Stern Will Not Fight for Custody If Birkhead's the Dad

Howard K. Stern will not stand in Larry Birkhead's way if the DNA tests show Birkhead is Dannielynn's father, this according to unimpeachable sources.

Howard K. SternThese sources have issued the following statement to TMZ:

"If Larry Birkhead is confirmed to be Dannielynn's biological father, Howard will not challenge custody. His love for her will not change, irrespective of the results. Howard will act in Dannielynn's best interest, because he loves her and would want a smooth transition to protect her, as she is deeply bonded to those who have been with her since birth.

While Howard continues to believe and hope that he is Dannielynn's biological father, he wants to be involved in her life, regardless of paternity. He wants to share the memories of her mother as the person who knew Anna best and all she wanted for Dannielynn.

Howard will do whatever is necessary to assist Larry Birkhead to defeat any effort by Virgie Arthur to obtain custody of Dannielynn.

Howard was not part of the paternity lawsuit filed while Anna Nicole was alive. The first person to challenge Howard on custody was Virgie Arthur -- not Larry Birkhead. Howard is dedicated to Virgie Arthur not having custody of Dannielynn. He is well aware of how Anna Nicole felt about 'Mommy Dearest' and Anna's feelings were clear regarding Virgie Arthur being anywhere near Dannielynn.

Speculation that this is somehow about money for Howard is misguided and wrong. Howard has never made a TV or book deal even though he is the one who knew Anna Nicole best.

Howard wants Anna Nicole to be remembered as an icon like Marilyn Monroe, and he knows a lot of damage has been done to her image in the past two months. This restoration of Anna's image is important for Dannielynn and the views she will have of her mother as she grows up. He also wants to make sure that only Dannielynn profits from Anna Nicole's name, likeness and estate. As TMZ reported earlier, the money from Anna Nicole's funeral went to a trust set up for Dannielynn. Howard set up the trust but he does not, and will not, receive any money from it and is not the trustee."

Anna Nicole SmithTMZ has confirmed that DNA results will be revealed in court on Tuesday in the Bahamas. Stern and Birkhead will both be present. Arthur is also expected to be there.

92. did a little research on california grandparents law--it's not a given, but grandparents have the right to sue for visitation, and it can be granted even against the parents wishes if they can prove it will not harm the child.

93. I like the statement. I would like it even better if the source was named. Vergie cannot
" trump" a Bio-Dad who wants and is able to take care of the child. If Larry lets Vergie into the child's life, that is his business. Larry lives in CA. Vergie lives in Texas. So if the Grandma visits with the kid, so what. If the court rules that the child is to be turned over to Larry, Vergie better play nice. Much better to see the kid without going to court and fighting with ppl. Let Vergie be a Grandma and stop this nonsense.

97. Howard Stern should never be allowed in the baby's life. He should never have been in
Anna's life or Daniel's life. As far as Vergie is concerned, she is the baby's blood relative and has rights - should she fight for custody or even joint custody? - of course not. She should be allowed to see and be with her granddaughter during visits, etc but that's it.
The baby does not need Howard in her life - ever. He's done enough damage. Comparing
Anna to Marilyn - I think not. Marilyn may have been Anna's idol, but they will never be thought of in the same league.

99. It just too many liars and liars. I think this is a "leaking" news. I am guessing I doubted about the two men Stern and Birkhead are not the father of Dannielynn. I wish Birkhead will go away--I haven't watch on the news and very tired hearing about "Who is Dannielynn's father". He just wanted some news media attention. If he is not the father of Dannielynn, he have to go back to LA and have to have a big yard sale to sell all the baby's things and pay big legal bill to former his lawyer, Debra Opri. This is going to be funny. When I was watching "Greta On the Record" (Fox Network) the other night that he haven't got another lawyer to represent him- and that some of them in Los Angeles has turned him down. This is Birkhead's problem. Sorry!! That's my opinion.

HKS and his family have been in my thoughts and prayers....don't really know why I'm so emotionally invested in this issue other than an issue of justice...right and wrong and not piling on the under dog. This is a great Easter Day present for me. My wish for Howard (which I wrote about yesterday) that his family helps him move on and rebuild his life...and accept whatever the DNA results may be, even another loss, the loss of a child, the third loss in a short period of time, seems to be coming to fruition. He will need a lot of help, professional mental and emotional help to get through this. I hope he knows that he is not alone and that THE WHOLE WORLD is not against him. It does not have to be he against the world......I hope there are those who know him personally, even his law team who forwards good wishes like those on this site and others to him as we have no other way to let him know not all the jury pool can be "tainted".

103. When Larry is proven to be the REAL daddy-HK$ will not have a leg to stand on anyway. Larry does not have to cut any deals with $tern.....if he is the daddy! For Dannielynn's sake though, she should know her grandmother & family! She shouldn't have to have HK$ in her life once it's proven that the birth certificate was a fraud! The farther she is away from the $tern family the better! God Bless Dannielynn!

104. Howard I am so proud of you. I have been one so against you. People I think Howard lawyers was making all the moves. Think of it. He has always been out of the camera if he did not have to. He might of been related to both deaths of the son and Mother. Let's face it. You can not save a person on drugs. They will get it anyway they can. That is why she did not want Virgie in her life or Larry. I think Howard loved her and wanted her to quiet. He also knew that he had to help her reach a point of saying I don't want this. You can not make a person quiet. It has to be their choice. We have not been there. So we really do not know. I say Howard we as America thank you. I see you in a different light now. People it is Easter and I prayed for this.
