Nicole Richie and galpal Mischa Barton hit Malibu over the weekend. Nicole was behind the wheel of a Mercedes G-Wagon as the pair played with puppies at a pet store.

TMZ reported last Friday that Richie was charged with driving under the influence of "alchohol and drugs." We screwed up. It should have read "alcohol or drugs." In fact, there was no evidence of alcohol when Richie was arrested. She allegedly confessed to cops she had taken Vicodin and smoked pot.

By the way, Nicole has a right to drive while her case winds through the legal system. In California, if someone is arrested for driving under the influence of alcohol, that person's license is generally suspended before the case goes to trial. Since alcohol was not involved in the Richie case, she's free to roll down PCH.

3. California needs to change the law to suspend license if you are arrested for driving under the influence of any substance.

The way Nicole looks she will be the next one found dead from the results of drug use.

6. Actually your license is suspended with a few weeks after ARREST, unless you fight case with DMV (separate from DUI case). You have perhaps 10 days maybe more to appeal the suspension with the DUI! So Nicole may very likely be driving with suspended license. Many don't even realize their license is suspended if they don't read all the tiny print. MR. HARVEY LEVIN, Mr. ATTY!
Don't you know the DUI and DMV cases are COMPLETED SEPARATE CASES!
Learn CA law Harvey!!! I learned the hard way in real life. Also the suspension lasts usually 90 DAYS. Even if you win your DUI case, you still end up with suspended license. Of course it's not fair at all and is aimed to confuse people and land them in jail again!

The pet store owners lie about stuff like that, but that's where they buy from, often through brokers

As do those websites that ship puppies to you. ALL the puppy mills!
