Tug of War Over Anna's Body

TMZ has learned that a fight is brewing over Anna Nicole's lifeless body lying in a Florida morgue.

Sources tell TMZ that Anna's mother, Virgie Arthur, wants to claim her daughter's body as soon as possible, paving the way for a proper burial. But Anna's mother, TMZ has learned, is not the only one who wants to claim the former Playmate's body.

We're told Anna's people have contacted Larry Birkhead's reps and tried to bargain. You see, Birkhead has a legal hold on the body per a Los Angeles Judge. If Birkhead releases that hold, Anna's reps promise to give him a sample of her DNA. But here's the catch: Anna's reps have not agreed to give Birkhead a DNA sample of the baby.

Even if Birkhead strikes a deal, it's unlikely Stern could claim the body since he had no legal relationship with Anna -- they were never married. It would seem that in this battle, Anna's Anna Nicole Smith Gallery: Click to launch photosmother has the upper hand.

91. My opinion only- I think Anna & Sterns used each other. He for the free ride & publicity. She for someone to take care of her & allow her drug addiction. There was no love between them, just two people taking advantage of each other. I'm sure Sterns has little love for that poor baby, but will use her like he did her Mom. I hope someone will take that child soon & give her a chance for a normal life.

94. WHERE IS THE BABY? IS HKS HOLDING HER AS RANSOME?
SINCE THERE IS A PATERNATY SUITE WHY CAN'T THEY TAKE THEY BABY INTO TEMPORARY CUSTODY?
It should not matter that Anna hated her Mom, her Mom hated Anna’s life style and what Mother would not? It only matters that Anna was always drugged and not operating clearly, that HKS did not do right by her at all. WHERE IS THE BABY NOW?
I pray they can get the baby in temporary custody and away from him till it is ironed out.
I pray that on 2/27 when he goes to court for Daniel, he will be detained for a long time and forced to give the baby up till this matter is cleared up.

96. I can't believe you people. ANNA chose Stern to be with her! He was the ultimate GOPHER, he did everything for her, including, PUT UP with all her crap! NO ONE can stop a person from doing drugs!! There are millions of women that put up with/ or enable their alcoholic/druggie boyfriends/husbands, so that's their fault how? Anna, and only Anna was responsible for her life!

98. Anna'a mother should not be able to go near that baby. She hated her mother. Look what a fine job she did raising her own daughter. She didn't just magically come into this world F*cked up. Money grubbing bitch wasn't concerned enough for her grandson's welfare to call children's protective services. BTW, where was Daniel's father? Wht didn't he step in and do something?

It's Bahamian Law.........He is in the eyes of the law in the Bahama's "THE FATHER" of Dannielynn. That is what is on the Birth Certificate. Once again, the LAW in the Bahama's is looking into Daniel's death. There is an inquest on March 27th, where apparently 30 witnesses are going to testify. Everyone will have their day in court!

102. I think Howard loved Anna and I feel bad for him. However seeing him on ET I noticed that when he did look at the camera, he looked high himself. I liked Anna...she wasn't perfect by any means, she just desperatly(sp) wanted to be loved. The only one who loved Anna unconditionally was her son. When she lost him she lost her soul. Rest in peace Anna.

105. Anna did not like HKS in a sexual way. She liked him because he was her lawyer in her fight for her old grandfather husband's fortune. He kept her so filled with booze and pills he was like her pimp.
