Mandatory Jail on the Line

Nicole Richie Nicole Richie could be adding stripes to her wardrobe in the very near future.

TMZ has found court documents which reveal that Richie pled no contest four years ago to driving under the influence. Under California law, if Richie is convicted of DUI as a result of Monday's arrest, the judge must impose a jail sentence.

The law requires a mandatory sentence of five consecutive days in county jail as well as a one year license suspension for anyone twice-convicted of DUI. In addition, Richie would be ordered to attend an alcohol education program for a year-and-a-half, even if the second conviction is not alcohol-related.

As TMZ first reported, Richie admitted to CHP officers that she had taken Vicodin and smoked pot before driving the wrong way on a Burbank freeway. A field sobriety test revealed she was not under the influence of alcohol.

Cop: "What have you eaten today?"
Nicole: "French Fries"

TMZ has obtained the police documents in the 2002 case. In the arrest report it reveals that Richie told cops all she had eaten that day were french fries. As for what she drank that day -- "1 shot vodka."

She blew a .12. and a .13 in two separate tests. In California, .08 is considered legally intoxicated. Richie was stopped in her Toyota Corolla after a UCLA police officer observed her blowing a red light and driving over a speed bump at more than 50 miles an hour in an area with a 15 mph speed limit. Richie flunked the field sobriety test -- her eyes were watery and bloodshot, and she could not keep her balance.

Richie was given three years probation for her 2002 DUI conviction and had her license suspended for one year. Six months later, Richie was arrested for possession of heroin and for driving with a suspended license.

not onlly nicole ritchie shold serve time allthe rest should to they are no better then the rest of us my friend got in trouble for having her baby in front seat but brittanny got nothing / if normal people show private parts they get arrested two different standards what kind of law is that

hey Michelle (comment #2) the article stated that she was pulled over in 2002 while driving a toyota... the fact the she drives a 2005 mercedes doesn't even come into play, seeing as how it's 2006 (again, the article stated that her original arrest was FOUR YEARS AGO).... I really wish the folks posting comments on here were actually math literate... or would at least take the time to READ before posting!!!!

The Toyota she was driving was for the 2002 ARREST!!!! The one shot of vodka and french fries was AGAIN FOR THE 2002 ARREST!!!!!!!

The vicodin and weed for this 2006 arrest... if you're going to comment at least read the article correctly!!!!!!!!

She deserves to be in jail... regardless if you like her or not. She could have injured and/ or killed people. This is not being blown out of proportion... its called LIFE!!!! and deals with her disrespect for the value of other people's safety.

Okay, Let's not make this a racial thing. It's about celebrity and money, but if you've broken the law, you've broken the law--end of story. We all know that there really isn't 100% justice in our judicial system so she probably won't get the punishment that the rest of us would get. I agree with other bloggers who say that Nicole truly has issues and needs psychiatric and medical help. I think that when you are given everything on a silver platter and not taught to appreciate what you have in life, that it leads to acting out in the way that Nicole and other people in the public eye act.
For example, think of all the child actors who were fortunate enough to work in the industry, but have gone to the dogs (The curse of the Different Strokes Kids, River Phoenix, That neighbor girl from full house, ) I could go on but I won't.

I think she should be given the standard routine like everyone else has to go through if they abuse the DUI laws. If you will all notice, the Toyota and the vodka/frenchfrie was a prior arrest. THIS time it was her Mercedes, Vicodin and pot. Unfortunately, she probably will not do time although maybe the judges are getting tired of the celebrities abusing the laws.. She may be made an example of... hopefully. We'll see what happens. The girl definitely needs help, she is on a road straight to hell for sure.

ZIP #85 - I would seriously question that she is even getting her period at that weight as the body goes into "survival mode" during starvation. Sounds like a nifty excuse for why she was taking vicodin, ie. like "the dog ate my homework, or my grand______died and had to go to the funeral." And anyone suffering from PMS or cramps should try to avoid caffeine (RED BULL is loaded with it) and salt (which most people know junk food is loaded with) due to the fluid retention it causes. That is one reason salt is put on meat duriing cooking; it increases fluid retention adding to "juiceiness."

If she goes to prison her popularity will soar higher than you can possibly imagine, for all that is holy, I do not understand this one.
for whatever she does she has publicity more than I have seen regarding any celebrity in quite some time. The more messed up she is the more popular she becomes, so with that said, going to jail is going to propel her to super stardom, it will watch.
Interviews from the pokie with Nicole in prison garb with a few heman lesbian in the background with cigs and tatoos, oh my god this wil defiently take her over the top.

im steve from cali ...i love nicole richie ...shes a real blasts ....she shouldnt be treated badly .....shes been through alot in the pasts with her dad as a drug addict ...she was losts ...justs suspend her lic thats what i think .....and also na meetings would be good ..its the law you can get help besides jail ...really whats 5 days gonna do nothing really i know she had a pasts of pacificcoasthwy1 she got popped but shes in a rich life where partys are near ...she justs got losts i believe that seriously godbless her soul from steven in southern cali victorville

She should receive jail time. It should not matter who she is, how rich she is , and how famous she is. My wifes father was killed by a drunk driver and you cannot imagine the pain and suffering she endures day by day. Nicole Richie. I cant believe HOLLYWOOD condones this behavior. It makes me sick.
