Brandy Sued by Survivor in Fatal Wreck

BrandyA survivor of the fatal car crash involving Brandy is going after the singer in court, claiming that the ousted "America's Got Talent" judge should have known the consequences of speeding in a Range Rover.

In the lawsuit filed today in Los Angeles County Superior Court and exclusively obtained by TMZ, Mallory Ham claims that Brandy "recklessly wantonly, unlawfully, and maliciously" operated the car responsible for causing a deadly collision on the 405 Freeway last December.

According to the document, Ham, who says he was "severely injured" as a result of the multi-car accident, is demanding that the singer pay for unspecified medical bills, pain and suffering, legal costs and punitive damages.

This is the fourth lawsuit Brandy is facing regarding the crash that killed 38-year-old Awatef Aboudihaj.

UPDATE: TMZ has also obtained Brandy's response to the wrongful death suit filed against her. In the papers, filed May 23, Brandy says she "denies each and every allegation in the complaint and further denies that plaintiff's have been damaged in any sum or sums whatsoever." In addition, Brandy "alleges and asserts her Fifth Amendment privileges" and asks that the matter go to trial before a jury.

Yes, some of us may have gone a little over the speed limit but those of us appalled by those defending Brandi have never caused somones DEATH. How stupid that anyone would compare someone gojng a liitle over the speed limit by maybe five or ten miles an hour though any speeding isnt good) to somoene who killed somone? How would you like ti if your family member lay dead because of some idiots negligence?

Those buzz words you speak about -- they are part of the statutes that cite the law, they are part of the statute. Those "buzz words" have to be proven by a preponderance of the evidence. they are not used to get more money for the laywer, the amount the attorneys get is set by law. And if they lose a case they get nothing. And again, it's the insruance company that is paying, not her personally. Maybe if you got your facts straight your comment would have more credibility.

15. Yes, Brandi caused an accident that led to the death of someone. Yes, I believe she should have to pay for that. But I also know 2 other things: 1..for those of you trying to bash Brandi, learn how to spell; then you and your comments may have some credibility. 2. "Recklessly, wantonly, unlawfully, and maliciously" !!! These words are "buzz" words used to inflame or incite more of a sympathetic ear. They are also used to try to get more money for an attorney.

19. If she wasn't "Brandy" with money, they wouldn't be sueing her, they'd only go after her insurance. They are taking advantage of her celebrity. She made a horrible mistake. Anyone of us could have done the same thing. I feel sorry for the family of the victim, but I also feel sorry for Brandy. She doesn't appear to be in disregard of human life. Paris Hilton on the other hand feels she is untouchable and she does diserve jail time. Paris has a blatant disregard for the law. Brandy had an unfortunate event take place that harmed another human being. She didn't intent on hurting anyone, I'm sure.

20. She caused the death of someone. Think about if you were killed in an accident, who would be left behind, a spouse, kids, friends,siblings, parents? She has ruined lives. As long as the people are asking for the normal amounts, and not taking advantage of the fact that a celebrity killed someone, they should sue, and she should take responsibility.

23. Surprised no one has addressed the dangerous off-ramp. My sister lives near there and evidently accidents happen there more than other places and near-misses all the time. It's a situation where cars going the freeway speed limit and have to cross the ramp exit where other cars have already slowed down. Not a surprise the ramp was shut down and the City has re-configured it. It's bad engineering and bad luck for Brandi and it could have happened to any of us. That the guy is suing for the extraordinary amount says everything about his character and the liability of being famous.

25. #23 is a dumb ass. The man suing has nothing to do with Brandi being famous. Brandis insurance will pay for ALL COSTS in the evident- that the man wins the personal injury lawsuit, which he should . So poor littel Brandi wont be out any money personally. She'll still have her life while a dead woman wont. 26. To #25 -- exactly right. How many other people drive through there on any given day and dont have a problem? Of course we hear about it because she's "famous" -- for what, I have no clue. But because she's famous, why do people have a bleeding heart for her? My heart goes out to the family. And taking the 5th in the wrongful death case? Obvious sign of guilt, first of all. Secondly, glad the family took that civil case out. Maybe she'll only be able to afford a bicycle and won't be able to kill anyone again.

30. This is a good example of a Horrible person. She should be CONVICTED and executed for the Murderer she is. It would be no loss to the world. This is exactly what you do not want your kids to grow up to be like. A KILLER at large.
