DNA is a D-O-N-E Deal

Howard K. Stern and Larry Birkhead DNA samples of Dannielynn and Larry Birkhead are in the bag, according to MSNBC's Rita Cosby.

Cosby broke the story and TMZ has confirmed that Birkhead and baby were both at a Bahamas doctor's office at 9 this morning and had samples taken. Howard K. Stern's DNA was not taken because by law there is a presumption that he's the father since he's listed as such on the birth certificate.

We're told Birkhead saw Dannielynn in the doctor's office.

If Birkhead's DNA matches Dannielynn's, he can then challenge Stern to pony up DNA and fight for custody.

We're told the samples will be sent to a DNA lab in Columbus, Ohio and will be sent back to the Bahamas in four days.

Larry, we know when you are PROVEN to be Dannielynn's Daddy that Howard isn't going to hand her straight over. You will be in a bigger fight than you are now, but, hold in there we are behind you all the way. grab some more lawyer's and tell Howard to bring it on. That he can't run any more... And don't deal with the slim sucker. Your daughter will know one day that you fought like all get out to get her. for her. not for the money. You were fighting for her before Anna died and you continue to fight for her. She is yours. You can see it in the eye's, hair and face. She is a minnie you.

48. I heard Court TV say that HKS may still appeal and he could force it to go all the way to ENGLAND to the highest court there.

This would give him more time which is precious to him - the longer he takes the more Dannielynn will bond with him - IF the equivalent to USA's DFAC in the Bahamas allow Dannileynn to remain in his custody.

The formal inquest into Daniel's death begins next week with over 40 witnesses - I expect what everything that has happened so far to Daniel, Anna, Danielynn & HKS will pale to what comes out over the next weeks & months.

Daniel and Anna are dead. Virgie Arthur didn't want to be right when she warned Anna she would be next and accused Howard of being resposible for Daniel's death when she warned Anna to be careful of who is around you - Virgie NEVER accused Anna of "murdering her son" as ET plays over & over & over - the" Mommy Dearest " tapes.

But Virgie was right and Anna is dead. I support Virgie's right to protect her grand daughter from Howard K. Stern. She should fight like hell for temporary custody of Dannielynn.

50. Even if DNA shows Larry is the father, that still does not give him legal rights to the baby. Howard is still custodian of Dannilynn and it was Anna's decision to make Howard the legal father of her. Anna would be rolling over in her grave if she thought Larry would get her baby.

52. Ok I have a question. Did they just show up at a Doctors office and the Doc took the samples without attorneys around to make sure this doctor is not Stern connected? At this point, I don't trust anyone to do the right thing. I would think that other officials would have been there to collect and mail/deliver the damples in a legal way. Input anyone?

53. If Larry turns out to be the father...I hope he sues Stern for all the problems he has put them through. Better yet, I hope someone takes Stern out..so he can go be buried next to the two he murdered.

55. Why does everyone favor Birkhead so much?? Because he's cute?? No one knows him or if he'll make a good parent?? No one knows Stern either. Anna sure trusted him with everything, even her son, whom we all know she loved very much. She also wanted her baby girl to be with HKS. I believed she should have been buried in the Bahamas, as were her wishes & if the baby is Sterns, she should be with her Dad, as per her wishes. Anna was a very needy person. She wanted HKS to be with her all the time. I don't believe he is a money grubber. He loved her. And as far as a murderer?? Please, shut up!!

56. Even if Larry is the father, he will not automatically get the baby. All the test will prove is that biologically he fathered Dannielynn. The results would give him "ammunition" to fight for custody, but it is not automatic. Courts in both the US and in the Bahamas look to the child's "best interest" when determining custody. So, if Larry is proven the father, he can go to court on a custody basis, for now, he is only there on paternity. Potentially, he could be proven the father, but HKS could have Dannielynn for a long time coming, depending on whether HKS puts up a fight trying to show that Dannielynn's best interests would be served by remaining with him. If courts were to decide that living with HKS was best for the child, Larry would more likely than not get visitation rights.

** For the record, I am not saying that staying with HKS is in Dannielynn's best interests, just stating what the law uses to determine custody.

57. i dont' get it! The tmz article said that if larry's DNA matches the baby's DNA then HKS has to give his DNA and larry gets the chance to challenge HKS for custody?!?!?!?!?!!? I thought the DNA was the deciding factor... Someone please explain this to me.

58. It's about time the DNA test was done. If this was HKS's baby, I think he would of had the test done with not problem but since it's not that is why he put up a fight. I do not think HKS was with ANS, when they kissed on TV it seemed so staged. Anyway, it would be interesting how this turns out. Also next Monday or Tuesday the resulty to ANS autopsy should be out.

60. It's about time, Im saying a prayer for Dannilynn that Larry is her father. For you Howard supporters, remember that Anna's son was worried for her life because of HOWARD and contacted a private investagator because of his worries and then he and his mother were both taken before their time. I really don't think Howard is a good person, he stuffed pills down Anna and even gave Daniel pills. I realize Virgie Arther is unliked but I think that we may find out that she was right all along. Howard has shown he is not a good person and Anna only wanted him to be the father because she didn't want to share custody with Larry and not only that Ummmm... Howard as said by Daniel to a P.I. that Howard controlled Anna. The whole moving to the bahama's was all Howards doing Im sure of that. Anna was so clouded in drugs, Howard was the mastermind and thought moving there would make it so that he would be the father to Dannilynn and then have full control of all that money.
My prayers are with that little girl, she deserves to be with her daddy who has fought for her all along and never gave up.
