"Prison Break" Star Will Be Charged With Manslaughter

Lane GarrisonTMZ has learned that Lane Garrison will be charged today with vehicular manslaughter, a felony.

Garrison was at the wheel last December when he plowed into a tree in Beverly Hills. Vahagn Setian, a 17-year-old high school student who was a passenger in the car, was killed.

The Los Angeles County District Attorney will also charge Garrison with driving under the influence. He will also be charged with providing alcohol to a minor.

Garrison's lawyer, Harland Braun, tells TMZ his client has arranged with the D.A. to voluntarily surrender to the court at 1:30 PM. We're told the D.A. will ask for $200,000 bail.

We're told Garrison's blood-alcohol level was .20, more than twice the legal limit.

Significantly, the D.A. is not alleging Garrison acted with "gross negligence." That's important because the enhancement of gross negligence would increase the maximum prison time.

If convicted, Garrison faces a maximum of 6 years in prison.

16. 6 years in prison? What a joke! A kid who I went to highschool with did the same thing and got 15-30 years! I'm sick of these Hollywood asswipes getting away with things because of who they are. Sick.

18. IF it's his first offense people, don't look for him to do ANY time, much less the maxium sentence of 6 years. It'll never happen, whether he's a "star" or just a regular citizen. I worked for years in law enforcement and that's just they way things are. Not enough prisons to hold 'em all. Here's a clue.......stop opening bars and clubs that people DRIVE to. What in the heck do you expect? Drink for hours then get home how? Wake up people. You want to drink, do it at home where you can only hurt yourself.

19. When are they going to get Paris Hilton for driving on her suspended license? That's supposed to be MANDATORY jail time. If Naomi Campbell has to sweep and mop, then why is Paris Hilton allowed to drive around with a joint in her mouth while on a suspended license?

20. I can't believe any of you people that are so quick to judge have NEVER done anything even remotely similar to this! Never drove after more than one drink? Never had poor judgment? Never did anything stupid at a party? If everyone were as good as the people posting on TMZ think they are the world should be a much better place.

22. # 15 do you know how stupid you sound. Do you think they forced him at gunpoint to go on a booze run? Anyone driving under the influence of a controlled substance and causes bodily injury or property damage should be held accountable for their actions. The fact that it is one of "Hollywood's finest" should make no difference to the sentence. Garrison will pay for his stupid mistake(driving under the influence) for the rest of his life. But too many "Stars" are using poor judgement by getting behind the wheel while impaired, when they could just have a driver take them where they want to go. Something drastic needs to be done in order to let these "stars" know that they will be punished.

24. about time, you play with drugs and drive...you pay for your consequences..do not feel sorry for him...he is an adult...and must now act like an adult...all the church going is not going to help him now. My Question is why when someone like Lane garrison probably never stepped into a church until he needs some kind of guidance, does so now...that to me is hypercritical!

25. The DA would have charged him with more if they had something on him. They didn't administer a BA test at the scene, and hands down hospital blood test are spotty at best. This case has a lot of holes in it, and the DA knows their up against Harlan Braun. I feel for all in involved, and hopefully Garrison will make restitution with the family at all costs..

28. Wow - there sure are alot of hypocrites and stone throwers here. #23 - how do you know he didn't go to church before? What does hypercritical even mean? All of these grandious statements from the pillars of society who frequent TMZ.com...gimme a break!

All of you grandstanders need to step back and look on your own lives and think about how many times you did something stupid and didn't get caught or escaped without consequences. You want this guy to get crucified for his actions - what if that was your family member or close friend who made the same mistake?

Fact is, he was stupid, made a bad decision and someone died because of it. He's in prison for the rest of his life - what's the point of doing enormous amounts of jail time? He'll be punished as is accorded by law. In the meantime i say keep the jail space for the real murderers, child molesters and rapists of the world.
