CHP: Brandy Should Be Prosecuted for Fatal Crash

UPDATE: TMZ has obtained photos of the horrifying aftermath of Brandy's car crash.


The California Highway Patrol has recommended that singer-actress Brandy be prosecuted for misdemeanor vehicular manslaughter. A CHP source tells TMZ his department has ruled out mechanical malfunction as the cause of the crash. The source adds that the CHP believes Brandy "was just going too fast" and "was the person at fault."

If convicted, Brandy could face one year in L.A. County Jail and a $1,000 fine.

TMZ broke the story that Brandy was involved in a wreck on a Los Angeles freeway on December 30, 2006. The accident claimed the life of 38-year-old Awatef Aboudihaj. An eyewitness tells TMZ Brandy was traveling at around 65 miles per hour but did not stop when traffic in front of her slowed. Brandy's vehicle struck the vehicle in front of her and triggered a four car crash. There is no evidence of drugs or alcohol and Brandy was not arrested.

A CHP rep tells TMZ that although his department believes Brandy's negligence caused the crash, he does not believe the accident was caused by gross negligence. If officials found gross negligence, Brandy could be prosecuted for felony manslaughter.

92. Brandy should be prosecuted because she caused the death of another person. It would have been better had she been DUI. At least then she would have had an excuse. She should get at least 1 year in prison and her driver's license revoked permanently. Someone is dead because she's a sh*tty driver.

93. Seriously!? I'm sure the family of the deceased is really appreciative for showing these horrible pictures. It makes me sick. My mother passed away in a horrible car accident and our local paper put a picture of the accident and the workers trying to save her. That image haunts me to this day! Have a little respect TMZ!!!

I do not even know why I am bothering since so many here have become the judge and jury and already convicted her in your mind but think of it if she were not a celebrity, black, or any other factor. Almost everyone has been there but were fortunate enough that it did not cause an accident or no one was killed as a result. That is why car wrecks are called ACCIDENTS. That is also why everyone carries car insurance. If you were beyond doing something negligent, you would not need car insurance as the only time you were involved, someone would be paying you. We pay for insurance to cover expenses anyone inccurs because of our own negligence (something everyone has done at one time or another in their lives)!
Can anyone here answer the question of how long did she have to stop her car? How do you know that someone did not slam their brakes in front of her because they were unfamiliar with the freeway or distracted themselves? I have drove long distances and had a second or two where I lost focus or even looked at something at the side of the road. Maybe she just did not have enough reaction time folks for whatever reason! They say that there appears to be nothing in the car that she was blatantly distracted with. That meaning probably that her phone was not lying right next to her when the car hit or there being food where she was eating sitting right there. PEOPLE LOSE FOCUS ON THE ROADS ALL THE TIME!!! ALL OF US have done that at one time or another but no one here wants to admit to it.
Just because Paris, Lindsay, Lane, Nicole, and the others in that bunch have been drunk drivers, careless, etc. does not mean that all celebrities are. We should not assume anything. She seems obviously very shaken by this and will have to live the rest of her life with the blood of the victim in her mind and on her hands. That is like a lifetime sentence on its own. If she has any conscience at all, she will never be the same again and will be sad at times the rest of her days. Personally, I would rather be killed in an accident than my mistake cause the death of another person. Trust me, she is paying for her mistake!

95. If her negligence in watching the road while driving resulted in a death she should be brought to trial. Simple. I know if I smashed into 4 0r 5 vehicles on the freeway after failing to slow down and caused a death on top of it, I'd be brought to trial and probably sued by the victim's family. She should be held accountable for her actions.

96. lol Okay, seriously. TMZ needs to STOP referring to only by her first name. It's pathetic for them (TMZ) and it's just self-indulging to this spoiled nobody (her). Just because a celeb chooses to guy by a first-only does not make it so. She's NOT a Cher. She's not even a Madonna. She's Brandy Norwood through-and-through, that's all. She's a middling actor and singer who broke it quasi-big in an average-run (length) sitcom (5 or 6 years). You don't see that ugly chick from 'Blossom' only going by a first name-only.

98. I think it is in poor taste for TMZ to post photos of the vehicle the woman was killed in with a woman next to her car and on a stretcher.

The car is one thing...posting photos of the victim who is now deceased is poor judgement.

102. Hey Farrah... in an early posting you said "remember Rodney King"... Well, let's recap the events of that infamous night. March 3, 1991, California Highway Patrol officers saw King speeding on Interstate 210 and reportedly chased him for 8 miles (13 km) at speeds around 100mph. When he stopped in Lake View Terrace, he did not obey repeated commands to exit the car or lie down and as can be seen in the first few seconds of the video, charged one of the officers, after which the police struck King with a PR24 baton that put him on the ground. King's black male passengers were taken into custody without incident and later released without charges.

Initially, a female highway patrol officer, Melanie Singer, approached King and drew her pistol. Officer Singer reported that King then turned around and shook his buttocks at her and did not comply with her commands. King also reportedly waved at the police helicopter that had him under spotlight. When the local police arrived, Sergeant Stacey Koon requested that Singer stand down and that weapons not be pointed at King. Force level was then escalated to verbal commands, to force King to comply but he refused. Koon then ordered four officers to swarm King, to force him into the felony prone position, but King threw all four of them off. Officer Koon fired a Taser on King twice, but King continued his attempts to get up. King was repeatedly told to put his hands behind his back and assume the felony prone position, but still refused to comply. At that point, rather than issue an order for the use of lethal force (choke hold or a gun shot), Sergeant Stacey Koon commanded the officers to use their PR24 batons to strike King's joints. Only after doing so was LAPD able to apprehend King.]

At trial, the defense for the policemen argued that the officers had legitimate reason to believe King was extremely dangerous and possibly on a mind-affecting drug such as PCP and that the force used was justified by that threat. One piece of evidence offered to support this argument was that King showed no response after having been shot by at least one Taser weapon (A single 50,000 volt Taser shot is enough to fell a buffalo.) The video also shows the officers repeatedly striking King while giving him verbal commands. However, the videotape shows King repeatedly trying to get up, despite the officers' verbal commands for King to assume the felony prone position. The officers later argued that they were responding to King's failure to comply with their commands, and that their actions were in compliance with standard police procedure.

So… where is Rodney now? In 2001 he was ordered to undergo a year of drug treatment after pleading guilty to 3 counts of being under the influence of PCP and indecent exposure. On August 27th, 2003 he would be arrested again on similar charges as his 1991 arrest. King was said to be speeding as he ran a red light while under the influence of PCP, and failed to yield to cops. The money King was awarded was used to pay his more than one million dollars in legal fees, and is now all but gone. Hmmm…. Mr. King seems like such a nice upstanding citizen, don’t you think?

Statistically speaking, blacks are more likely to be involved in crimes, and therefore there is a greater likelihood of clashes with the police when such crimes occur. I know you are going to say I am racist for saying that, but I am only speaking facts. Do I think all blacks are bad? Hell no! I don’t like the thought of police brutalizing people when it is unwarranted, regardless of the color, but Rodney King was no saint that night and should not be held up as an example.

105. Mike, rear ending someone these days doesn't make you a sh*tty driver. It just means you got busted. EVERYONE plays with the radio, the BB, the Sidekick, the cell phone, the burger, the eyeshadow, the nose or something while driving. EVERYONE has looked up to see traffic stopped.
