ParisTMZ has learned that Judge Michael T. Sauer has ordered that Paris Hilton appear in court for the hearing, which is scheduled to take place at 9:00 AM PDT.

A Los Angeles County Sheriff's vehicle is already on the way to pick up the heiress from her West Hollywood home.

53. Phone it in? Yeah, you can phone it in that she's going back to jail. The sheriff can send her home to serve out her sentence, that is if the judge didn't specifically say no electronic monitoring!

54. Let's hope this judge can count and not give Paris credit for one day of house arrest when yesterday was already counted for jail time. That is how she has served 5 days when the rest of us would have served 3, I wonder is this sherrif still has the lip stick on his zipper

irst Offense:

* up to a $2,000 fine
* 72 hours to 180 days in jail
* driver’s license suspension: 90 days to 1 year

Second Offense:

* up to a $4,000 fine
* 30 days to 1 year in jail
* driver’s license suspension: 180 days to 2 years

Third Offense:

* up to a $10,000 fine
* 2 to 10 years in penitentiary
* driver’s license suspension: 180 days to 2 years
