Paris Standoff -- Sheriff vs. Judge

TMZ has learned the reason Paris Hilton stayed at home while the lawyers and judge sat in court is because the Sheriff's Department refused to pick her up.

Law enforcement sources tell TMZ the Sheriff's position is that the judge does not have the power to order her to court. The Sheriffs believe they have sole jurisdiction to monitor and control Hilton while she is under house arrest.

The Sheriff's Department says they are the only ones authorized to take her anywhere. Thus, the standoff in court.

The issue may have been resolved, but that is why the hearing was delayed this morning.

The law in is an ass, blind freddy could see from all reports true or false that a heiress such as Paris Hilton (for example)was not going to go too jail for too long, treating the law as their own private play area (plenty of money ) and the attitude to do it and know they were maybe going too get away with it, Hmmm how times change , a judge standing by his order she should serve her time in jail.
The old adage'you do the crime you do the time!!! still stands to day no matter who we are !!!

184. As a former prosecutor in Florida, the Sheriff does not have a legal leg to stand on. The Sheriff violated a court order. If the Sheriff wanted to change the terms and conditions of her incarceration by putting her on house arrest he needed to file a motion/request with the Court. The Sheriff is not the judge, but just a professional jailor.

If I had been the Judge, the Sheriff would have been held in contempt and sentenced to 45 days suspended. Not just for contempt but for incompentence as well.

186. As a retired Home Detention program officer, it appears to me that the Sheriff of LA County was wrong in taking Ms. Hilton out of jail and putting her on the Home Detention program. Because, under California Penal Code Section 1203.016 (e) "At the time of sentencing or at any time that the court deems it necessary, the court may restrict or deny the defendant's participation in a home detention program." The sentencing Court made that order denying Ms. Hilton participation in a Home Detention program or any other alternative jail program at the time of her sentencing. So, the Sheriff was in violation of this section and the Courts order and shame on him. Maybe her daddy was a big campaign contributor to the Sheriff when he ran for election, who knows, maybe? The County jails are well staffed by medical and psychiatric personnel to deal with handling persons who have medical conditions or psychiatric conditions and they are allowed to continue supplying medications that the persons are normally on when admitted into custody. So, the
Sheriff caused a lot of distress for Ms. Hilton and the taxpayers by making this unlawful move.

187. ay to go Judge. The Sheriff should be held in contempt. It says that when you receive a legal court order it is the responsibility of the Sheriff to obey said order.
The Sheriff should be taken to task with possibly loosing his position for not doing his job....

188. This Sheriff needs to hand in his badge. Since when does the Barney with the badge tell the Judge what to do!!!! This entire situation is just ludicrous. Apparently Ms. Hilton thought this entire process to be somewhat of a joke. Well sweetie, guess the joke is YOU!

189. The media and the courts are ridiculous. How many other people have driven on a suspended license and not got thrown in jail for it. The judge and the prosecuter are only doing this to get famous too. This is not justice.

L.A. has always been known as the noth pole of wackos.Looks like this judge might just be the leader.This decision as far as i remember in law school is horrific.The only way this judge could have put her back in jail was if she broke her in house time.This judge is loking to make a name for himself.By the way his attitude and writing.to me he has a personal vendetta against the defendent.HE SHOULD BE REMOVED AND DISBARRED.

191. I dont think it is right what they are doing to paris. Although I would love too see the bi#ch in jail she shouldnt be treated like a ping pong. The 45 days are a bit harsh and he should of gave her the 23 days she originally had. she did nothing wrong the shereff did.

192. harvey levin is an idiot for defending paris (knuklehead) hilton. his opinion is worthless. she broke the law repeatedly and the judge did what someone should have done a long time ago. she continued to not follow court orders before and had her people open her mail and not do the right thing. so the judge not the sheriff did the right thing

193. #187 and #189 are absolutely correct. The sheriff should be investigated by the FBI and the US Attorney's office for civil rights. The release of Paris was a plain violation of law and there is no defense to it.

Who cares if Paris is undergoing psychological trauma? That is the whole point of being sent to jail. Everyone goes through some degree of psychological trauma. That is why they call it JAIL - hopefully the person learns a lesson - duh. Even if the lesson is that life isn't fair - welcome to the real world, Paris. I guarantee every inmate in there can point to someone that got off better than they did.

She was NOT just driving on a suspended license. She was on Probation for reckless driving w/ alcohol. The PROBATION makes the big difference. From what I have read, she has violated that probation twice.

As a former Assistant State Attorney in Florida, Ms Paris Hilton, better stay out of parts of Florida, for had she been driving on a suspended license while on probation for reckless w/ alcohol coupled with another probation violation, she would have gotten 6 months to 364 days in the county jail. Apparently, California, is not as tough on criminals as Florida is.

When I hear lawyers in LA say that the 45 days sentence is "stiff", I just shake my head. Pretty pathetic, but then I guess when you would rather coddle illegal immigrants and pay for their impact by plundering taxpayers for increased costs in education, social services, and other services, then build jails to deal with increased crime and tell the illegal invaders to go home.
