Hilary Duff & Joel Madden: We're In Mortal Danger

Hilary Duff and Joel MaddenHilary Duff claims in court documents that she fears for her life, alleging she and her boyfriend are being stalked by two men -- one a paparazzi and the other a homeless man.

TMZ has obtained court documents, filed today in Los Angeles Superior Court, in which Duff and Good Charlotte frontman Joel Madden claim that a 19-year-old Russian emigre came to the United States "for the sole purpose of meeting and becoming romantically involved with Ms. Duff."

The court documents state the man, whose first name is Max, "admitted to being 'obsessed' with her, has stated his intention of 'removing' his 'enemies' (i.e., those who prevent him from being with her), has stated his intention of purchasing a weapon, and has threatened to kill himself and to engage in dramatic actions to get her attention."

According to the documents, Max "has stated his belief that Hilary is in love with him and that Joel Madden stands in their way."

The court documents also claim David Joseph Klein, a 50-year-old celebrity photographer who is roommates with Max, is also a threat.

The documents state, "Over the past six weeks, the defendants have engaged in an accelerated effort to make contact with Hilary, including visits to her neighborhood, to her mother's home, to her boyfriend's neighborhood ... to Mr. Madden's concert venue, and direct calls to Hilary's manager."

According to the documents, the police detained Max at least once at one of Madden's concerts and questioned Klein at the same event.

The stars are requesting a judge to order Max and David Joseph Klein to stay at least 100 yards away from Hilary Duff, her sister Haylie, Joel Madden and his twin brother Benji.

TMZ spoke with David Joseph Klein who denies claims that he is a dangerous threat. We were unable to contact Max.

31. Problems like these can be recified for the minimual cost of $47 in most states. This smal cost enables you to obtain a permit to carry. And if you are a responsible gun owner and know the law, this permit to carry says that, if in a incident you feel your life or anyone else's life is deemed to be threatened by another person you may use you weapon to erradicate that threat. Folks, it is just that simple. Protect yourself and you will have nothing to fear. As for the court ordered restraining order, your kidding me right. It a piece of paper and by the time the police show up to enforce that court order you can be dead!!! Police can't be everywhere, and that is a shame. But it is your right and duty to protect yourself and others around you. Just my humble opinion.

32. Life is ALL about choices. I chose to live the life I am living, stalker free. These celebrities chose this path and chose what comes along with a life of luxury. We can't go protecting little ole' hilary because she is scarred. We should be arresting people who pose a higher threat than scarring a celebrity. You Chose your life, so you chose to deal with it!

35. No "people are stupid" it is you who are stupid. Most people who are stalked and eventually assaulted or killed are not celebrities. The same laws that protect Ms. Duff are the same ones used for everyone else. Fortunately, she can hire security and probably afford other measures to protect herself. Rebecca Shaefer did not have the money to afford any of that (and contrary to the false assumptions, not all actors are rich and are still stalked, actually this happens to the lesser known actors a lot). No one deserves to die or be seriously hurt either physically or mentally simply because they chose the profession of an entertainer.

**Before** they cause major harm??? Who remebers what happened to Princess Diana?? I'd consider that pretty damned harmful. These photogs that rely on taking pictures of celebrities "to earn a living", only act the way they do to try and get the most sensationalized shots so they can sell them to the highest bidder. I'd suggest these freaks find a regular job, or become professional photographers, who will respect the subjects of their pictures, not act like damned animals out for blood. And for those who say that celebrities should expect people to take pictures of them and not complain... sure, I agree... but do they have to behave they way they do? Shouting hateful things to get a reaction? Hiding in bushes or scaling over the walls of the celebrities backyards to get a picture? Preventing them from going out in public to do normal things? Surrounding their vehicles so they can't go anywhere or escape?? Chasing them in cars and causing accidents?? Hell no. So, to any photog-paparazzi-scum reading this... get a life, get a better job, and stop harrassing people that you wish you were, know you'll never be, and are jealous of.

Please, I don't want to hear that this ends tragically. This is one of the main reason I think allowing the photogs to mod these people is dangerous. It’s scary that some nut job with a camera can get close enough to turn the situation ugly in one second. I think we need harsher laws against stockers.

I also want to say that just because we pay $9.50 to see a movie it doesn't buy us an E ticket to invade the actors lives. People always try to use that argument and I've never really understood the feeling that because they are celebrities they are somehow obligated to have no personal life what so ever. That's crap. They're here to entertain, that all.

40. Alot of people are mentioning this actress who was killed, and i think I remember that lady. It was horrible, I hope that that same tradegy doesnt befall hilary. I mean sure, Paparazzi and all that crazyness "comes with the territory" but I dont think that crazy stalkers who threaten to do harm "come with the territory" of being famous. I hope hilary and Joel are safe, I dont feel too bad for them because all hilary is going to do is hire like 12 more big body guards to protect her. "Normal" people are stalked everyday and killed, people who simply dont have the money to protect themselves in the way hilary does.

Hillary Duff is an actress, and she does not "deserve" stalkers any more than
anyone else because of her line of work! Anyone who says otherwise is a mean-spirited a**hole.

Princess Diana died in a car crash for much the same reasons. History should NOT repeat itself with Hillary.

45. Some of you have seem to have forgotten that stalking is a crime. Yes, unfortunately it does tend to go along with fame but that doesn't make it right or even that these celebs ask for it! People that stalk have severe mental illnesses. They seem, like Max, to think that these celebs are there solely for them. Most of us, those not in the aforementioned category, know that this is not so. People seem to forget that celebs are not "gods" they are human like (hopefully ;>)~ ) you and I. When they are not out promoting their latest endeavor LEAVE THEM BE!!!!! Famous or not they are entitled to their own lives and with that privacy goes without saying. The paparazzi are leeches. Jealous because they can't be famous in their own right. Max is a stalker who needs immediate mental medical attention but so do all of the paparazzi. The paparazzi aided in the death of Princess Diana. They've contributed to accidents amongst other celebs trying to flee from the ever prying eye. WHAT IS IT GOING TO TAKE FOR THESE LEECHES TO LEAVE THEM ALONE?!?!?!?! Gee, I wonder if I'm the only one that thinks that the paparazzi adds fuel to the fire for all of the stalkers.
