Anna to Be Released Soon, Who Gets the Body?

[3:07] UPDATE: A Florida judge has ruled that he will not release the body of Anna Nicole Smith until he can determine the next of kin.

[2:00] TMZ has learned that a Florida hearing is underway to determine details for the release of Anna Nicole Smith's body.

A California judge is clearing the way for Anna Nicole Smith's body to be buried, but the question remains -- to whom will the body be released?

Moments ago, a California judge withdrew his request to put a 10-day hold on Smith's remains, meaning her body may be released and buried, pending a corresponding ruling from a Florida court. A decision is expected in the next few days.

16. If her mother gets the body though, she will take it back to TX - THAT IS WRONG. Burry this poor body beside her son. That is the ONLY right thing to do.

18. I imagine her mother will get the body, no one else has ANY legal claim. None of them are her legal next of kin..only her mother is. HKS has NEVER been her legal husband, so he has no claim...if they had ever legally married that would be different, but they didn't so he has no legal claim (no matter what he says). LB also has NO legal claim as he's also not next of kin.

Really this is a no-brainer.

20. The mother should bury her daughter. Nobody here knows the real story behind their relationship and their "so-called" estrangement. I believe her mother loved her daughter but didn't approve of her lifestyle. Anyone who is a mother here knows that. At least she's a true relative.

21. Howard should get the body of Anna. I think everybody is making him out to be such a bad person,but he really loved her. He is only guilty of loving her and his baby. Leave him alone and let her rest in peace. She is dead ,and all people can talk about is how bad of a person she was.GET OVER IT !!!!!!

25. I think her mother should get the baby and her body! I think her mother wanted the best for her and Howard brainwashed her while she was high on drugs all these years. Told her what to say and everything. A true friend who cares won't let you do drugs in their presence and just sit and tolerate it! They would have helped her through it and got her into rehab before this tragedy happened to her!!! I think Howard deserves nothing!

27. No way should Anna's mother have the remains. Anna hated her Mother. They are running an interview on ET tonight that they previously didn't show. Anna talks about how much she hated her mother and that her mother was abusive. She sisn't want anything to do with her. It is my understanind Anna and Howard were to be married 2/20/07. Let him bury her with Daniel.

I may be nuts, but I am kind of rooting for the guy. I mean Anna chose to be with him all these years. You can't blame him for her drug use. He is obviously drugged out as well.

as for her mother yes it's her daughter but in relaity Anna wanted nothing to do with her mother! how does that make her think she can claim the body! all she wants it for is to have money made! guarantee!

30. Anna's drug problem was the reason why she did not get along with her mother. Remember, her mom was a police woman of some kind.
Her mother should have her body.. but like Anna wanted, she should be buried next to her son.
But most importantly, someone needs to go get the baby away from Howard Stern. I believe that he is a dangerous man out for the money! The baby is not in a safe place based on two deaths and he is still the only one alive. No doubt! We all know that he is not the father!! It is a terrible thing when a person denies the rights of a parent to their child.

Any for whoever prescribed the drugs to Anna, you must be nuts!!! She was 8 months preggers when those drugs were written up. There is more than one guilty person in this situation.
