Paris 45 Days in the Clink?

Paris Hilton is in big trouble, if the Los Angeles City Attorney has his way. TMZ has obtained documents filed with the court, in which prosecutors say they want Hilton to spend 45 days in jail.

Paris must appear tomorrow on a probation violation, for allegedly driving on a suspended license. Hilton was already on probation after pleading no contest last January to alcohol-related reckless driving. The DMV had suspended Hilton's license as a result of her DUI bust.

While her license was suspended, Hilton was stopped by the CHP last January 15, and again by the L.A. County Sheriffs on February 27.

The City Attorney will argue that Hilton certainly knew after she was stopped in January that she wasn't allowed to drive, so the second stop was a flagrant violation of law.

The documents suggest Hilton mistakenly relied on her lawyer's assumption that Hilton had a right to drive, but the City Attorney claims in the legal papers that it's a bogus argument.

According to the papers, Hilton also failed to enroll in an alcohol education program within 21 days of the order directing her to do so.

The legal papers ask that "Hilton be ordered to serve 45 days in County Jail." Prosecutors also want her to be ordered "not to consume any alcohol for a continuous period of 90 days." During that 90-day period, prosecutors want her "to be monitored for alcohol consumption ... by use of a Secure Continuous Remote Alcohol Monitoring (SCRAM) device at her expense."

Paris at her best: Click to launch photosTracy Morgan was just ordered to wear a SCRAM device.

The City Attorney wants more. Because of her "flagrant" driving violations, they want her license suspended for an additional four months -- and they want her car impounded for 30 days.

211. Eheheheh, no jail for Paris!
Let her keep the license too.
What? Why not? Because rich people should be punished too?
No, they shouldn't. It'll give normal people more incentive to become rich, stimulate the economy. Think about it.

213. OK, it sounds like there are some resentments against rich people. However, I too feel that Paris Hilton has acted very irresponsibly and has behaved like she's way above the law. Now she wants to through the blame game saying "I didn't know I couldn't drive my car w/a suspended licenses. Jail for only 45 days? Rediculous. What do the authorities want? Her to commit a murder before she spends some real time behind bars? She's arrogant, self willed, self centered and very immature. This is a combination for disaster just waiting to happen. She really needs to RESPECT THE LAW, 4REAL!!!!!!!

214. GDI u guys, yo, ur r impeccably resentful, belligerent, and talk about character assasination...PHEW! The kid should do community service and if she does jail time she should be charged by the state for reimbursement. but you know, if they threw Paris's BFF ms. richie, added pompous anti-semite gibson & toss-in the "i-hate-gays" actor-doc from greys you've got a gr8 toxic recipe for a reality show.

217. Paris Hilton deserves to go to jail. All the young hot hollywood stars need a taste of the real life. But if she doesnt serve jail time then she might never learn her lesson. She deserves to go to jail.

218. One problem here is those people who got caught plotting against our troops were never punished when they were caught multiple times for DUI

219. Wow, isn't that a feather in the DA's cap, putting Paris in jail. It isn't "celebrities" that get off, it's male celebrities that get off. Did Mel Gibson do jail for his DUI, if he did, as much as Paris? Did O.J. get it? Did Robert Blake get it? How about Martha Stewart? Paris is getting more jail time than any child molester and most woman beaters, child abusers and rapists. How does this prove that celebrities aren't given any special treatment? Actually, using her celebrity in the good of community service in some way would accomplish a lot more for everyone involved, instead of catering to those jealous of her position in life to prove that she won't be treated "differently". It won't prove a thing. All of the powerful male celebrities/rich and famous will continue to get off with hardly an outcry from the people commenting here, calling Paris disgusting names.

Paris Hilton is an easy target for any ninny who wants to pin his/her jealousy and lack of accomplishment on someone else. The level of hatred toward her here is disgusting. This is why women are attacked and killed at such a ridiculous rate in this country. Switch genders and she would be so much more celebrated than she is, and you wouldn't hear the constant name calling that she's a "ho" or "slu*" either.

All of those who are so happy to see her go to jail are a bunch of sucker punchers taking cheap shots at an easy mark. Take a good look at yourselves instead of feeling superior by attacking Paris Hilton.

220. I cant believe that she said she didn't know that her driver licenses was suspended and that her lawyer told her that it was ok to drive on a suspended license. LOL omg. Either she is really stupid or her lawyer needs to go back to law school. And this on line petition to free her what a joke. Who the hell does she think she is any ways? She is no better than anyone else that breaks the law. If the Govenor and the judge lets her go what kind of a message would this send to other young people? If they do they will be getting a letter from me. Serve your damn time Bitch and stop your whining.

221. Who cares if she is crying, the rich spoiled brat deserves exactly what she gets which is time behind bars. That's where skinny, ugly ass belongs. Her parents did a bad job of raising her, they should be ashamed.

222. If Martha Stewart can serve time behind bars so can this spoiled little brat Paris.

223. If Paris actually shows on June 5,and say because of over crowding she is released, wouldn't she have to report the next weekend.I know that in some states if released because of overcrowding you have to report until you serve time or you have showed up enough time to meet your required days.I also am soooooo hoping she does have to spend time, but I don't wish anything to happen to her while she is in.Think about it,this is Paris I can just hear it now ohhhhhh I broke a nail I'm going to sue because I didn't know how to turn on the water or flush the toliet I have someone else do that for me.Hey guard can you wipe my as***

224. So, it's official. The No-Talent skank is going to serve only 25 out of the 45. Why am i not surprised? The rich and infamous always get away with murder in this country. If it had been a black or latino or poor regualr person, he/she wouldn't have a chance. I am trully disgusted. Watch the slut do it again and get away with it. My best friend was killed by a stupid drunk driver like Paris Hilton, in 93'. I always think of him everytime situations like this happens, and it makes me angry. I want true justice for all those who never got a chance because of assholes like Paris Hilton! She can't get away easily!

225. She should have to do the 45 days in jail. This good behavior for showing up in court, what 10 minutes late and she gets her time cut in half. Most go to jail when arrested, she didn't! Most have a certain period before completing the court order, she didn't. This girl has BIG bucks, why drive when you know you can't and can afford to have someone drive you..? Plus I thought when you're on probation you're not allowed in bars..?
