Anna Nicole Pot Judge Burns Out

Judge Lawrence Korda has decided to weed himself out of the Broward County courts, announcing his early retirement from the bench. Righteous, Your Honor.

Korda, who heard arguments in the Anna Nicole Smith case, made a hash of things when he was arrested in March for allegedly firing up a doobie in the park -- and then pleaded not guilty -- to toking-up in the city park. The South Florida Sun-Sentinel reports that Korda's reeferiffic exploits sparked an official inquiry, which he avoided -- talk about harshing your mellow! -- by stepping down yesterday. Korda, according to his lawyer, was considering retirement anyway.

Hizzoner will be ganja for good on July 2.

Criminal Profiling Topic of the Day: Anna Nicole’s Doctor Under Investigation

Well it’s about time. The DNA results naming Larry Birkhead as the father of Dannielynn Smith dominate today’s headlines, but there is a more important development in the Anna Nicole Smith saga. According to BBC News, the friend and psychiatrist who treated Anna Nicole Smith, Dr Khristine Eroshevich, is now under investigation by California authorities. California medical board spokesperson, Candis Cohen, confirmed that Dr Eroshevich is being investigated in connection with Smith’s death, but declined to provide further details.

There are some disturbing findings regarding the actions of Dr Eroshevich, and others, contained in documents released by the Broward County Medical Examiner’s Office. These findings raise questions that require answers.

The investigative report by Broward County Chief Medical Examiner, Dr. Joshua Perper contains a timeline of events beginning with the arrival of Smith and her companions, which included Dr Khristine Eroshevich, in Florida.

“…At 8:30 pm the party checked in at the Hard Rock Hotel in Hollywood. Maurice Brighthaupt, a friendand former body guard met them at the hotel. Anna’s temperature was taken by Dr. Khristine Eroshevich and was 105 degrees. Anna was told to have 911 call for transport to the hospital, but she categorically refused. She was given an ice bath and her temperature dropped to 97 degrees. She was given Tamiflu as well as 1000 mg of Ciprofloxacin with water. Chloral Hydrate was added for sleep. She fell asleep around 10 pm”

After Dr Eroshevich discovered Anna Nicole had a fever of 105, she told her “to have 911 call for transport to the hospital, but she categorically refused” Why did she ask an extremely ill patient with a dangerously high body temperature if she wanted to call 911? Then Dr Eroshevich proceeds to treat her for the fever and infection and give her a drug for sleep that is “a DEA Schedule IV controlled substance that is infrequently prescribed as a hypnotic agent which may cause respiratory and central nervous system depression, coma, convulsions, cardiac arrhythmias and death.

Anna Nicole Smith did not urinate and had a “pungent” odor and temperature of 100 degrees. She was at time depressed but she was able to watch television and appeared overall okay. She was given a bath and various fluids including pedialyte, camomile tea and Fiji water. She felt well in the afternoon after a bath and was given chloral hydrate for sleep. She slept about two hours, then she watched television until 11 pm. She took another dose of chloral hydrate and asked for Soma, Klonopin, Valium, Topamax (unknown if she took these medicines).”

Anna Nicole still has a fever and is now presumably severely dehydrated evidenced by a lack of urination. Dr Eroshevich gives Anna Nicole fluids, a bath, and more chloral hydrate. Furthermore, autopsy test results show that Soma, Klonopin, Valium, and Topamax, were 4 of the 7 prescription drugs (plus 2 over-the-counter drugs for a total of 9), which included chloral hydrate, found in Anna Nicole’s system. It may be “unknown” if she took those medications at that time on February 6th, but she did take them in the days prior to her death.

Anna stayed awake in bed, watching television around 11 am. She was feeling better and ate breakfast/lunch (omelette of egg white and spinach). In the afternoon she was observed naked and sitting confused in a dry bathtub. She subsequently took a bath. In the evening she ordered 2 crab cakes and shrimp for dinner. Dr. Eroshevich left in the evening for California. Anna was upset and depressed over her friend’s departure. Maurice (“Big Mo”) Brighthaupt returned after Dr. Eroshevich left. Anna was still complaining of not feeling well. She was in the bathtub when Maurice Brighthaupt left for several hours returning between 8-10 pm. Anna was seen on the couch and Howard K. Stern was present but in the bedroom. Maurice went to sleep in the guest room and awakened around 4 am. When he checked the couch, Anna was no longer there and he assumed she had gone to sleep in her room.”

Soon after the still ill Anna is “observed naked and sitting confused in a dry bathtub”, no doubt due to a drug induced stupor, Dr Eroshevich leaves her with the 7 drugs that she has prescribed for Anna Nicole under false names and no medical supervision, then proceeds on her merry way back to California. If this is how Dr Eroshevich “treats” her friends, who needs enemies.

The rest of Anna Nicole’s companions aren’t much better.


“5. Thursday, February 8, 2007
Maurice woke up around 9 am. Around 9:30 am he went to Anna’s room and thought he saw her moving but was not certain. He told Howard he was going to have breakfast with his wife, Tasma. Mr. Stern awoke between 9-10 am and helped Anna to the bathroom. He then watched television in another room until King Eric called to inform him of his arrival at the airport. Mr. Stern then called Maurice to instruct him to pick up the guests (King Eric, his common-law wife, and another man). Upon the arrival of King Eric and his party at the hotel at around 12 pm, Mr. Stern called out to Anna who was still in bed to arouse her. One of the guests then urged him not to wake her so he did not call her again.”

Stern “called out to Anna who was still in bed to arouse her.” The least he could have done was actually enter the bedroom to check on her.

“Shortly after 12 pm, Maurice, Mr. Stern, King Eric, and the other male visitor left the room at the Hard Rock Hotel. Maurice left to take care of personal business and Mr. Stern, King Eric, and the other male guest left at the same time to pick up the boat. Maurice asked Tasma, his wife who is a registered nurse, to stay with Anna. She worked on the computer in Anna’s room while Anna remained in bed under the covers. King Eric’s common-law wife remained in an adjoining room. At about 1 pm Tasma Brighthaupt was on the phone with her husband, Maurice Brighthaupt. The boat captain’s wife, who had been in the guest room, came into Anna Nicole’s room because she thought Tasma was talking to Anna Nicole. When the captain’s wife realized Tasma was not talking to Anna Nicole, she went around Miss Smith’s bed and took a look at her. She then told Tasma to come take a look at Anna because she didn’t like the way Anna Nicole looks. Tasma hang up with Maurice and came around the bed. She saw Anna’s face slumped downward on her chest, her mouth open and without breathing sounds. Tasma Brighthaupt initiated CPR after calling her husband Maurice. She alternated mouth to mouth breathing with chest compressions, checking for a pulse until Maurice arrived.

1:38 pm Maurice returns to the Hard Rock Hotel and he took over resuscitation.
1:40 pm Seminole Emergency Medical Service was called.
1:43 pm First patrol unit arrived to room 607.
1:46 pm Seminole paramedics arrived. CPR was continued.
2:43 pm Anna Nicole Smith arrived at Hollywood Memorial Hospital.
2:49 pm Anna Nicole Smith is pronounced dead and the Medical Examiner’s Office is notified.
4:15 pm Associate Medical Examiner, Dr. Gertrude Juste responds to scene of death pronouncement at the Hollywood Memorial Hospital.
4:59 pm Anna Nicole Smith’s body arrived at the Medical Examiner’s Office and is logged in.”

At about 1 pm, Mrs. Brighthaupt, who is a registered nurse, calls her husband before starting CPR, and does not call 911. The “Scene Report - Seminole Hard Rock Café” by Associate Medical Examiner Gertrude M. Juste, M.D. states information was initially provided by Seminole Detective Marian Bryant that Tasma Brighthaupt noticed something wrong with Smith at around 12:30 p.m. Maurice Brighthaupt arrives approximately 38 minutes later, and then 911 is called.

Dr. Perper’s final summary conclusions:

“D. HOW THE INCIDENT OCCURRED

INGESTED EXCESSIVE AMOUNTS OF CHLORAL HYDRATE
IN COMBINATION WITH THERAPEUTIC LEVELS
OF OTHER MEDICATIONS

E. PROBABLE TERMINAL MECHANISM:

RESPIRATORY DEPRESSION”

The report also states, “Chloral Hydrate was the most significant drug implicated in this fatality, however several other prescription medications also played a role in this death.7-10 Although the remaining pharmacologic agents were at therapeutic levels, each of these drugs is known to interact with chloral hydrate resulting in an increased risk of overdose.”

Respiratory depression would account for Mrs. Brighthaupt’s statement that Anna Nicole appeared cyanotic or “blue.” In the eyes of the law, Anna Nicole’s life is no less valuable than anyone else’s is. Yes, Anna Nicole Smith was an admitted abuser of prescription drugs, and this contributed to her death. However, this does not relieve Dr Eroshevich of her responsibility for prescribing the potentially lethal combination of medications. Would Smith still be alive if 911 were called sooner so that she could receive proper emergency medical care? We will most likely never know, but the fact remains it was at the very least irresponsible, and at most, criminal, that help was not summoned sooner.

37. Howard’s Eulogy for Anna

“The truth, there’s only one truth, and it’s not what people say in court, even if those people are your blood relatives,” said Howard. “It’s not what people who claim to be your friends say to the media. … The truth is what your life … what you touch, what you feel, what you see with your own eyes, what you observe for yourself. I know the truth about Anna. …

“No one could give Anna the credit she deserved. It doesn’t matter what anyone says. We know the truth. … People questioned whether she was bright, she didn’t graduate from high school… I could guarantee you, Anna was smarter than I am. She became a household name. [She was one] of the most famous people in the world. It didn’t happen by accident, it wasn’t managers, lawyers, agents, it wasn’t me, it was all her. …

“Anna was an entertainer, a true entertainer. It didn’t matter if she was acting just with her friends, she knew what people wanted and she gave people what they want. … It didn’t matter where we were or who was there — actors, musicians, politicians — everybody’s focus was on Anna. She was the center of attention, it wasn’t even close. …

“MARILYN MONROE was her idol, [and] I’ll bet you if they lived at the same time, and they met, Marilyn would be flocking to Anna. It’s not disrespect to Marilyn … it’s just that Anna was that special.

“When Anna was alive it was one thing, but it was wrong for people to portray Anna the way they did when she passed away … people who claim to be friends, her lawyer and even the judge … if these people have decency, or dignity, or any concern for Anna or DANNIELYNN, they wouldn’t have done it … it was disrespectful, but not the truth that I know, not the truth that I know. …

“She controlled her life. Her opinions were her opinions, and her judgment wasn’t clouded by anything, she was wonderful and she was kind. To me she was perfect. … She lived her life in a fishbowl and fought with one of the richest men in the world, all the way to the Supreme Court, and she was publicly ridiculed every day. … The only thing she couldn’t overcome was the death of her son, DANIEL, who was the world to her. And I quote [from Anna’s eulogy for Daniel], ‘You were my rock, the only one that kept me solid. … You were always afraid of dying, and I never believed you, and now you’re gone. It’s so hard to think of you … my heart is empty, I will come home to you.’

“From the day that Daniel passed, she had nightmares that Daniel was lost and he didn’t know what to do. … Well, Anna, today you are going home to Daniel to the Bahamas and in heaven. I understand how you felt when Daniel died because you were my rock, and now my heart is empty. I wish God took me instead. … When we were together, it didn’t matter what people said, nothing mattered because we knew the truth. … Sometimes it felt like it was us against the world. I can’t believe that you’re gone and you’re not here to protect anyone, and honestly, sometimes I don’t know how I’m gonna go on, but I know that my work isn’t done. I still have to protect you, I have to protect your wishes, I have to protect your name, and most of all I have to protect Dannielynn, and I promise you, as long as I’m still breathing, I will, no matter who comes at me.

“You and I, we know the truth. We lived it, and that’s all that matters. When my work is done, I promise you, I will come home to you again, both you and Daniel. I love you.”

38. 22732. There's now one less mystery surrounding the sudden death of Anna Nicole Smith's son—the where and when of his burial.

Nearly six weeks after the 20-year-old died while visiting his mother and newborn sister in a Nassau hospital room, Daniel Smith was buried Thursday in the Bahamas. A family statement announced Daniel was interred at 3:27 p.m. in a private ceremony at an undisclosed location in Nassau.

"Anna Nicole Smith laid her son to rest today. It was the most difficult day of her entire life," Howard K. Stern, the model's lawyer turned paramour, said.

Stern also gave the eulogy at the service.

“Daniel is Anna's rock, and that became even more profound at today’s emotional service. Howard, Anna and [daughter] Dannielynn Hope need to cherish, love and be strong. May the blessings of peace, hope, life and, above all, love, be theirs,” added Alex Goen, CEO of TrimSpa.

While Smith's camp declined to go into detail, a spokeswoman for the local Lakeview Memorial Gardens & Mausoleums confirmed to the Associated Press that the funeral had taken place at the cemetery.

Deborah Cartwright told the wire service that a gold-colored hearse brought Daniel's body to the grounds, on which a large green tent had been erected for the private service. She said that he was interred in a mahogany casket.

To ensure the affair was kept as private as possible, six police officers stood guard at the cemetery's main entrance, with plainclothes officers stationed outside the tent. Invited guests of the service were the only people allowed on the grounds for the duration of the funeral.

Earlier in the week, Entertainment Tonight reported that roughly 25 mourners were expected and that Daniel would likely be buried wearing a trucker cap, T-shirt and blue jeans, his preferred wardrobe.

ET also claimed that the mourning mother would be wearing a black dress and veil to the service, created specially for the occasion by designer Pol' Atteu, the clothier responsible for Smith's last-minute matrimonial garb for her commitment ceremony to Stern last month.

The not quite wedding ceremony, held on Sept. 28, was a source of contention between Smith and Michael Scott, the attorney who was representing her during her sojourn in the Bahamas. Scott abruptly quit as the actress' counsel last week, saying he disagreed with Smith and Stern's behavior in the wake of Daniel's death.

Scott told reporters that among his biggest beefs was that Smith and Stern organized and carried out a commitment ceremony prior to burying her son, who died Sept. 10.

Smith had initially intended to bury Daniel in California, contacting a funeral home there in the days after the young man's demise. But she reconsidered as the probe into his death languished. Meanwhile, her ex-husband and Daniel's father, Billy Smith, held an Oct. 7 memorial service for Daniel in their Texas hometown of Mexia.

While the burial grants some closure over Daniel's death, the tragic incident is sadly far from over. Authorities have yet to declare an official cause of his death, though a private pathologist hired by Anna Nicole announced last month that Daniel died of an accidental combination of methadone and the antidepressants Lexapro and Zoloft.

Anna Nicole Smith is set to have the body of her dead son Daniel exhumed.

The former Playboy playmate buried her son in the Bahamas on October 19, but now she is unlikely to be granted permanent residency in the country she may dig up Daniel’s body to take back with her to the US.

A source is quoted by website MSNBC as saying: “She waited as long as she did to bury him because she was trying to figure out if she could get his body into the US.

“Now that she might get booted out, the word is she’s going to take her son’s body with her.”

Anna Nicole, 38, has had her Bahaman residency challenged after it was revealed that the waterfront mansion she claimed to own actually belongs to someone else and she has been served with a notice of eviction.

It is alleged that the former model was hoping to make the Bahamas her permanent home to avoid a paternity test on her newborn daughter Dannielynn.

Anna Nicole has named her lawyer, and lover, Howard K. Stern as the father of her daughter but photographer Larry Birkhead claims he is the biological dad and has issued a court order demanding a paternity test.

Daniel died in September at Anna Nicole’s hospital bedside just hours after she had given birth to his new half-sister. A toxicology report found large amounts of prescription drugs in his blood stream.

Discuss today's hearing with Linda Kenney Baden, criminal defense attorney, former prosecutor and author of "Remains Silent." She was just on Courtside, and she's joining us here now.

Court TV Host: Welcome, Linda Kenney Baden, thanks for being our guest online today.

Linda Kenney Baden: I hope the general public doesn't get the wrong idea about what happens to a person when they die. Usually, in most cases, there are not many lawyers involved, and no fights over burying a body of a loved one. What everyone should be aware of is that this is not the normal common procedure, should one of your loved ones die.

Question from odeeo: Linda, have you ever seen a circus like this before?

Linda Kenney Baden: The answer is no. I have been involved as a forensic attorney in several probate actions, including one that I'm handling now that has gone on for seven years. However, usually there is agreement that the person who has died be allowed to rest in peace quickly and that the family members and loved ones of that person be allowed to grieve in a normal, funereal process. Here, it appears that everyone is trying to get some type of position in order to claim parental rights or guardianship rights over a child who may stand to inherit a lot of money. That is not normal, and if Anna Nicole were of a different religious persuasion the delay of her burial could have a significant impact on the family.

Question from Mimmi: Who legally has a right to her body?

Linda Kenney Baden: This is actually a good question, because what you are asking is: who has the right to make decisions regarding her burial? The answer is both simple and complicated. Usually, it is the next of kin, starting with a child who is over 18. Then, if there is no child, it's the mother and father. Then, if there is no mother or father, then brothers and sisters. If there is a spouse, however, that would trump the family right to make decisions regarding burial. In this case, there is no spouse. However, if there is a will normally the executor who is the person that is given the authority by the deceased when the deceased was alive, makes the burial and funeral arrangements, and since the will does not have to recognize next of kin then the executor can in some states trump or overcome the rights of the next of kin. If there is no will, or there is a dispute, and the case has come into court, as has happened here, the judge is also required to look at the desire of the deceased as expressed when the deceased person was alive. This is commonly called "testamentary intent." It is being argued in this case that Anna Nicole Smith had expressed a desire to be buried next to her son Daniel and that she even bought a second burial plot to demonstrate this intent. This could end up being very important to the judge in determining who should have control over the body, or the judge may decide that a specific person should have control over the body, but be required to bury the person next to her son, if that was her desire. The probate court is the court that deals with death and inheritance, which is a court of equity - that means that the judge has powers that are beyond those that exist in the statute and can do what he believes is fair and right. This judge may even be able to decide who the father of the minor child Danielynn is in order to make a determination as to who is next of kin under Florida statute for the purpose of burial. That is why this case is both simple and complicated.

Question from hammy: Linda, how does the paternity question pan out at this stage when Stern is already listed on the child's birth certificate?

Linda Kenney Baden: Technically, under most jurisdictions, he is the father, unless and until a court determines otherwise. Since Danielynn is without doubt the only surviving child of Anna Nicole Smith and since she is under 18, then her father may be the one to express her desires concerning her mother's burial. We saw the court today appoint a guardian ad litem for the child on this issue even though we know the child cannot yet speak. If Howard K. Stern is declared to be definitely the father, then there is no need for a guardian, and Stern would be able to express to the court the child's wishes and follow through with Anna Nicole's desires as she set forth under her will. So paternity enters the situation through he backdoor.

Question from mrsplants: What if there is no will?

Linda Kenney Baden: If there is no will then the rights to the inheritance are determined by the statute of the state that the will would have been probated under. Or the laws of the country of which she was a resident. These will all be open issues in this case, because there is no doubt in my mind that if the will is offered for probate anywhere, the validity of that will is going to be challenged by others who could inherit. Therefore, even if she had a will, her estate may still end up being distributed as if there is no will, if a successful challenge is made. Additionally, I imagine there will be a challenge if there is a will to the appointment of Howard Stern as an executor because the executor takes a percentage of monies for administering the estate and if an estate is worth $88 million, that could be a value of $5 - 6 million alone.

Question from court-reporter1: How in the world is the court reporter actually making a record of that horrible hearing with all the lawyers talking at once and the judge constantly interrupting?

Linda Kenney Baden: Usually, in chambers, hearings are tape-recorded, and that is why attorneys had to announce who they were in the beginning and who they represented. The judge indicated that tomorrow he will move to the court room because it was very difficult, i thought, as a viewer to determine who was talking , because we were seeing mostly the backs of their heads. But this type of free for all in a judge's chamber conference area, when there are cases dealing with a large number of attorneys and in high profile cases, judges generally want to let everyone speak and make a record, so there can be no attack on the judicial system that there wasn't a forum for all parties.

Question from hammy: Linda why would several samples of DNA from Anna be required when one report could be shared by all claiming to be the father? That does not make sense?

Linda Kenney Baden: At every autopsy the medical examiner takes samples from various sections of the body. These are tissue samples. They are generally of the heart, the lung, the brain, and other organs that may be relevant to a determination of a cause and manner of death. Usually, it is from these tissue samples that DNA is extracted. Here, for some reason, the attorneys for Larry Birkhead wanted to take a "buccal" swab, which is a swab from the inside of the cheek for skin cells. Just as an aside, everyone should know that the only cell in the body that does not have DNA in it is the red blood cell. Here, you are correct, the medical examiner had plenty of tissue samples from which to take DNA but the attorneys may have been looking to make sure that all types of samples were taken because they have further testing issues in mind. For instance, Anna Nicole Smith's natural hair looked to be about 12 inches or so long. If a number of the strands of the hair are removed from the root intact, then someone could test for any drug she was taking over a period of time. Hair grows at about a half an inch a month and by taking segments of it and performing what is called segmental analysis you could look to see whether she had been on narcotics or other drugs for a period of about two years. I suspect that the samples that are going to be looked at to determine whether they are adequate go beyond tissue samples for DNA determination.

Question from kiara: Ms. Baden, how critical is Anna Nicole's Bahamian residency to the custody issue?

Linda Kenney Baden: The issue of which jurisdiction controls is always a big issue in the law and if the paternity law in the Bahamas favors a person who is listed on the birth certificate, then it could be crucial, because, assuming Howard K Stern is not the father, he would argue that Bahamian law would apply and not California or Florida law. I am aware that in the Bahamas that for purposes of inheriting your parents' estate, that if you are on the birth certificate, it is considered unassailable that you are a child for purposes of inheritance. However, it does not automatically mean that you are a parent for the purposes of a paternity fight and there appears to be a lot of confusion about this issue in media reports that I have read.

Question from mrsplants: What if they find out that Howard K. Stern helped murder her by letting her have her drugs?

Linda Kenney Baden: The medical examiner has to find out first what killed Anna Nicole Smith. If it is determined that it is a drug overdose, the drug overdose could be considered accidental or suicidal. But if it is determined that someone gave her the drugs improperly or illegally, then the medical examiner could rule the death a homicide, which means death at the hands of another. If Anna Nicole died of illegal drugs, or illegally obtained drugs, whoever obtained those drugs could be charged with a criminal act. There are some jurisdictions that would charge that type of case as a manslaughter case, others would charge it as murder and sometimes the DA would make no charges, depending on the facts of each case. But there is no doubt that should the ME rule this as a homicide, the fingers would be pointed at a third party and we have already seen suggestions of finger-pointing against Howard Stern for being an enabler of Anna Nicole Smith's behavior. At this point, we do not know whether this is true and should wait for further investigations and findings before we rush to rumor and judgment.

Eroshevich was referred to treatment centers where Smith's problems — chronic pain and grief over her son's death — could be addressed professionally.

But Eroshevich would have none of it. Even though the expert warned her that the drugs she was ordering were "horrible combinations" and that one dose was enough to kill someone, Eroshevich ignored him.

Luckily, sources say, Kapoor was reassured when he first heard from Eroshevich, Smith and Howard K. Stern, that she was not breastfeeding her newborn baby girl.

Nevertheless, Kapoor was apparently horrified when Eroshevich told him, "I need something to knock her out." And the notion that the baby might be a priority didn't seem to matter.

"She told Kapoor that she hadn't bonded with the baby, and that she had people there to look after her," a source said.

All of this happened on or around Sept. 15, 2006, approximately five months before Smith died. Because "The Insider" and "Entertainment Tonight" have paid Eroshevich for interviews, they are not asking her anything definitive or questioning what went on in the Bahamas at that time or from then on.

Smith became Kapoor's patient in 2004 after he inherited the practice of a physician who retired. He had continued the treatment prescribed by the prior doctor: a low dose of methadone for chronic pain.

"Hundreds of thousands of pregnant women are on methadone. It doesn't affect the placenta," a source said.

Many respected medical journals describe the safety of taking methadone during pregnancy. But the other drugs Eroshevich ordered surprised Kapoor, friends say, especially since he had never heard her name until that day in September.

"Stern told him Eroshevich was a longtime friend," a source said. "He said that they hadn't given Anna anything for pain after her C-section. And Eroshevich said she would be with Anna Nicole 24/7 and that she would administer the drugs herself."

Kapoor responded that he would not send them, and that he was particularly concerned about the dose of Dalmane, which was 12 times the limit.

"Eroshevich told him Anna Nicole was really tolerant of Dalmane," a source said.

But after the phone call and fax from Eroshevich, he heard from Smith only one or two more times. The last time was in November. Smith died three months later.

45. Bahamas Cabinet Responsible for Anna Nicole Smith Affair

It seems we simply cannot escape Anna Nicole Smith now that she has sashayed onto our national stage with her bizarre behaviour and the swirl of controversy which seems to follow her wherever she goes.

There are a lot of issues facing us at the moment and ordinarily Ms. Smith would have been exempt from serious commentary. But she has thrust herself onto our agenda, enthusiastically facilitated by a Minister and a Government who seem to think that she is a positive addition to the Bahamian scene.

It looks as if her outlandish antics will continue to grab newspaper headlines and that her dealings will be the subject of litigation in our courts.

But however these should develop, the immediate concern of Bahamians is the conduct of their Government and the Government has made three fundamental errors in this affair.


The first mistake made by Minister for Immigration and Labour Shane Gibson and his colleagues in the PLP Cabinet was when they decided that Ms. Smith was a fit and proper person to be granted the privilege of permanent residence in The Bahamas.

The second mistake was when the Minister, obviously aided and abetted by his colleagues, decided that this was a case deserving to be put on the fast track for approval.

When what they had done became public knowledge, they made their third mistake. Instead of admitting they had done the wrong thing, they threw up a smokescreen of obfuscation and prevarication.

For all of this Mr. Gibson and his colleagues should be held immediately accountable regardless of the incidentals.

The Bahamian people look to their government and no one else to decide for them who should get permits to reside in The Bahamas, however conditional. Permanent residence, with or without the right to work, is the highest status we can give an expatriate short of citizenship.

It is the responsibility of the Government to do its due diligence exercise but in the case of Anna Nicole Smith, the Government fell down and failed even to employ common sense.

Even if Ms. Smith had put down $5 million of her own money to buy a house in The Bahamas, she should not have been considered for permanent residence. The purchase of property does not entitle any foreigner to permanent residence in this country. There are other considerations.

The men and women – all 17 of them -- who sit around the Cabinet table in the Churchill Building live right here on planet Earth; they are not from Mars. Every one of them must have heard of Anna Nicole Smith and must have been aware of her notoriety, and yet they concluded that she was a fit and proper person to have permanent residence in our country.

People who are accomplished in the arts, especially the performing arts, earn the appellation of celebrity, and they often behave badly. But at least they are talented. Ms. Smith is regarded as a celebrity by some, including the PLP Government, but any talent she might have is not immediately apparent.

Being a drama queen and being able to cry without shedding tears does not mean that one is a thespian, and publicly indulging in outlandish behaviour does not – should not -- earn one the status of celebrity.

There is little we can do to protect our young people from the avalanche of crude behaviour that is so readily available on television and the internet but our Government should not be a party to importing it live.

Furthermore, in the case of a country and a people, it is not true that any publicity is good publicity. The kind of publicity that Anna Nicole Smith was bound to bring to The Bahamas we can well do without.

Prime Minister Perry Christie, Minister Gibson and their colleagues did a grave disservice to the country when they gave Anna Nicole Smith permanent residence. Mr. Christie must be aware of all this but once again he has allowed one of his unruly ministers to lead him -- and the country -- down the wrong path.

It is crystal clear that the main reason Ms. Smith’s application was processed with such indecent haste was her friendship with Minister Gibson.

To tell the public that this was due to improved efficiency at the Department of Immigration and that she was a celebrity and an investor is all quite laughable.

But that is what the Prime Minister of The Bahamas and his Minister tried to sell to the Bahamian people; and, in the face of massive incredulity, Mr. Christie responded: “If you don’t like it, lump it!”

It is a good thing in party politics for a prime minister and other colleagues to rally to the defence of one of their own who is under attack, especially if that attack is unjustified or exaggerated. It can be a good thing even in a case where a genuine mistake has been made.

But it is wrong for a prime minister to try to defend what is patently indefensible and in the process to put partisan loyalty above the best interests of the nation and to abuse our system of government.

If there was indeed such improved efficiency at Immigration under Mr. Gibson’s leadership, then the best way to have demonstrated that would have been to deal with the many deserving cases lying around for many long months.

Some applications for permanent residence and citizenship deserve to be put on the fast track for compassionate and humanitarian reasons as well as natural justice. It is an affront to all those decent people who have been waiting for so long to see Ms. Smith jump the queue because of her friendship with the Minister.

Strictly speaking, anybody who buys a piece of Bahamian property or starts a little business here can be described as an investor. But it is also true that when Bahamians use the term they usually have in mind someone who comes to the country to do more than buy a house – or have someone buy her a house -- so she can qualify for permanent residence.

Bahamians will readily understand if a foreigner who comes with millions to invest in the development of the country is put on the fast track for permanent residence. But Anna Nicole Smith is most certainly not in that category, and even if she were, a judgment would have to be made as to whether she is the kind of investor we want.

It is quite apparent that Minister Gibson was intimately involved in the processing of Ms. Smith’s application for permanent residence from beginning to end and that he was anxious to have it done as quickly as possible.

As a matter of fact, his very own words bear out that conclusion. When he was challenged about the haste, he blurted out: “If it could have been done in a day, then I would have done it in a day!”

Clearly, the Minister could not have done it in a day but he set about getting it done as quickly as he could. That is the principal element at the heart of this affair and the answer to all the incidental questions.

That is why the Minister’s vehement denial that he personally received the cheque for payment of the permit fee falls on deaf ears. It is merely evidence of something he had already pleaded guilty to: his desire to get the residence permit for his friend issued as quickly as possible.

Reasonable people can also come to the conclusion that that is why a copy of the conveyance for the house found its way into the files of the Department of Immigration even though the lawyers handling the application say they did not send it; and why Ms. Smith was able to inform the lawyers that her residence permit was granted, not the other way round.

It is no use trying to blame the lawyers nor a former minister nor anyone else for this atrocious affair; the Prime Minister and his colleagues, especially Minister Gibson, are the ones responsible.
