Richie Has Prior DUI -- Mandatory Jail on the Line

Nicole Richie Nicole Richie could be adding stripes to her wardrobe in the very near future.

TMZ has found court documents which reveal that Richie pled no contest four years ago to driving under the influence. Under California law, if Richie is convicted of DUI as a result of Monday's arrest, the judge must impose a jail sentence.

The law requires a mandatory sentence of five consecutive days in county jail as well as a one year license suspension for anyone twice-convicted of DUI. In addition, Richie would be ordered to attend an alcohol education program for a year-and-a-half, even if the second conviction is not alcohol-related.

As TMZ first reported, Richie admitted to CHP officers that she had taken Vicodin and smoked pot before driving the wrong way on a Burbank freeway. A field sobriety test revealed she was not under the influence of alcohol.

Cop: "What have you eaten today?"
Nicole: "French Fries"



TMZ has obtained the police documents in the 2002 case. In the arrest report it reveals that Richie told cops all she had eaten that day were french fries. As for what she drank that day -- "1 shot vodka."

She blew a .12. and a .13 in two separate tests. In California, .08 is considered legally intoxicated. Richie was stopped in her Toyota Corolla after a UCLA police officer observed her blowing a red light and driving over a speed bump at more than 50 miles an hour in an area with a 15 mph speed limit. Richie flunked the field sobriety test -- her eyes were watery and bloodshot, and she could not keep her balance.

Richie was given three years probation for her 2002 DUI conviction and had her license suspended for one year. Six months later, Richie was arrested for possession of heroin and for driving with a suspended license. Nicole Richie gallery: Click to launch photo

91. O.K., I've been reading these posts here on TMZ for a few days now, and this one, with the ignorant people whom can not read, has me posting.

First of all, there are 2 separate incidences they are writing about. The first was 4 years ago, when she was driving the Toyota, and she blew a .12 and .13 on the sobriety test. She was drinking alcohol at the time.

The second was recently, and while she did not fail the breathalyzer, she admitted to smoking pot and taking vicodin ( a prescription drug).

It is because of the first offense that she may receive jail time for the second.
Please, I beg you, read the article first before commenting.

Now, I believe that she should do the jail time for this incident, and I believe she will be forced to do it as another example to us and the celebrity community whom have been doing what they want unchecked for a while now. However, I don't believe she will freak out over it or anything like that. I believe she will believe it is cool to have been in jail, and will probably make for good conversation for her and her friends when they go out partying again. In fact, I bet they all go out partying the day she gets out to celebrate her release. She will not learn anything from this incident. The only way she will straighten up is if SHE wants to straighten up. Her dad and anyone else won't matter. Unfortunately, she isn't going to learn and will probably end up seriously hurting herself or someone else before she wakes up.

As for the blog-haters, I can't quite grasp why you are talking crap when you are in actuality commenting on what other people are writing, and therefore are hating on yourself. Interesting what ignorance will bring out. Well, I had a nice laugh at your expense, anyway.

98. People, can't you read. The toyota, the french fries, the speed bumps and vodka were part of her 2002 arrest. She wasn't drinking 1 shot of vodka, smoking weed, popping vicodin and driving the wrong way down the freeway over speed bumps. SInce when do freeways have speedbumps? Before you comment, make sure you get all the facts straight.

That said: She's a menace and if they don't enforce jail time, there's no consequences for her. Next time, she just might kill somebody.

100. She will get community service, and ordered into rehab, random drug testing for up to a year once getting out of rehab. It seems like a cry for help, and now, she will get all the help that she don't want. But truley needs.

This makes for a good Reality TV episode, for Nicole.

101. I wouldn't be surprised at all if she doesn't get jail time this time. They have to prove that she was actually under the influence and technically incapable of driving. And no one has reported at what point she had taken the vicoden or pot before she got in her car. It could have been way earlier in the evening. Look at her mugshot...she doesn't look stoned at all. Yes she went the wrong way on a ramp, but anyone sober can do that. It will probably be difficult to make a case. However, I'd be more surprised if some of you people actually got your facts straight. The toyota, vodka and fries, not to mention the to failed sobriety tests were from 2002. The weed and vicoden were taken THIS WEEK and had nothing to do with the other. Jeeze. I have no love for Nicole and think she probably needs to gain some focus, but seeing how some people can screw up the facts so quickly- I'm not totally going to condem her either.

105. This ...look at me.... shove it in your face..... I've got money............I can do anything.........ARROGANCE has got to stop. She needs JAIL TIME.. REAL TIME.. LIKE ONE YEAR and pull the license for a year. And don't let her bring in her own food. That would be a mockery of our justice system.. I just hope and prey that there is a judge that can stand the affluent heat and rule according to the seriousness of her actions. At this juncture, let's all band together and WATCH WHAT THE JUDGE DOES!
