"California Family Code, Section 7550 to 7558 can also be called the Uniform Act on Blood Tests to Determine Paternity. Here are sections 7551-7552:

7551. In a civil action or proceeding in which paternity is a relevant fact, the court may upon its own initiative or upon suggestion made by or on behalf of any person who is involved, and shall upon motion of any party to the action or proceeding made at a time so as not to delay the proceedings unduly, order the mother, child, and alleged father to submit to genetic tests.

If a party refuses to submit to the tests, the court may resolve the question of paternity against that party or enforce its order if the rights of others and the interests of justice so require. !!!!!! (My exclamation marks.)

A party's refusal to submit to the tests is admissible in evidence in any proceeding to determine paternity.

For the purposes of this chapter, "genetic tests" means any genetic test that is generally acknowledged as reliable by accreditation bodies designated by the United States Secretary of Health and Human Services."

92. What I find interesting is that normally men do not want to be the father of a baby, and usually do not want to pay child support. However, because money is involved suddenly the men want to parent the child. HAHA

I guess in this situation it PAYS well to be a father.

Another sick thing is that the judge clearly wants to become a TV judge, and had a clown face on in court which was sick and twisted, and almost a mockery of ANS' clown video that aired on fox 5. Its not really appropriate behavior especially not in the court room. I do not think anyone in the entire court room, including the judge has altruistic purposes in the court proceedings.

None of them live in reality. I think that obviously Larry Birkead is just some pretty boy who shacked up with a beautiful whore, simply for face value. Its doubtful he intended to get her pregnant. In fact a normal person despite her beauty would not go out with a drug addict, and that its quite obvious she was heavily under the influence at all times. Everyone in court received money for photos, interviews and so on. It doesnt matter if it was $12,000 or a million, all these people made money from the death of daniel and anna in life and death.

All these individuals who are around the baby are also in it for the money.

The judge is in it for the fame, he wants to be a tv judge, has private interests in this case.

Normally tv is not allowed in court broadcasted live all day long. This is just a very poor way of handling this situation.

I think the baby should go to a mother and father that have been looking to adopt a child, and her name should be changed to keep her out of the public eye, she shouldnt even know who her parents are or any of this at all so she can live a decent normal life.

I think the money should all go to charity, because all that money is really the root of all this evil. I doubt Anna will ever even receive any of j. howard marshall's money at the end of all this. She probably has very little money of her own. Lets face it these are people who are making a living by selling flesh, all of them whether its living or dead.

I dont think Howard killed Anna but i think he is in denial about how bad her problem was, and i think he was an enabler. But, i still dont see how he would kill her, she took care of him, and he took care of her (if you can call being an enabler taking care of her). There was more money to be made and more in it for him if she stayed alive. He probably got used to the drug addiction, the longer he was around it. He even mentioned in court "its not like she was unable to speak," which shows his extreme denial about the seriousness of her condition. I dont think he lives in "reality" and i think he lived in Annas "world" and he needs therapy because he doesnt know reality from television anymore. I dont think anyone in this world knows reality from television anymore.

94. I think Vergie's estrangement from her daughter could have been the result of many years of trying to get Anna to live a "normal" life. I imagine that ANS could have been a very dificult, strong willed and rebellious child. Her real problem was probably having been abandoned by her father.

My Mother believed in "spanking," to put it mildly. I knew that if she thought I was going down the wrong path in any way, she laid down the law. I am alive today because of that. Many of my friends died from drugs, perhaps because their parents weren't as tough as my Mother was. You can't always be your child's friend. Anna and Daniel are a sad example of what can happen when a parent isn't really a parent, and prefers to be a friend.

Anna and Vergie are certainly not the only Mother and daughter who are, or were estranged. Several famous singers are struggling with drugs and alienation from her Mothers. A real Mother will not stand idly by and watch her child self-destruct. Vergie would not have had any way of controlling her daughter, and the estrangement may have been the only way she could express her disappointment with her daughter's drug use.

She may also not have approved of Anna's farce of a marriage to Marshall, or of her being a topless dancer. Maybe she just wanted her daughter to stop the non-sense and be a positive role model for her kid. The list of things she may have been angry about is probably endless. TOUGH LOVE may be the best technique for curing drug addiction.

I have experience as a drug counselor, and many of my clients have said that the only thing that stopped them from using, was that their parents disowned them.

As for Howard, as an Attorney, he was aware of the Paternity laws in the Bahamas. He probably suggested that ANS and he go there to escape Larry's attempts to get Anna to clean up her act, and deny him paternity. He had a Fatal attraction to a self-destructive woman and couldn't get her unless she was stoned out of her mind.

Did it make sense that he knew for so many years that ANS had a death wish? Wouldn't a friend have suggested counseling for a friend who wanted to die like Marilyn Monroe? Maybe there was a "counselor," or doctor reaping financial benefits of prescribing so much dangerous medication to an emotionally fragile woman.

The clown video is a sad, sad example of Howard's enabling Anna and capturing her on film or allowing her to do interviews under the influence. He appears to have at least been trying to discredit her in the public eye so that he could gain control of her finances. He may not have actually killed her, but let's call it an assisted suicide. Is that legal?

Can someone get that baby away from him NOW?

96. Just from someone who is not a lawyer or a legal eagle, but wasn't the purpose of moving out of the States for the benefit of Howard commiting fraud on the birth certificate? Is that legal? (The reason he gave was so she could give birth without the media pressures, but wasn't the media keeping her career going and didn't she thrive on the attention?) Let's see, you keep someone drugged up, tell them let's go live in the Bahamas, which sounds great and then you keep them drugged up once they get there suggests a HUGE problem. If I am not mistaken, wasn't Daniel buried in the Bahamas because of a HUGE paperwork issue of bringing him back to the States? Was Howard in charge of this task? Sure is a good way to keep the family and friends away. Also, how can he practice law in the Bahamas when he is not licensed to do so there? Didn't he tell the Judge he would find a job? Could this small baby girl be trying to overcome the drugs Howard gave her Mom now all by herself? This is so sad. What is a winner in this situation?

The "stolen" documents people are saying Larry's lawyer is using were not stolen...it has been said that Ford et al got the police to go with them to the home for which they had a key...HKS has yet to show anything that the home was purchased...I think the owners know if it was loaned or purchased HKS is squatting in that home.....if he did buy his own home after the death of Anna why isn't he living in it....maybe that is where the forged checks come in play.....something to think about

98. Howard is an enabler and has had more involvement in the deaths than the naked eye can see. This is sad for anyone who has a family member who has a chemical addiction, to keep feeding Anna the drugs, and watch her wasted. She was wasted on many many video footage. Why couldn't HKS do something? He watched and let it happen and now, Dannilynn needs to be safe.

Well they could try to get a private paternity test done so they know ahead of time if LB is the dad. If it comes back as yes then they will try to keep baby from LB cuz HKS is an evil bastard, If it comes back that Larry isn't they will possibly submit baby for a paternity test with no worries. Thats my theory.

I'm still saying LB is the dad... and I think the way HKS laughed at Larry's lawyer when she asked him if he was the father showed how absolutely EVIL this guy is.....TOTALLY EVIL

100. Oh PLEASE... Larry is about as stupid as they come. WHY believe him about the "bag"? He is now deemed credible? Hardly.. the "Judge" in this case would be impressed with a bowling ball that glows in the dark. Larry is not a bright guy, and while we are on that subject.. her MOTHER??? Anyone?? She was proved to be everything that Anna said she was. Also I caught several untruths that Larry was trying to ummmm "remember". Whether or not he is the Father it was Howard who stood by her. Larry did unknowingly validate Howard in regards to Anna's behavior ( erratic) . Don't be so quick to judge Howard, he always did what Anna asked... watch her old "E" show... it's all there. Plus her hairdresser for YEARS and before Howard came on the scene said that she had a drug problem, even passed out in his salon... PEOPLE please stand back and see this for what it is.. or is it true from South Park that most of America, PRESS included is retarded?

I recall scenes from the Anna Nicole Smith show where Anna was trying to put the moves on Howard (she was horney as hell and said she hadn't had sex in years?!?!?!?!) but Howard just laughed and pushed here away?!?!?! Weird. So I doubt Howard was in love with Anna and it was unrequited love. Howard was desperately trying to maintain a visual professional relationship with Anna since he was the acting attorney in her legal battles for millions.

Has anyone given thought that maybe Anna chose to get Howard here under the guise of buying a boat so she could commit suicide in this country because it was the only way she gould get rid of HKS.....and where she wanted to really be.....and in her clouded thinking (or one lucid moment) she thought Larry could then have the child and take care of things... like not only getting the child ...but bringing bringing Daniel home too..... because after her death HKS would not try to hold on to the lies she told at his insistance that he was the father....
