Birkhead Free to Leave with Baby

Larry Birkhead can leave the Bahamas with Dannielynn, at least for now.

A judge has just cleared the path for Birkhead to go to United States with one string -- he must return with Dannielynn for the full custody hearing in June.

Sources tell TMZ that Virgie Arthur objected to the ruling and could appeal. But that appeal may be too late. We're told Birkhead wants out in the next few days.

And there's this -- Arthur's lawyer protested there were leaks in the case, and pulled out several TMZ stories that he said were posted "minutes" after the various hearings ended.

48. Good for Larry. I am afraid that "ole" Virgie's lawyer has been promised a fair cut of all that Virgie can get from DL - he seems to have as questionable background as does Virgie. I am sure he isn't working this case out of the goodness of his heart. I think the judge will be able to figure all this out, and Larry will be a wonderful fulltime father with a good support system including his family. I hope he keeps DL as far away from Ca. & TX as he can.

49. Vergie is a rude pig! She wanted nothing to do with this baby before. Who the hell does she is.....all she cares about is the money so she can continue to feed her fat face. I hope Larry takes care of Dannielynne and keeps Vergie away from her and will let Howard see her.

58. IF I'm reading this right, Howard still has official custody but Larry is allowed to take the baby and leave. He has to be back in June for a formal custody hearing. I believe
Howard said he wouldn't stand in the way but June would be Larry and Vergie's issues that have to be resolved. When they are, then custody will go to whoever is the winner in June.
Larry doesn't have custody right now. HE just can leave and go home for awhile.

She is the blood relative grandmother and deserves to be part of DL's life.

60. That's Great!!! Dannielynn shouldn't have stayed in the Horizons that long. She surely doesn't need to be in the Bahamas awaiting the court hearings. Now she can go visit her Grandpa and the rest of her new family.

Larry and Vergie will work the rest of it out!!
