The Beach BoysWouldn't it be nice if you could wake up ... and find out that a crazy judge didn't pull the rug out from under you?

The Beach Boys just learned a hard lesson about the American justice system. TMZ has learned that on December 11, Danny Morin, the lawyer from Brother Records Inc. (The Beach Boys' company), showed up 13 minutes late for a court hearing in Los Angeles Federal Court. Judge Manuel Real, legendary for his explosive tirades, sent some seriously bad vibrations through the courtoom by dismissing The Beach Boys' case.

Brother Records Inc. filed the lawsuit last January, seeking $20 million in damages from two men who allegedly stole a treasure trove of band memorabilia from a North Hollywood warehouse. The band claimed that Allan Gaba, owner of the warehouse, and his friend Roy Sciacca, pilfered such items as Brian Wilson and Mike Love's contract for the song, "Do It Again," photos of the band with George Harrison, and original music compositions.

The hearing on December 11 was a final pre-trial conference, the last stage before trial. Even though Attorney Morin's office made several calls to the clerk advising that the mouthpiece would be a bit late, it didn't sit well with Judge Real. We're told The Beach Boys are none too pleased, and Morin is asking the judge to reconsider. Don't count on it.

17. There is NO WAY the dismissal will stand on appeal or a motion for reconsideration.... an attorney's lack of punctuality cannot prejudice his client this egregiously.... to put it melodramatically, that would fly in the face of justice.

18. I have personally witnessed Mr. Real in action. He personifies all that is wrong about the judicial system in y opinion. I have actually witnessed him tell a defendant that if he (the defendant) mentioned the constitution in his defense he would find him guilty on the spot. "The constitution has no place in my court" I heard him admonish the defendant. The guy just goes off and rants for periods of time. Its one thing if admonishment has a good purpose but he takes things into the never, never land of juris prudence. The guy is, in my opinion, senile and needs to be removed from the bench.

19. Manuel Real is a jerk. He's been a jerk for decades now. He's the epitome of why there needs to be a constitutional amendment to limit the terms of federal judges. He probably wakes up every morning and asks why God is in his chair.

20. An attorney showing up late is nearly inexcusable, but let me tell you something, this judge is a real piece of work! What a flaming hypocrite!!! He throws out a case because an attorney is late? Meanwhile, he himself is involved in criminal activity. Here's the info:

22. The Judge should have sanctioned the attorney.
He is punishing and denying the plaintiffs their constitutional protected right to sue. The Judge is a loose canon.
