Richie Has Prior DUI -- Mandatory Jail on the Line

Nicole Richie Nicole Richie could be adding stripes to her wardrobe in the very near future.

TMZ has found court documents which reveal that Richie pled no contest four years ago to driving under the influence. Under California law, if Richie is convicted of DUI as a result of Monday's arrest, the judge must impose a jail sentence.

The law requires a mandatory sentence of five consecutive days in county jail as well as a one year license suspension for anyone twice-convicted of DUI. In addition, Richie would be ordered to attend an alcohol education program for a year-and-a-half, even if the second conviction is not alcohol-related.

As TMZ first reported, Richie admitted to CHP officers that she had taken Vicodin and smoked pot before driving the wrong way on a Burbank freeway. A field sobriety test revealed she was not under the influence of alcohol.

Cop: "What have you eaten today?"
Nicole: "French Fries"



TMZ has obtained the police documents in the 2002 case. In the arrest report it reveals that Richie told cops all she had eaten that day were french fries. As for what she drank that day -- "1 shot vodka."

She blew a .12. and a .13 in two separate tests. In California, .08 is considered legally intoxicated. Richie was stopped in her Toyota Corolla after a UCLA police officer observed her blowing a red light and driving over a speed bump at more than 50 miles an hour in an area with a 15 mph speed limit. Richie flunked the field sobriety test -- her eyes were watery and bloodshot, and she could not keep her balance.

Richie was given three years probation for her 2002 DUI conviction and had her license suspended for one year. Six months later, Richie was arrested for possession of heroin and for driving with a suspended license. Nicole Richie gallery: Click to launch photo

20. First of all the #2 Michelle, we know what she drives now....the toyota and french fries and shot of vodka was referring to the 2002 DUI just before the heroin arrest. Read the articles people before you comment.

With past history there definitely needs to be consequences for her as well as HELP!!!!! I do not doubt with the almighty $$$$$ she could get off even with her second DUI, however if her family and her DAD wants to keep her ALIVE, let her pay for her actions, stop enabling and get her into a RESIDENTIAL treatment center, and not one that caters to the rich and famous and gives them there cell phones and meds if their left toe hurts, but rather one that has ALOT of rules and regs and holds people accountable for their actions.

21. Instead of whoring around with his back up dancer in an affair then making babies perhaps Lional should have been more concerned with the daughter he had already adopted. Maybe things would be different now. I like Nicole, but five days isn't the end of the world. Maybe this will help her get some control over her life. Obviously she doesn't have anyone around her who cares enough to help.

23. ok, first they report she was under influence of alcohol and pot and vicodin...then she's wasn't....

then, she was driving an SUV mercedes and now TMZ had it down as a Toyota Corolla....not even an SUV....the 911 call said SUV, heard it...

25. #5 HOW CAN YOU SAY THAT WAS A LITTLE MISTAKE? THE GIRL WAS DRIVING ON THE WRONG SIDE OF THE FREEWAY! DO YOU KNOW HOW HORRIBLE OF AN ACCIDENT SHE COULD HAVE CAUSED. LOOK I REALLY LIKE NICOLE RITCHIE BUT COME ON. THAT WAS NOT A LITTLE MISTAKE. NOW IF SHE WAS SOBER AND ACCIDENTLY TURNED WRONG THEN I WOULD CUT HER SOME SLACK BUT THE POINT IS SHE WAS NOT SOBER! 26. I completely agree with #23. She could have easily killed herself or someone else. Then she'd be looking at a vehicular homicide charge ... not simply 5 days in jail.

27. I think its very awful that she would do such a mistake again. Nicole did it once why wouldn't she do it again if she was punished enough? I know people make mistakes but if you do it again maybe she should serve time which I don't think will happen anyway because she has money. But think about it....if something would've happen, if someone would've gotten hurt,...IF SOMEONE YOU LOVE OR YOURSELF WOULD'VE GOTTEN HIT BY THIS IGNORANT WOMAN. YOU KNOW THIS WOULDN'T BE A JOKE! I hope she doesn't get off easily on this one. I've never care for Nicole but now I'm really disgusted by her. PEOPLE SHOULD BE PUNISHED FOR THEIR MISTAKES OR THEY WILL NEVER RESPECT THE LAW!!!

And while we are at it, some of you need to learn simple vocabulary and need to learn how to spell the most simple words. Nicole was busted 4 YEARS ago. At that time, she was NOT 85 pounds.

I don't give a damn who she is or who her daddy is, she belongs in jail! Lock her sorry a$$ up, I doubt she'd learn anything. At least she won't be out driving the roads high/drunk/whatever & possibily kill someone. If you or I would be locked up, so should she. She ain't special, she just got lucky on who decided to adopt her is all. She really should think about that, and be thankful for every single friggin' thing she has.

Hey, Lionel Richie, take your "poor little rich girl" to a few hospitals & have her spend time with people who are suffering because of someone driving impaired. Why not start with the 2 girls from Lane's car wreck? I refuse to call what he did an accident, cause he choose to drink & drive, that's NO accident. (I'm sure I'll hear about the girls in Lane's story drinking too, but THEY WEREN'T BEHIND THE WHEEL!) Broken bodies, mangled brains...not too pretty, huh? That's what partyin' can get you...

30. I agree with #15. She will never see the inside of a jail cell.

She's obviously got (or had) a substance abuse problem and it's quite obviously gotten her in trouble in the past (prior DUI, heroin bust), but money buys you the best lawyer and rehab, it's just that simple.

Truthfully, if money can keep Nicole (or anyone else in her position) from realizing the full consequences of her behavoir, then in the long run, it's really a disservice to Nicole. And to who she may kill next time she gets behind the wheel.

Look at Tawny Kitaen! She was caught with FIFTEEN GRAMS of cocaine WITH her kids in the home. Anyone else would have had children's services yank the kids, and they would have done hard time for that feloney. But no, she's getting rehab. It's a joke. And she's not nearly as high profile as Nicole.

Nope, Nicole will do no time. Just rehab. Watch.
