Vivica A. Fox Charged With DUI

Vivica A. FoxTMZ has learned that actress Vivica A. Fox has been charged with two misdemeanor counts of DUI, stemming from a Tuesday night arrest.

Los Angeles City Attorney spokesman Frank Mateljan confirmed that Fox was charged with one count of driving while impaired and one count of driving with a blood alcohol content of .08 or higher. Sources tell TMZ that Fox blew a .09 when she took a breathalyzer test.

If convicted on both counts, Fox faces a maximum six months in jail and a $1,000 fine.

TMZ first reported that CHP officers pulled over Fox's 2007 Cadillac Escalade late Tuesday night after she flew past a marked patrol car at approximately 80 mph. The former "Dancing with Stars" contestant then failed a field sobriety test and was placed under arrest on suspicion of driving under the influence.

Fox is due back in court on May 17.

34. WOW...too many numbers (comments) to comment on, just sticking to the issue. Most celebrities don't do the time for their crime, sad yet true. I betcha is if were you or I, we'd be under the jail. Botton line: they are not above us and should be treated as equally as the rest of us.

37. It's interesting to note the difference in the commentary depending on the race of the offender. Just a couple of minutes ago I was reading about white jews trashing a hotel room (see TMZ .COM). There were a few comments, some lenient, some kinda sorta harsh)....fast forward to a black celebrity breaking a law, the racial slurs jump off the page.

I understand that the average reader IQ is not super high but could people at least make an effort to make intelligent comments backed up by something other than slurs and innuendo...thanks guys!!

38. I am so tired of the racial slurs made on this site and others by both blacks and White. I often forget that ignonorance still runs ramped. In fact It seem that the most idiotic things are coming from my own kind. Come on guys. I know that this is a gossip site,but in the Case of Miss Fox She does not have a previous record. I heard that there is more to that story than we have heard. I personally know the arresting officer and know he has some issues with harrasement. We should wait on her response. She is a class act as far a Entertainers go. I cant speak for the negative comments made by blacks on this site but as far as the Whites please be advised. If you are not well rounded with a decent world view, don’t type statements. Not all of us want to be linked to you stupid's with your racist point of view.
