CHP: Brandy Should Be Prosecuted for Fatal Crash

UPDATE: TMZ has obtained photos of the horrifying aftermath of Brandy's car crash.


The California Highway Patrol has recommended that singer-actress Brandy be prosecuted for misdemeanor vehicular manslaughter. A CHP source tells TMZ his department has ruled out mechanical malfunction as the cause of the crash. The source adds that the CHP believes Brandy "was just going too fast" and "was the person at fault."

If convicted, Brandy could face one year in L.A. County Jail and a $1,000 fine.

TMZ broke the story that Brandy was involved in a wreck on a Los Angeles freeway on December 30, 2006. The accident claimed the life of 38-year-old Awatef Aboudihaj. An eyewitness tells TMZ Brandy was traveling at around 65 miles per hour but did not stop when traffic in front of her slowed. Brandy's vehicle struck the vehicle in front of her and triggered a four car crash. There is no evidence of drugs or alcohol and Brandy was not arrested.

A CHP rep tells TMZ that although his department believes Brandy's negligence caused the crash, he does not believe the accident was caused by gross negligence. If officials found gross negligence, Brandy could be prosecuted for felony manslaughter.

16. She murdered that women. Its against the law to be eatting and using a cell while driving. Also wreckless driving charges contributed to this murder, this was no accident!!!!

17. Everybody knows the LA cops are RACISTS! Remember Rodney King? If my sister was white this sh*t would of been over by now and no charges what so ever. Anyways, they can't railroad her because she's gonna get the best attorneys and beat the rap. My sister is rich, famous and African American. You go girl, you ain't got nothing to worry about. 19. It's a catch 22. I don't want her to go to jail over this but I feel for the family of the victim. How come the ones that don't drink and drive, are the one's that get dealt the bad hand. Had she been under the influence, I would have said 100% yes she needs to be convicted but this was a simple mistake. She didn't mean to hurt anyone. This is a terrible tragedy for Brandy, the victim and her family. God be with them all.

24. A guy did the exact same thing last week where I live. The driver was traveling on the highway at 65 mph and didn't see the traffic stopped ahead. The car that he rear-ended burst in to flames and killed six people. The driver is being charged with misdemeaner vehicular manslaughter. Looks like Brandy is being treated like everyone else. It is a sad story for everyone involved.

25. If this were my child, killed by the hands of a careless driver....I'd want them to be prosecuted, whether the person was famous of not......the fact that it was Brandy, as opposed to a regular every day person....really shouldn't matter......

27. It's really sad, because what Brandy was doing was probably something we've all done -- stopped paying attention to the road for a moment.

There is no positive in this situation, so let's not bring it down a few more notches by throwing hate around. A woman is dead, and another woman, who didn't mean any harm at all, is responsible for it.

28. I work in and understand the legal system. From everything I've read so far this was what it was - a horrible accident. Brandy admitted guilt and showed massive remorse at the scene of the crime. No one wins in this situation. Brandy will be haunted by this for life and the victims family is without a loved one. No one wins here. We all need to deeply examine our own hearts. This has nothing to do with celebrity or money. This was an unfortunate and horrible accident. Will she do time - No! Will she pay - yes - probably at her own jestures.

29. I have one thing to say and one thing only. It is very unfortunate that someone's life was lost in all of this, but an accident is JUST THAT an ACCIDENT. If Brandy had been drunk or under the influence of drugs then that would be a different story. These things happen, and we can not question them. I for one hope that the family gets through this difficult time with as little of grief as possible, but again it was truly an accident. Brandy keep your head up sister, and pray because only GOD is your true judge honey :) My prayers are with both the young woman who lost her life's family, and Brandy's family as well.

30. I feel that just because she is a celebrity she should not get special treatment.

She did kill someone. Even if she did not mean to.

Imagine if the lady thats dead was someone special to you. How would you feel?
