52. to open your eyes ......... I have had 3 c-sections and twice I was 2 weeks past my due date and once I was right at my due date due to baby size they did not want me to go past that date. It depends on the doctor and medical condition as far as when a baby will be delivered by c-section.

they are not out for money your just plain wrong i feel for virgie and i hope she will get all she wants because when she was on the stand today she felt so confused with answering all those questions that were tough and one answer she was very
confused about was about the money part if she was in for the money but it is sad to see virgie in court she was very sad in the court room during some of the testimony give this lady a break and dont blame her for going after money thats not the issue.

55. #47.....Who claims anything was stolen...???...a dead woman? Don't think so. Howard?..Bingo! Why?....it wasn't his property.
Just because the owners of the house got there before Stern did and secured Anna's property, not Howard's?...means nothing. They claim it was Anna's wishes if anything happened to her. They don't have a reason to lie....does Howard? Hell yes!
All I'm saying is that if there was a doubt the "Clown" tape dispelled them all regarding Howard's integrity, morality, and intent.
Why don't some of you listen to the facts before spouting off?

A beautiful, full of life woman, with no self-worth....untrusting...and an addictive personality.
An educated man, who, over time, fell in love with a woman who did not love him.
An innocent son, who lost his life, due to his mother's lifestyle....and her associations.
An innocent daughter, who will never know her mother, her brother, and maybe even her father.
This whole story is about fame, money, deceipt, drugs and fraud. Many lives have been ruined....and many more will be.
Very, very sad for everyone involved.

Paternity Law May Work To Stern’s Advantage

The law of The Bahamas may work against Larry Birkhead, the ex-lover who claims to have fathered Dannielynn Hope Marshall Stern with the late Anna Nicole Smith, in his challenge of the Bahamian birth certificate listing Howard K. Stern as the baby’s father.
Mr. Stern, whose only client as a lawyer has reportedly been the late Ms. Smith, claims to be the father of her daughter, who was born at Doctors Hospital in September 2006.

He claims to have been the late model/actress’ lover for some time.

Mr. Birkhead is one of four or five men who have either claimed to be the child’s father or have had it claimed on their behalf.

According Mr. Birkhead, he is the real father of the baby girl, and Ms. Smith’s and Mr. Stern’s assertions that he (Mr. Stern) is the father are untrue.

However, the Status of Children Act 2002 seems to put the advantage in the affair squarely with Mr. Stern.

The law may, however, allow Mr. Birkhead some relief in terms of the ability to appeal.

Section 7(1)(d) of the Act makes the presumption that the father of a child is the person who was living with the mother in a relationship "of some permanence" at the time the child was born.

"Unless the contrary is proven on a balance of probabilities, there is a presumption that a male person is, and shall be recognised in law to be, the father of a child (if) the person was cohabiting with the mother of the child in a relationship of some permanence at the time of the birth of the child, or the child is born within 280 days after they ceased to cohabit," the law states.

As Ms. Smith and Mr. Stern had been living together in ‘Horizons’ on the Eastern Road prior to the child’s birth, and continued to do so up until Ms. Smith’s unpredicted death, this seems to give the weight of Bahamian law to Mr. Stern’s claim to paternity.

A subsequent section of the law, Section 7(1)(g), also seems to speak to the particular situation facing Messrs. Stern and Birkhead.

"There is a presumption that a male person is, and shall be recognised in law to be, the father of a child (if) the person has acknowledged in proceedings for registration of the child, in accordance with the law relating to the registration of births, that he is the father of the child," the law says.

Therefore, in Bahamian law, Howard K. Stern is the father of Dannielynn Hope Marshall Stern.

Section 12 of the Act allows for the court to vary or discharge the declaration of paternity "where evidence becomes available that was not available at the previous hearing."

Section 14 sets out the terms under which a blood test may be used to determine the parentage of a child.

If Larry cared so much about Anna and the baby, while she was still pregnant why the hell diden`t he say or do somthing at the time he saw Howard in action in the hospital while all this was going on. Because he was in on somthing too. Noone really cared enough about any of Anna`s family or Anna herself or they would fought for her right then and there . My sons father died of an overdose when he was five years old. I left him when he was 3mos. old because I could not stop the man I loved withall my heart from hurting himself. I was not going to be a part of that shit with my son at all.. None of these people gave a fuck about this poor sweet now dead mother nof two!!!

59. As a former police officer and defense attorney legal assistant I find this trial very interesting. After watching the testimony of the parties involved I am most impressed with Larry Birkhead. He seems very sincere and honest. He does not come accross as one who is trying to gain anything but the custody of what I now believe is his child. As for the burial of Anna Nicole's body, just end it and let her mother bury her. Howard Stern is in this for the money. He admitted that he stands to make 6 million dollars from the 100 million Marshall judgement that is currently being appealed. Stern lives in California, why would he care of want Anna's body buried in the Bahamas? Anna's Mom has already indicated that she wants her daughter and grandson buried together in Texas. Stern got his face cracked when the judge ask him if Anna Nicole was impaired in the tape they keep showing where she is bashing her Mom when he responded that he (Stern) had seen her more impaired and when the judge questioned him about his remark he (Stern) tried to repair the damage he just caused, but I don't feel that the judge bought his attempt to undo the damage he caused. So, Larry Birkhead, best of luck to you and I hope you get your daughter real soon.
