TMZ has obtained the will of Anna Nicole Smith, aka Vickie Lynn Marshall. The will is dated July 30, 2001 and was drafted prior to Dannielynn's birth and Daniel's death, and therefore indicates that Anna only had a son.
The will entrusts all of Anna's property and names Howard K. Stern as executor.
There were two witnesses to the will's signing, one of which was Kimberly Walther, Anna's former assistant.

If she left everything to Daniel, wouldn't it now go to his Estate, which would pave the way for HIS next of kin, HIS father, to claim the dough?

she had to have a reason to exclude specifically any other issue....did she have a child somewhere that she adopted out and wanted to exclude them...Her mother was good enough to protect her and raise Daniel for years until she commented on the drug use and Stern cut her out....if he knows he is NOT the dad, he is then a kidnapper...the baby is a US citizen and should be back here...Daniel could be also buried with family, he has NO one there. Bonnie stern said she was a good friend but also said she saw the baby for the first time after anna died.What a liar, since if she was such a good friend, she wasnt there to see the baby or for Daniels funeral!! Anna already took part in a burial dispute with her old husbands family, she decided to cremate him and split the ashes, why not do this with her remains now?

Why would Anna be allowed to buy her burial dress and pick out her own casket, but NO ONE THOUGHT ABOUT UPDATING HER WILL???? Where were her lawyers....3 lawyers at that, according to the will?? Anna was depressed, in shock, high on drugs. How could she think of this??

You think Birkhead looks like a "Player"? He sure looks alot more professional than the pics they show of $tern. $tern looks like a friggin lap dog. The two they show of Anna, Dannilynn and HK$. He looks like he is trying to plop on her lap and push the baby out of the way!! Did you also notice that the pic of Anna in the hospital look like she was off drugs and him on them and the one of them later, she looks like she is in lala land again. Did you also notice that $tern also had totally changed his appearence since Anna passed. He was clean shaven and now he is trying to support some kind o beard/goatee.

This is so sad. Had Howard Stern had Anna looked out for, he would of made sure that her estate would of been looked after in her behalf and should of been updated, since loosing her only son and giving birth to her daughter. To me, this looks fishy. He was the only one that he was worried about. If he was so involved in her life, it seems to me that he would of taken better care of her period, especially as her lawyer. He did no such thing. Seems like he just was out for everything he could get. Did you see the interview on ET when they asked him if he was the father? His response was not that of a happy father just having a new baby!!!! I think he needs to be looked into farther on the going ons of meds etc with Daniel and Anna. This is my 2 cents, thanks for listening.

I honestly believe that HKS is the only one trying to do what ANS wanted.
1. She didn't want Birkhead to get the baby (love between the two apparently turned to hate very quickly after they split).
2. She didn't want anything to with her mother and sister (both said such terrible things about her when she was alive).
3. She wanted to be burried next to her son (that's why she bought the adjoining plot).
4. She felt that everyone in her life that she had loved had either said terrible things about her or tried to sue her (Howard is still trying to keep those wolves away from her door).
When things were getting too rough in the Bahamas, Howard was trying to get her to Dubai where drugs and alcohol aren't so easy to come by and she might find some privacy and peace to mourn and recover from all her hurt.
I saw an interesting interviews with the CEO of Trimspa who knew them both well. He said:
Anna Nicole definitely wore the pants in the relationship.
Howard frustrated him because he was always trying to protect ANS, for example, making sure that she didn't work 12 hours a day.
At the end, Anna Nicole was desperate to marry Howard. She said she needed to have someone comitted to her in her life. Howard said the timing wasn't right and tried to persuade her out of it. In the end, they just had a commitment ceremony, not a wedding. If he was a money grabbing bastard, you would have rushed the wedding.
To those making judgement, you are assuming that ANS was rational and acting under normal circumstances - so that she would behave like you would have. But she wasn't. She was destraught over her son's death, depressed, drug and alcohol fuelled, hurt by a failed relationship with Larry and all her family who had turned on her, in pain from her breast inplant or whatever etc.
Its easy to say she should have done X, Howard should have done Y etc...
Its so easy to say and judge - but how do you really know what was going on?

Anna felt her son's soul was in Purgatory, I think she felt her son needed her help and to be together. He was her life.

The Will looks pretty bare bones boilerplate and appears to specifically exclude everyone except Daniel and Stern (and the alternate executors), including specifically excluding any future children, spouses, etc. However, the trust agreement presumably has (but maybe not) a provision for the possiblity that Daniel could conceivably predecease her. Could be the whole document is null and void. No doubt it will all end up in probate court and largely sit pending the results of the Marshall estate battle. And the long nightmare continues . . . .

I think she had a newer will drawn up. This is a ploy by the courts. Watch and new will pop up in the next few days along with the dna results.

Drugs will make you do and say alot of things you really don't mean. Just because Anna may have been estranged from her mother doesn' mean her mother still didnt love her. Will HKS be so ready to pay Annas expenses if she didn't have a littlemoney to bury herself. How would his parents feel if HKS had a girlfriend who wanted to make burial arrangements for him? I don't think they would like it. Maybe Anna and her son should be buried in texas. Maybe they won't feel so alone once HKS high tails it out of the Bahamas. HKS will never visit them regularly.

Even back in '01, Anna wasn't planning to live much longer! Daniel was, what, 15 back then? The Will states when he hits ages 25 and 30, he'll get money. Anna didn't think she would live a full life to old age and her 15 year old son would be much much older when she passed away. She thought she would be dead in 10 years or less from '01, I suppose.
Did the Will say she was of sound, mind, & body? Don't recall. Mother, Larry, whoever contests it, should claim she wasn't of clear mind at the time of signing the Will considering her drug use even back then.

HKS is going to profit no matter what. It doesn't matter if he doesn't end up the executor, doesn't get money from the will, doesn't get the baby. He will still get money because he represented Anna Nicole in her suit against J. Howard Marshall's estate, and he will get a hefty (up to 1/3) portion of any of the lawsuit money awarded to her estate. The Marshall case has been in litigation for 11 years, but it's going to be settled. HKS is going to end up rich one way or another.
Regarding the baby, I think the courts should trade the body for the baby. That way HKS can bury Anna Nicole next to her beloved son in the Bahamas and he can obsess over her the burial and make a big deal of it, and then normal people can care for the baby. Creeps me out that he still has Dannielynn--he MUST realize he's not going to get to keep her. Dannielynn is either 1) a bargaining tool for HKS regarding the estate, 2) a remnant of his obsession with Anna Nicole, or 3) a means to getting back at people he dislikes, like Larry Birkhead and Vergie Arthur.
