Baldwin is doing exactly the right thing - if these charges of vistation interference can be substantiated, Basinger should lose primary custody, pure and simple.

I got custody of my daugther when she was 13 and after 10 year's of paying child support on time, and every week when my ex-whore wife was ordered to pay a pity $45 she refused until the court took her taxes ..she bitched and cryed like a baby. so yes Rick your right, the guy usually does get scewed...SO ONCE AGAIN F**K THE BITCH

Neither Kim nor Alec are "perfect" parents, and it would undoubtedly be in Ireland's "best interest" for the state to just take her (or any child...) away from the parents and adopt her into the care of a "perfect" pair of PhD psychologists with expertise in childhood development. Since that doesn't really happen, and it won't happen here, the "best interests" of this child are unattainable and the state's premise that it derives its authority to award sole custody from its interest in securing the "best interests of the child" is fiction. If California had a presumption of equal joint custody, Kim and Alec would be forced to accept the other's important role in THEIR child's life. BOTH would be obligated to maintain clean, sober, abuse-free lives due to their knowledge that the other is just waiting SILENTLY for proof of misconduct that they can submit for prosecution, because a conviction of either for any child-threatening offence would disqualify the convicted parent from sharing custody. Equal joint custody removes the promise of victory AND the threat of defeat, both of which motivate each parent to fight so hard to "win".

If there's really abuse here, then someone should be in jail for it, not answering criminal claims in a civil court. If there's no abuse here, then the false accuser should be in jail. Call it PAS, or if you don't like that term, just call it perjury.

Kim and Alec are fighting because the court system falsely promises them a sole custody award to the "winner". But, there really are no winners in divorce court, except the lawyers. Which is probably the #1 reason the ABA opposes equal joint custody presumptions in divorce law. They know that if we give people less to fight for, they'll fight less.

24. First of all, I understand alec Baldwin has a temper and he comes form a troubled family. (Heck he's from Long Island isn't he). but I think Kim Basinger is awful for not allowing a father to see and spend time with his daughter. Maybe alec is psycho. I think he is. But something's got to be done about this divorce battle. I mean you can't keep a child away from it's father or mother. and at the same time you need to fight for your rights as a parent. AND you need to somehow settle the dispute and not go crazy over one's child/children like this. I am sure, with all the money alec and kIm make, Ireland is coping. All Alec wants is for his child to be in his life without any restrictions. But at the same time both Kim and Alec must not use anger as a force to solve their problems. It is setting a horrible example for ireland and that girl may grow up with mistrust, relationship and anger issues as a result of all this.

Hmmmm.... I WONDER IF BRAD PITT & ANGELINA JOLIE WILL END UP LIKE THIS IN THE FUTURE?

27. by the way, yes you can keep a child away from their parent if there safety is in danger and the court deems it. I know many cases. Kim is bound by agreements to not slander her husband and even if things are true, they must be proven, something to think about. Listen to Loveline on KROQ...106.7 LA

29. I think that both parent need to grow up and think of the needs of the child involved. That is what the court system is bound to do, no matter who is richer or more popular. The have to make their decisions based on provable facts rather than heresay from the other parties involved. They may not or may never get along together again but must maintain civility for thier child, (I've been there, done that) otherwise would only cause damage that the child would have to contend with for possibly the rest of her life. Those of you who post with opinions of who should gain custody or not based on someones political views or the such undermine the very values that this country was built upon. A mans (or womans) political views should have no bearing on the type of matters, who can provide a more stable home environment is what is the main question. That is something we can all discuss, but ultimately it is up to the states laws to determine that outcome.
