Birkhead Sues Opri for Fraud, Malpractice

Birkhead - OpriLarry Birkhead just filed a lawsuit against Debra Opri for allegedly defrauding him out of hundreds of thousands of dollars.

In a lawsuit filed Friday in Los Angeles County Superior Court, Birkhead claims an MSNBC reporter hooked him up with her. He says Opri said she was willing to represent him free of charge, because "the publicity from her representation of Plaintiff would greatly benefit Opri's legal career." Birkhead says shortly after hiring Opri, he did an interview with the MSNBC reporter who was asking questions about confidential documents she shouldn't have had. Birkhead says Opri told him she had given the reporter the confidential info as "payback for the client referral."

As TMZ first reported, Birkhead made a deal with NBC Universal for $1,050,000 to appear on various shows. The initial check to Birkhead was for $865,000. Birkhead says without his consent, Opri deposited the money in her client trust account. Indeed, Birkhead claims he "specifically advised Opri that she was not authorized to take control or possession of any of the funds..." Opri then turned over $200,000, leaving $665,000 in the trust account.

Birkhead, who claims conversion, fraud and legal malpractice, says he repeatedly demanded that Opri release the money but she refused. Birkhead then fired her.

Birkhead's suit then details another TMZ story, that after Opri was fired, she sent him a bill for $620,492.84 for legal services, which included charges for expensive dinners, Opri's publicist, and even her husband's laundry. Birkhead claims many of the charges were for Opri's "personal aggrandizement."

Birkhead further alleges in the suit that "Opri placed her own career desires and needs as a priority over the needs, interests and desires of her own client."

Birkhead also claims Opri represented herself as a specialist in California family law, but says the representation was false and she knew it.

Birkhead is seeking at least $885,000 in damages. He is also asking for punitive damages and rescission of any fee agreements Birkhead claims he signed under fraudulent pretenses.

50. I work in the General Counsel's office for a large College. I procecess legal bills all day long. We outsource a lot of our cases at $350.00 an hour. We have generally 4 attorneys working for us at any time full time. Every month we have to have bills reissued for items that they either misbilled or tried to stick us with. For example we've been charged for woked they did for the state and for them to train their lawyers on our time. Lucky for us our General Counsel reviews the bills and weeds out the over charges as he use to be a partner in the firm. I think Larry got taken for a ride. Only because Debi can not deposit checks in to any account that Larry did not sign off on. If she was sent a check yes should could hold it but she can not cash any checks made out to him in his name as I don't think she was his power of attorney. And she got a lot of press out the bit in fact it would take millons of dollars to get the press she got out of Larry. Debi going to be for a hugh payout to Larry if she did the things he claimed he did. No company would pay expenses for a spouse to go on a business trip so that's crazy. Also is she released documents that she should not have she's facing disbarment. In my two years I have never received a bill for over 500,000 K, that more then our whole college spends in a year. Unless she was filing motions 24/7 she's a cheat cause you bills for hours worked because there are 24 hours in the day. Also I sure he was not her only client. Consider the average attorner makes 100K to 150K a year Larry could have just staffed himself an attornery like Anna Nicole had Howard pay him a yearly amount and had his own personal attorney. Her bill is crazy I mean it not like his GM or AT&T or something he's one guy trying to get a kid from a C list celeb.

56. Debra Opri for FREE. You get what you pay for. First of all the word free does not exist in any lawyers vocabulary. Pro bono? If Opri has a signed fee agreement saying Larry agreed to her fees he is a cooked goose! If not she is a cooked pig !

58. I would like to know how anyone deserves over $400 an hour? There are too many children around the world born into dire poverty through no fault of their own. Then to see someone like Ms. Opri earning that much money is obscene. I hope Larry wins this case. Gosh, that poor guy has been through enough.

59. It makes more sense now. Debra Opri should never have gone to the Bahamas. She couldn't practrice there. She crafted that bogus $620,000 bill to keep the money that she already had in her client trust account.

Larry has demonstrated remarkable restraint in keeping this quiet until his case was filed.

I hope the State Bar disciplines Opri, and rescinde the contract with Larry. She didn't win Dannlynns custody case, The case was won by the Bahamian Lawyer, and I bet his bill was much smaller.

60. He'll end up winning too, he has one hell of a case against her. If Opri was releasing confidential documents to the press(which I believe she was), she would be in violation of her attorney-client confidentiality and not only will she not see one red cent, but she have to shell out close to, if not over a million to Larry for damages and the Cali Bar may revoke her license. The rest of the media has turned on Opri and that is indeed bad news for her.
