Anna Nicole Pot Judge Burns Out

Judge Lawrence Korda has decided to weed himself out of the Broward County courts, announcing his early retirement from the bench. Righteous, Your Honor.

Korda, who heard arguments in the Anna Nicole Smith case, made a hash of things when he was arrested in March for allegedly firing up a doobie in the park -- and then pleaded not guilty -- to toking-up in the city park. The South Florida Sun-Sentinel reports that Korda's reeferiffic exploits sparked an official inquiry, which he avoided -- talk about harshing your mellow! -- by stepping down yesterday. Korda, according to his lawyer, was considering retirement anyway.

Hizzoner will be ganja for good on July 2.

Dr. Joshua Perper, the chief medical examiner in Broward County in Florida, said he would have never sent Anna's tissues out for testing for Chloral Hydrate because the drug is such an antiquated sleeping aid. As a matter of course, he said, coroners just don't check for it anymore. The only reason he tested for it is that a bottle of the drug was found on the scene of the death.

Prior to the testing for Chloral Hydrate and subsequent discovery of the drug in Anna's tissues, Dr. Perper was prepared to label Anna's Cause of Death as "Natural," brought about by the "natural process of disease," such disease being infection of the blood with intestinal flu as a contributing factor.

However, once the test for Chloral Hydrate confirmed the drug was in Anna's tissues, Dr. Perper had a new piece of the puzzle and, accordingly, changed the cause of death from "Natural" to "Accidental."

Dr. Eroshevich, Anna Nicole's friend and psychiatrist, wrote the prescription for Chloral Hydrate in Howard K. Stern's name, but the drug was intended for Anna Nicole Smith. The therapeutic dosage was written as 2 tablespoons at bedtime.

Toxicology tests revealed Anna had 300% the amount of the therapeutic dosage (or 6 tablespoons) in her system at time of death.

If the bottle of Chloral Hydrate had never been found, the test for the sleeping aid never would have been conducted, thereby leaving the Anna's Cause of Death as "Natural."

Last September, a Bahamian coroner conducted an autopsy on Daniel's remains. Because the sudden death of a 20-year-old is automatically labeled as "suspicious," the coroner related as much in a statement to the press and that she, acting as Magistrate, would be holding an Inquest into Daniel's death in October.

In the Bahamas, the coroner is also a Magistrate. It is the Magistrate's duty to preside over all Inquest hearings. She slated the Inquest for October.

Anna's attorney, upon hearing the Bahamian coroner's assertion that Daniel's death was "suspicious," lambasted the coroner's statement, claiming that, because the Bahamian coroner was not an investigator, she had acted beyond her scope as coroner and had no business releasing such an inflammatory statement.

The chief magistrate removed the coroner from Daniel's case. It would now be up to the chief magistrate as to whether an Inquest would be held at all. He also saw to it that the coroner's autopsy findings remained sealed.

Dr. Cyril Wecht, known in some circles as "coroner for hire" and "coroner to the stars," was hired by Anna Nicole to conduct an independent autopsy on her son. His findings revealed that Daniel died from a lethal combination of three drugs found in his system: Lexipro, Zoloft (both anti-depressants) and methadone (a pain killer). Wecht reported that the concentration of all three drugs was at low levels.

Perhaps due to the tremendous media focus and public outcry in the Bahamas, the chief magistrate decided to go forward with an Inquest into Daniel's death. Moreover, the chief magistrate said he would preside over the Inquest himself. The Inquest was to begin last week.

The autopsy results from Daniel's original autopsy have yet to be made public. However, rumors have surfaced alleging that the amount of methadone that Dr. Wecht reported in Daniel's system was profoundly under reported. Dr. Wecht vehemently denies the rumors, calling them "utterly ridiculous" and the result of "media speculation spun out of control."

Additionally, Dr. Wecht's findings failed to note the presence of several other drugs that were supposedly noted in the original autopsy report. The contents of the original report are rumored to be revealed at Daniel's Inquest

When Dr. Wecht was asked on a recent talk show what he thought about Vergie Arthur's wish to have Daniel's remains exhumed for further study, Dr. Wecht lost his cool. Ms. Arthur, Anna Nicole's mother, has suggested that a better explanation for her grandson's death would shed a new light on the investigation.

Dr. Wecht's position as an independent medical examiner would ordinarily afford him the inherent reputation of a disinterested party. However, his overt verbal attacks of Ms. Arthur on television appear to undermine that reputation. Rather than displaying the impartiality of a doctor, he has managed to paint himself as a man who is deeply and personally involved in the case and incapable of divorcing his emotional state of being from that of an academician embedded in scientific fact.

Apart from the facts that Dr. Wecht has dozens of indictments hovering over his head and was forced to leave his state job under the cloud of ethics violations, media outlets continue to hire him to offer his expert opinions. As if Dr. Wecht's scholarly reputation could possibly undergo further damage, his outbursts and apparent collusory ties to those that hired him appear to have ruined any chance he might have had of portraying himself as a credible consultant.

Consequently, the reliability Dr. Wecht's results from Daniel's autopsy report has been cast under a new and doubtful cloud. Renewed interest into whether a possible cover-up has occurred may prompt the exhumation of Daniel's remains to determine if, indeed, Dr. Wecht's findings are accurate and complete.

Anna Nicole's remains would not have yielded the chloral hydrate in her system if the bottle had not been found on the scene of her death. Dr. Wecht did not test Daniel's tissue for the presence of chloral hydrate. Dr. Wecht tested for and discovered traces of the drugs that were found in the hospital room where he died.

483. 18697. Also found this is one of my files. Sorry I don’t have a direct link or date. Back when this first started I had no idea it would take on a life of it’s own and didn’t think to get links and dates.


RALE: Actually, I`m even toning that down tonight because, you know, we are trying -- you know, Howard has been reaching out, and we`re hopeful that this thing can be settled without lawyers involved. You`ve got to remember, this thing started up in Los Angeles back in October of `06, and Howard wasn`t a party. Howard`s never been a party to the LA case. When Anna passed away and we were suddenly in Florida, they filed a proceeding there, trying to get DNA from Dannielynn. And I think that`s the first time that somebody tried to name Howard. I`m still not even sure about that right now because we`ve got three jurisdictions going on.

But in the Bahamas now, they`re seeking the DNA from Howard. But Howard`s never been an issue. For Larry Birkhead to determine paternity, we need his DNA and Dannielynn`s DNA. It`s never been an issue of Howard. So it hasn`t been Howard refusing, they never asked. So...

GRACE: OK, my question is, Howard Stern has the baby. Has the baby been tested? Has she had an oral swab done?

RALE: My understanding is, you know, we don`t have any DNA testing that has gone on. The only DNA...

GRACE: So no. OK.

RALE: Right.

GRACE: Here`s the question, the original question. Why won`t Howard Stern allow the test on the baby?

RALE: You know, that -- I can answer that again. And that goes back to the LA case. Remember, we were set to do -- it wasn`t Howard allowing it, Anna Nicole was going to have...

GRACE: He has the baby now.

RALE: We`re talking about -- you`re just talking recent history. I`m going back all the way to October. We were set to do the DNA test through the LA Court, and Anna was going to provide that on January 23. And as you know, who stopped it? The guy sitting right here. Anna was perfectly willing to do it. And I went to court and got a stay of that because we had some very serious procedural problems.
I`d ask Ron Rale a question, if I could, about January 23. A, did he tell not her not to go through with it on the 23rd? And B, I know for a fact that Anna Nicole Smith texted Larry Birkhead and said, There`s no way in hell that I`m going to go through with this test. Is that not true, Ron?

GRACE: Ron, true or not?

RALE: Yes, and I`m answering it. Look at the date of that text, and that`s the same time that I told her she`s not going through with the test. Yes, I am the one who stopped it. Absolutely.

GRACE: Why?

RALE: It might take a few minutes to explain, but...

GRACE: Go ahead.

RALE: OK. Number one, they failed to register the order, the California order in the Bahamas. Same thing like when they went to Florida, when they tried to get the DNA for Dannielynn in Florida. They tried to register the California order, which they did. They just weren`t allowed to get the DNA. They didn`t do that in the Bahamas. You know, just because, like, for example, you get a judgment against somebody in Arizona from California, can you go walk in there and take their safe deposit box? No, you`ve got to go through the proper route.

Moe recounted the horrible moment he first saw Smith's body in Room 607 at the Hard Rock Hotel and Casino in Hollywood, Fla. He straddled her in a desperate attempt to revive her, shouting, "Please, come back . . . Dannielynn needs you."

Ten minutes earlier, he had received an anxious phone call from his wife - a nurse, but not Smith's private nurse, as was widely reported. She had agreed to stay with Smith while boyfriend Howard K. Stern was away arranging to take ownership of a boat and Moe was out running an errand.

"Her being a nurse, she knows what to do if [Smith] needed some water or help going to the restroom," Moe told "ET" and "The Insider."
But, he said, his wife called and told him: "Something's not right. It doesn't seem like she's breathing. I'm doing CPR."
Moe rushed to the hotel, alerting Stern along the way by phone.
Stern's response was, "What? What? What?"
Entering the hotel room, Moe saw his wife on top of Smith pounding away at her chest.
"I looked at [Smith's] lips. They didn't look right. Then I looked at her eyes and saw they were, like, fixed and dilated," said Moe, a trained paramedic.
Moe said he slapped her on the face and told her to wake up. He checked her airways, gave her breaths of air and felt for a pulse - but there was none.
"I picked her up and put her on the floor, a hard surface . . . to get good CPR techniques . . . and then started giving her rescue breaths," he said in the interview, which airs tomorrow and Tuesday.
"I was talking to her, saying: If you got anything in you, baby girl, please come back. We all need you. Dannielynn needs you."

Stern entered the room and went "out of control" when he saw Smith. He was on the floor, inconsolable, Moe said.
Ten minutes passed before EMTs arrived, he said.
"My personal opinion. I thought she was gone . . . even though I was denying it to myself. I knew she had gone because of what I do for a living. I'd seen dead bodies, and I know the signs," he said.

485. 18810. I just did a Google search and, according to E! News OnLine, the Cipro WAS PRESCRIBED on February 2, 2007 to Alex Katz. It WAS FILLED on February 5, 2007 at Walgreen's in Hollywood, Florida.

It seems odd, if this information is correct, that the antibiotic (Cipro) for the abcess or infection would have been prescribed from the Bahamas in advance of the need by Eroshevich! Allegedly, Anna felt better after having the flu-like symptoms, had taken a dancing lesson and was well enough to travel. It was'nt until the plane trip that she began complaining of pain in her buttock.

It has taken me forever to figure out the Lorazepam in Anna's system and I have finally found out that the Lorazepam 22.0 ng/mL is just a little over therapeutic...

if she was given therapeutic 2 mgs on hour before she died!

Lorazepam is quick acting and quick to metabolize and leave the body.

The mean half-life of unconjugated lorazepam in human plasma is about 12 hours and for its major metabolite, lorazepam glucuronide, about 18 hours.


All of this means that Anna WAS given Lorazepam very close to the time she died.

Anna's prescription was for injectable Lorazepam! No Bottle of Lorazepam! No injection needle!

Nice point of testimony disagreement. Moe is just filled with 1 + 1 = 5, isn't he? He does not seem aware of the statements and doc.s others have submitted. Here, the hospital records do not indicate HKS EVER setting foot in the hospital. Same as the ambulance forms do not indicate he was in the ambulance; to the contrary, they indicate he was NOT on that ride.

2. Could it be the prescription was called into Florida because a) could not get ANS to her own doctor on the weekend, and b) Dr. E could not write a script in the Bahamas so Dr. E called into Florida? (Better, perhaps it was meant for Dr. Katz to pick this up...)

POTTS: People around him feel that he`s created this house of cards. He moved Anna Nicole, the corporation, offshore, the way a company would go offshore to the Bahamas, to be able to be outside the rule of the U.S. law, which has proven the case here.

I also hear from people inside and around that situation that Moe is now willing to talk. He knows more than he has said. He has not lied -- I want to make that clear -- but he has not explained everything, all the details that he knows.

And I can tell you for a fact that he knows a lot more, and bodyguards always do. The question is, is he saying this now, because he feels at some point down the road he will be in front of a judge and he will have to, under oath...

GRACE: Wait. Is he saying -- what now? What do you mean he knows a lot? You know for a fact he knows more than he is revealing, what do you mean?

POTTS: Absolutely. I know that he`s talking about that there was a bottle, a baby bottle close by on top of Anna Nicole on the sheets. And there are other things that he knows that he`s willing to talk about. And we just have to -- we`re all working to try to get to Moe to talk about those things.

But I think Moe is an honest guy. I think Moe is trying to do the right thing. I think now he realizes that he better say what`s right, and say what`s real, and say what he knows, because at some point he will be under oath, Nancy.

IF YOU worked in health care you would know when a patient is a suspected addict, you do not give their drug of choice or any mood altering substance after a death loss. One anti anxiety would have been sufficient, not 5 different ones.

Any health care professional knows never to mix Benadryl with an anti anxiety drug. The mixture of those combination of drugs indicate to me a planned event.

The fact that Howard Stern had them prescribed to him and then gave them to Anna is a felony in Florida. He will be arrested on that if nothing else. They have a team that does nothing but investigate those cases. I admit it is very slow arresting the perp many times, but they are always arrested and charged.

Their statements and the prescriptions alone are enough for indictments, but most likely they are waiting to combine other charges with the indictments.

The Federal and State Grand Jury witnesses lists are sealed, and if
a respondent testifies before a state or federal grand jury , they are warned that if they reveal their testimony in any manner, they will be subject to criminal prosecution under Fla. Stat. 905.27, which prohibits, inter alios, a witness from ever disclosing testimony given before a grand jury.

With everyone wondering why all of a sudden there is complete silence from all the witnesses, you might consider the statement above.
