Mandatory Jail on the Line

Nicole Richie Nicole Richie could be adding stripes to her wardrobe in the very near future.

TMZ has found court documents which reveal that Richie pled no contest four years ago to driving under the influence. Under California law, if Richie is convicted of DUI as a result of Monday's arrest, the judge must impose a jail sentence.

The law requires a mandatory sentence of five consecutive days in county jail as well as a one year license suspension for anyone twice-convicted of DUI. In addition, Richie would be ordered to attend an alcohol education program for a year-and-a-half, even if the second conviction is not alcohol-related.

As TMZ first reported, Richie admitted to CHP officers that she had taken Vicodin and smoked pot before driving the wrong way on a Burbank freeway. A field sobriety test revealed she was not under the influence of alcohol.

Cop: "What have you eaten today?"
Nicole: "French Fries"

TMZ has obtained the police documents in the 2002 case. In the arrest report it reveals that Richie told cops all she had eaten that day were french fries. As for what she drank that day -- "1 shot vodka."

She blew a .12. and a .13 in two separate tests. In California, .08 is considered legally intoxicated. Richie was stopped in her Toyota Corolla after a UCLA police officer observed her blowing a red light and driving over a speed bump at more than 50 miles an hour in an area with a 15 mph speed limit. Richie flunked the field sobriety test -- her eyes were watery and bloodshot, and she could not keep her balance.

Richie was given three years probation for her 2002 DUI conviction and had her license suspended for one year. Six months later, Richie was arrested for possession of heroin and for driving with a suspended license.

What is her Father pretending not to know. You don't let a kid get this far out of hand without doing SOMETHING to help, even taking desperate measures if necessary. God Bless our young people, they seem to be lost.

She should go to jail, if this was a normal person like the rest of us our asses would be in jail for at least five days. You are supposed to learn from your mistakes that is why the law punishes with fines or jail time, she obviously did not learn from her first mistake, which was just a fine, so this one should be harsher. She obviously has money why couldnt she just take a cab, oh wait she couldnt be seen getting out of a cab its to yellow and its a ford or chevy when she only rides in imports. American cars made my american people are not good enough for her. I only hope the judge is not pressured (being that the person he is going to sentence is a celebrity) to just let her off with a fine and probation. If he has any integerity and respect for the legal system he will throw her rich A_s in the jail for a few days.

Well you have to admit it's pretty sad to see this happening in anyone's life. It doesn't matter who you are, where you come from, how good it may seem on the outside...... drugs and alcohol are not biased, or judgemental. The disease is just happy you're feeding it again. . I would pray that this may be a wake up call to those in and around Nicole's life that care for her. It's obvious she needs help, like any addict or alcholic does. I have 9 years clean and sober myself and I know that if you don't face the demons inside and work on yourself, you will never get better. Being an addict & alcoholic is like having 2 people that live inside you. One wants to see you live, be happy, know love, give love, and attain all that your heart and soul desires. The other wants to destroy you, take everything and everyone you've ever loved away so that it can have you to itself to be miserable, anguished, humiliated, and alone..... oh yeah and to have you drink and use over those feelings as well. And when it's done with you then oh well.... NEXT!
Nicole.... get help, PLEASE. For yourself, for your sake and for the lives that one day you might take (if you don't). God Bless YOU!

For all of the people who have sympathy for this rich spoiled brat I was just wondering if you have lost anyone to a driver under the influence. I think your attitude would be a lot different. Talk away her license, make her do the jail time that normal people would and save innocent lives. I don't care if she starves herself to death as that is her business and it won't harm anyone else.

This is really sad, because of her celebrity status she will probably get away with the crime,and do no time. She needs to go to rehab and be court ordered to stay for a long time and away from her chemically dependent friends.She is in the public eye, and she is not a good example for any child to see or follow.She needs help and the court system needs to do their job and make her pay for the crime,with rehab included.

It doesn't make you a bad person, it's a lesson you have to learn on your journey through life. Can we go back to making fun of Lindsey Blohan now? She provides so much idiot scandal and she needs our attention. Leave Nicole alone. If you are in your 20's, you can guarantee that you and most of your friends will be arrested for DUI at least once.

HER ACTIONS WERE DEPLORABLE NOT JUST BY PUTTING OTHERS AT RISK WHILE DRIVING UNDER THE INFLUENCE, BUT BY SENDING A MESSAGE TO OUR DAUGHTERS THAT IS OK TO GET HIGH AND DRIVE...AS A MOTHER AND A PROFESSIONAL THAT WORK WITH OPIATE DEPENDENT PATIENTS, I BELIEVE IT IS HER DUTY AND HER FAMILY DUTY TO TAKE RESPONSIBILITY AND BLAME..SHE SHOULD BE MANDATED TO TREATMENT AND LOOSE HER LICENSE...OUR KIDS AND US PAY TO KEEP HER AS AN IDOL AND A ROLE MODLE, SHE OWES US THE SAFETY AND WELL BEING OF OUR KIDS.....
