Uncle Larry Birkhead in the Swim

Yesterday was a day of celebration for the DNA victorious Larry Birkhead. Shortly after the news of Dannielynn's paternity was announced, Birkhead did some victory laps -- in a pool with his adorable niece and nephew.

While a huge weight has been lifted from Larry's shoulders, it looks like he'll still have heavyweight Virgie Arthur to contend with in a custody hearing.

It seems that Larry will be a swimmingly good dad, and Dannielynn will have some happy cousins to play with. *Sniff*

I believe Larry will make a great Dad but everyone is blaming Howard but Anne was stressed after her son death and giving birth to her daughter and has everyone forgotten fighting Larry about her daughter. Larry contributed to her stress level also I don't think he is innocent in all of this. True Anne was wrong to keep his child from him but if he had been patient and given her time to deal with her son death and giving birth she showed signs of classic postpartum depression. So congratulation to Larry but at what cost.

573. Jacqueline...Anna brought the stress on herself with the aid of HKS by fleeing the country and denying Larry his child!!!! Larry was I'm sure worried for his daughter knowing Daniel had died too! He absolutely did the right thing!!

574. Deb...............Yesterday two nannies and lawyer appeared on TV recanting much of what was in the article. They said that Ford Shelley paid them to say that..........................who knows what is true anymore.

Lawyer Says Paternity May End House Battle

Larry Birkhead’s confirmation as the father of Anna Nicole Smith’s infant daughter Dannielynn paves the way for an end to the legal standoff centred on the Eastern Road mansion called ‘Horizons,’ according to the lawyer for one claimant to the house’s title.
Godfrey ‘Pro’ Pinder told the Journal that his client, Ms. Smith’s ex-lover G. Ben Thompson, would "work with" Mr. Birkhead.

He has been locked in a dispute with lawyers for Howard K. Stern, Ms. Smith’s live-in lawyer, over who owns the residence where Ms. Smith and Mr. Stern lived with Dannielynn until Ms. Smith’s sudden death in February.

Mr. Stern and Dannielynn still live at Horizons.

Mr. Thompson claims he owns the home, since Ms. Smith never fulfilled the terms under which he supposedly turned it over to her, and Mr. Stern and lawyers for Ms. Smith’s estate support Ms. Smith’s claim the house was a gift.

Mr. Pinder said that the substantiation of Mr. Birkhead’s paternity claim adds a new dimension to the wrangling over the house.

"I believe that he (Mr. Birkhead) would also get temporary custody. If he gets temporary custody then he should replace Howard K. Stern in the house. You don’t need to have two fathers in the house," Mr. Pinder said.

"We shall invite Howard out of the house, and leave Larry in. We’ll work with Larry. Larry knows who the owner is; he’ll eventually probably do the right thing and turn it back over to us."

However, insiders in the housing case say that is a difficult call to make.

The property is the subject of an injunction. Supreme Court Senior Justice Anita Allen has ordered that nothing further be done with regard to the property until further notice.

And the Journal understands that the estate of the late Playboy pinup must be probated before the property can be dealt with definitively. Ms. Smith’s will may have to be probated in California, and then resealed in The Bahamas – a process that is likely to take months, if not longer.

Mr. Birkhead was confirmed as the child’s father on Tuesday when DNA expert Dr. Michael Baird disclosed in the Bahamas Supreme Court that the DNA tests showed Mr. Birkhead was 99.9999 percent likely to be Dannielynn’s father.

The determination of paternity is the first milestone in the custody proceedings. Next up, the court will hear a claim from Ms. Smith’s mother Virgie Arthur on Friday. Mrs. Arthur intends to press her claim for guardianship and custody of Dannielynn, although her lawyer Deborah Rose may have indicated some wiggle room on Tuesday.

"We are scheduled to be back before the court on Friday [to argue Mrs. Arthur’s claim for custody and guardianship], but as we said, we’re looking forward to working with Larry and hopefully we can come to a position that’s in Dannielynn’s best interests," Ms. Rose said.

Sources close to the case say that while it is possible that Messrs. Stern and Birkhead may have made an arrangement with regard to both custody of the child and the disposition of the Horizons residence, it is unlikely that such a deal has been struck with Mrs. Arthur.

578. Things that make U go hmmm... You try dealing with the death of a child and giving birth to one on the same day and see how much stress is in your life. Anne was a mother that had just lost her only son and all she could fathom was Larry taking all she had left. That is stress and no matter how much we blame Howard when someone you love is hurting you will do all you can to help them even when it isn't the best for them. I don't agree with Howard because he should have gotten her help but it is only so much that you can do...sometimes. I agree that the baby needs her father I just wished that it didn't have to come at the expense of her mother.

NO, there isn't "only so much someone can do" even dr. phil last night told Alex Goen when he asked "what are u supposed to do, pick her up, throw her over your shoulder and take her to the hospital"? dr phil replied "YES". so there is more that mo and howard could have done. they could have saved her freakin life!!!!!!

581. Well , Number 23 Comment!! I am with you. I do not think Larry Birkhead will be good for the baby or anyone else ,for that matter. He wanted his 10 minutes of fame and would do anything to get it. Larry Birkhead does have a past, you will all see.

Why can't you share, in his joy? You must be a miserable person if you can't. I live near Louisville, KY and there's been nothing but 'good news' about Larry on the news. We're all very happy for him.

583. THANKS SO MUCH FOR THIS POST! I missed it on t.v. DL is really lucky that she will be going home with such a loving family. You can tell it's genuine because they are all sitting their relaxed. Mr & Mrs. Birkhead you can certainly be proud of the family you raised. (And the sister-in-laws family too!) God Bless you all!
