 minutes he can conjure up for himself.
