Can any lawyer out there answer this? Mark Geragos tonight on Larry King said that if Paris Hilton appeals Monday she will be out on bail that day until the appeal hearing. Is bail automatic in cases like this? Mark Geragos made it seem it is? What is the likelihood of her getting out this Monday?

For those of you who think she's being singled-out because most of that facilities inmates go home early, you need to confirm your stats because MOST actually do their time minus "good behavior", just like she's being made to do. It's about time the status-quo were actually enforced. Maybe the "stars" and "affluent" had better change their ways and decide to join the masses at-large in being co-investers in the fabric of society,...or, be forced to.

364. ok seriously if any regular person had done the same thing our ass would be in jail...she got a DUI this is not like a speeding ticket! She took it upon her self to put the lives of other people on the road in danger, and thinks that because her last name is "Hilton" that rules do not apply to her, well that is just BS! She is the one who violated her probation, not just 1 time but 2 times and wasn't she supposed to go to alcohol classes and didn't?????? WTF...seriously I can't believe the amount of tax payer money that is being wasted by her, I think the court should make her pay for the extra cost that this whole thing has cost....Appeal my ass! Good luckhaving any fans left once this is done

367. I am a retired CA Home Detention Officer. It is unlawful for the Sheriff of LA County to release a sentenced inmate to a Home Detention program if the sentencing Court has precluded Home detention as an option at the time of sentencing. In the Ms. Hilton case, the Court precluded by Court order her participation in a Home Detention program or any other alternative jail program. Section 1203.016 (e) of the CA penal code gives the right to the sentencing Court to preclude Home Detention participation. ("At the time of sentencing or at any time that the court deems it necessary, the court may restrict or deny the defendant's participation in a home detention program.")
The Sheriff of LA County brought this hardship on Ms. Hilton and the taxpayers by unlawfully releasing her against the Courts order to the Home detention program. And even if she has underlying medical or psychological problems, the County jails are well equipped to handle these problems and even dispense to the inmates their normally prescribed medications. So, shame on the Sheriff, he knows better.

369. I am so sickened by the comments here to the events of today. Paris went to jail and served her time with dignity. She has had no hand in anything that happened since. ALL non-violent prisoners in LA serve about 10% of their sentences. Paris has already done more time than any "normal" person would have in her shoes. This judge is so far out of line he needs to be sanctioned in some way. It is just appalling what these incompetent power-hungry judges are capable of, and because the media hounds Paris you all think it's funny. You disgust me. You deserve the president we have, the economy, the war, and every other thing that is wrong with this country.

370. First, I am glad that Paris is back in jail to serve her sentence.
Second: I am bothered by one thing- TMZ reorted that due to credits for good behaviour, overcrowding, etc, that 3 days is a normal stay for this offense. So, IF Paris is to be treated like everyone else, then why was she sent back? Why was another UNDERAGE actor across the hall let free for the same thing???? The courts really need to be consistent. Don't get me wrong, I don't think anyone should get time off for good behaviour- do the crime, do the time.... I am all for celebs being treated like everyone else, but a judge can go too far to prove a point. Quite honestly, I think Paris should have to sit and watch that video of Martin Heigden crashing into that limo killing two people, along with having to look at a picture of Katie Flynn. I also hope that Nicole Richie's judge and the DA saw her laughing it up with Dave about her own impending hearing.
Third:The language here is disgusting. It doesn't make any of you look like you are smart anything. Try getting your point across without foul language. People will pay attention better.
Last: For all of you parents out there who are raising kids without limits, never saying no, etc. STOP!!!!!!!!!!!!!!!!! This is where your children are headed. Yes, Paris is an adult, and should know better, but look at how she was raised, and how many chances she has constantly been given, and all of a sudden you can't blame her for trying to get out of something because it has always worked before.

I dont understand how she can get off with only 23 days out of a 45 day sentence i think thats bs cause when i went to jail for a probation violation i got 30 days and had to serve all of them till the exact time i went to jail so where does she get off thinking she any better you screw up you pay she should have gotten longer considering she was drunk driving i think anyone that drinks and drives should get a 6 month sentence and if they dont learn then send there ass to prison i mean this is a winy lil bitch that is too good for the rest of us offenders granted i wasnt drinking and drivin i went to jail over driving on a suspended license and violated my probation by not completing comunity service when i had actually completed but due to my neg of not asking for a copy of my hours completed i paid the price and i got all this with a public defender however i wasnt suspended due to dwi or dui so i think she got a very fair sentence and should have to serve the full sentence hell its only a month and a half wa wa if you dont want jail stay out of trouble cry baby

372. She should also sue L.A. county. The grounds is simple when you are put in jail you can wine and complain all you want so what. The fact that she was reassign to her house was not her doing.
She had no right you lose all right when booked and you don't have any say on anything until release. So She was not let out of jail with a get out free card like Fox news claim. She was order to stay in her house. If you had a choice Jail or house I bet everyone would pick house.
So there was no reason for the judge to be ticked off at Paris she had no say it was up to the sheriff and his staff. I would also ask for a new judge for my case and probation since the judge hates her so much he clearly don't care about the law when it comes to her.

373. She got a raw deal, more time than most. The judge is a pervert that likes hurting girls, he taunted the sheriff about her medical papers over and over (he's a real pro) and he put a potentially sick person back in jail because the morons in the newspapers told him to.
Paris, do your time and keep your notes. When you get out use some of your money to smear boogers all over him and perhaps get him fired. Don't get angry, get even.

374. Kathy Hilton should be in the next cell,,, around the corner on a different floor. She STILL thinks she is ABOVE the law. What a loser & a horrible mother. Kathy turned out just like her mother! She makes Lynn Spears and Gina Lohan look like good mothers who lost control of their girls. Kathy Hilton looks like a selfish golddigging mother who used her girls (Nikki was too ugly to really work with for what Kathy had in mind) to get herself famous, since she couldn't do it on her own. Now that is PATHETIC!

375. 45 - 23 = 15 days to serve. press rewind. do the 15 days without leaving the cell, who needs to shower, use the hilton $ to make sure guards are 7/24 to make sure she's not harassed. she could have come out a hero.
