Tug of War Over Anna's Body

TMZ has learned that a fight is brewing over Anna Nicole's lifeless body lying in a Florida morgue.

Sources tell TMZ that Anna's mother, Virgie Arthur, wants to claim her daughter's body as soon as possible, paving the way for a proper burial. But Anna's mother, TMZ has learned, is not the only one who wants to claim the former Playmate's body.

We're told Anna's people have contacted Larry Birkhead's reps and tried to bargain. You see, Birkhead has a legal hold on the body per a Los Angeles Judge. If Birkhead releases that hold, Anna's reps promise to give him a sample of her DNA. But here's the catch: Anna's reps have not agreed to give Birkhead a DNA sample of the baby.

Even if Birkhead strikes a deal, it's unlikely Stern could claim the body since he had no legal relationship with Anna -- they were never married. It would seem that in this battle, Anna's Anna Nicole Smith Gallery: Click to launch photosmother has the upper hand.

31. i don't think that anna's mother is trying to milk anna's death. in fact howard K. stern is the one milking it. i just got no vibe of real emotion from him on the ET publicity stunt he pulled getting 1million for that stunt. seriously he cares!!!!!!!! YEAH AND BUSH IS GOING TO LET THE TROOPS COME HOME. i don't know who the baby's daddy is but i think that it shouldn't be all this hoopla on trying to get her DNA...what's the big deal. the big deal is they don't want the truth out there, if howard is the father then prove that, don' t just say that he is without any scientific proof. i just want the truth to come to light! but with all these lawyers and sh*t it won't. and for the record since howard wasn't legally married to anna nicole smith, her body by law will go to her FAMILY (blood relative that is)

34. Stern is a slimey pig - just like ANS was - only she was too stupid to even know it. They were a match made in heaven (or hell, depending on your perspective). They deserved what they got - and the 20 year old son is the only one who really lost in all of this. At least Birkheads baby has a shot at a decent life now.

37. Anna hated her whole family... Howard is the only one who has stood by her for years.. I hope he is the father of the baby.. i keep trying to look to see who the baby looks like but can't tell..

Anna's mother is only after press...so is the rest of her family her half sister who hasn't spoken to anna in 10 yrs is writting a book they are media whores..

38. Anna made her choices. She chose the lifestyle of a hollywood slut and jumped in bed with everyone she met. She introduced her son to the drugs that killed him and now left her daughter in this predicament.
She chose to be around the kind of leeches who wanted nothing but her giant fake breasts and her money, or to use her name to get famous and make some money themselves.
It is no surprise that her death is as sleazy as her life was. The saddest part is that she will never go away because there are millions of dollars to be made over the next 21 years as the media chases the daughter around to enteratain Anna's stupid fans.

40. What a tragic story this is everyone wanting to pretend they care. So sad
that the one thing the poor women wanted all her life was gone when
she lost her son. She just wanted uncondtional love and her son was
the ONLY one who gave that to her. The people around didn't care
about her well being if they truly did she wouldn't be dead now. She
needed compassion and therapy not DRUGS!!!! Mercy for her will
come where she is now she was flawed but had a sweet soul.

41. Isn't " Next of Kin" next of kin????? Whether you can stand your kin or not. Isn't that why it's called "Next of Kin"... Geez... this isn't rocket sience!

If anyone can petition a court to be named Next of Kin, then we are all in trouble!!!

Courts need to stay out of this one and let her mother bury her child! Many of us can't stand our parents, probably some worse than Anna Nicole but "Next of Kin" is just that!

44. ANS's relationship with her family was poor - but WHY? ANS lifestyle was not in keeping with any moral civility..................she was an exhibitionist, dope addict, alcoholic, nude dancer, playboy centerfold......... Her family was kept at bay by HKS - for his own personal gain. Just watch the film clips of ANS before HKS came into her life: she was bubbly, happy and very talkative. After HKS, she needed to be propped up, told what to say, and HKS was always there whispering in her ear, standing right by her, never leaving her side when she was in public. As an RN who has taken care of abused women - all their men stood right by their sides - hovering and talking for the woman, afraid to leave them alone, lest they tell us the truth. Larry B need ANS's DNA, as the baby HKS eventually will have to present for testing, so that ANS DNA can be matched to the baby HKS presents as hers. I think he is up to switching babies, just so the DNA does not match.
