CHP: Brandy Should Be Prosecuted for Fatal Crash

UPDATE: TMZ has obtained photos of the horrifying aftermath of Brandy's car crash.


The California Highway Patrol has recommended that singer-actress Brandy be prosecuted for misdemeanor vehicular manslaughter. A CHP source tells TMZ his department has ruled out mechanical malfunction as the cause of the crash. The source adds that the CHP believes Brandy "was just going too fast" and "was the person at fault."

If convicted, Brandy could face one year in L.A. County Jail and a $1,000 fine.

TMZ broke the story that Brandy was involved in a wreck on a Los Angeles freeway on December 30, 2006. The accident claimed the life of 38-year-old Awatef Aboudihaj. An eyewitness tells TMZ Brandy was traveling at around 65 miles per hour but did not stop when traffic in front of her slowed. Brandy's vehicle struck the vehicle in front of her and triggered a four car crash. There is no evidence of drugs or alcohol and Brandy was not arrested.

A CHP rep tells TMZ that although his department believes Brandy's negligence caused the crash, he does not believe the accident was caused by gross negligence. If officials found gross negligence, Brandy could be prosecuted for felony manslaughter.

I think she should be charged as an example of how tired all of us should be that people, especially females do not pay attention to the road because they are either speeding or talking on their damn cell phones. There was a national survey done where it does conclude that male drivers are safer behind the wheel than female drivers. I heard it really pissed off the femnist (NOW) National Orginization For Women) but the truth hurts , so what can I say. I mean , there's a woman who lost her life here, is there no accountability anymore?

320. Also, all this talk of money is bs. Money is the last thing the parents of the victims should be worried about, they should be focused on how to help theirgrandchildren through the tough raod ahead. The fact is it was an accident and to suggest that she gets life in prison for an accident is ridiculous. To the person whose uncle received 20 years, all you've presented was a vague description of the events and only enough to make it seem like your relative was completely innoent (except of knocking down a pole). You and I both know there was another reason why he was given that sentence.

322. This was the product of an accident - the kind that happens hundreds of times everyday in every state. The only difference in this instance is once again a celebrity is involved and that is why it is getting this kind of attention. Though Brandy is a celebrity, she is first and foremost human and we (humans) make mistakes, she is remorseful and grief stricken. The family of the young lady has lost a mother, a wife and friend. Let us not pass judgement, but instead focus on the grief that both sides are suffering. Let us pray that they will come through this situation as whole as possible.

323. This issue is not about black or white - rich or poor. It is about an accident pure and simple. I am an African American and very proud of it, but I get sick and tired of some of my brothers and sisters making EVERYTHING about race. It's about people. Simply being a black person or a white person doesn't make you good or bad. Being A BAD person makes you bad. Being a GOOD person makes you good. These things have no color. I know plenty of good white people and plenty of bad white people just like I know plenty of good black people and bad black people. Emotions like LOVE and HATE have no color.

324. Brandy it's a same that you are driving and not looking at where you were going.Especially in cali. Dont get me wrong you are human and we do make mistakes. This will only cost you money but you will always remember this. But you have learned a valuable lesson(Driving require's all of your attenion)

325. I can tell you from personal experience that this is so tragic. I was in this almost same horrific accident but I was the victim and I still don't know what made the lady in my accident come clear across the road at 60 miles an hr. But I was driving the SUV and thank God I was, she is still in a coma. had I not tried to avoid her she would of killed all eight of us 7 children and 1 adult. Funny her husband still feels I'm partially at fault. Like i said she came frm tha opposite side of the road at me. I feel very much for Brandy, I thought I had killed that lady and I cried for 3 months straight almost daily . Brandy I know you made a mistake and I am so glad you owned up to it. GOD BLESS YOU BRANDY, my prayers are with you. aand the victim 's family so are they with you and to the others involved.
