Judge Lawrence Korda has decided to weed himself out of the Broward County courts, announcing his early retirement from the bench. Righteous, Your Honor.

Korda, who heard arguments in the Anna Nicole Smith case, made a hash of things when he was arrested in March for allegedly firing up a doobie in the park -- and then pleaded not guilty -- to toking-up in the city park. The South Florida Sun-Sentinel reports that Korda's reeferiffic exploits sparked an official inquiry, which he avoided -- talk about harshing your mellow! -- by stepping down yesterday. Korda, according to his lawyer, was considering retirement anyway.

Hizzoner will be ganja for good on July 2.

Anna Nicole Smith almost missed being the star of her own labour video when boyfriend Howard K Stern forgot to pick up the camcorder on the way to the hospital.

Stern took the former model to Doctors Hospital in the Bahamas when Smith started complaining of a chronic migraine early in September (06) but when she arrived there, nurses told the couple she had gone into labour.

Desperate to capture the birth of baby Dannielynn, Smith ordered Stern to go back and pick up the camera and instructed doctors to try and hold off labour until he returned.

Stern recalls, “I drove back, I don’t even wanna say what the speed limits were… and when I got back (to the hospital) they said that she was in recovery, so I thought I’d missed the whole thing and then they said, ‘No, we’re preparing her.’”

The amazing birthing footage aired exclusively on US news shows Entertainment Tonight and The Insider last night (06NOV06), and shows just how painful the experience was for Smith, who cried out “Oh God” throughout the labour.

She recalls, “I had an epidural but it did not kick in so I felt everything and it was freaky… I actually thought I was dying. It felt like God and Jesus were, like, ripping my insides out of my body and, like, the devil was, like, yanking my insides from my legs and they were playing tug of war.”

The footage also featured the new mum’s request for the caesarian incision to be made above her pelvic tattoo but as low as possible, so she could still “wear a bikini.”

Anna Nicole Smith has become an election-season liability for the Bahamian government, which has had to defend its decision to grant her permanent residency while the former reality TV star fights eviction from a posh waterfront mansion.

Miss Smith’s quick path to Bahamian residency and the high priority given to an investigation into her son’s mysterious death are eclipsing the economy and other issues as the island chain prepares for general elections next year.

The former Playboy playmate moved to the Bahamas in July and gave birth to a daughter in September with little public fanfare. That changed when her 20-year-old son, Daniel, died while visiting his mother at the hospital three days after the baby was born. A private examiner concluded Mr. Smith died from a lethal combination of methadone and antidepressants.

Miss Smith has since dominated local press coverage and political discussion in the archipelago southeast of Florida.

Charges of special treatment surfaced after the head coroner scheduled an inquest three days after Mr. Smith’s death, despite a backlog of requests for inquests into the deaths of ordinary, non-celebrity Bahamians. The outcry prompted officials to reassign the head coroner, and the formal inquest still has not been held.

Opposition lawmakers, meanwhile, have called for the resignation of Immigration Minister Shane Gibson, who approved Miss Smith’s residency application based on her claim of ownership of a waterfront mansion. Now it turns out the mansion might not be hers after all.

“She’s had a tremendous impact on our politics, and she’s not going away and the scandal isn’t going away,” said Arthur Foulkes, a newspaper columnist and former Cabinet minister.

Mr. Gibson personally processed Miss Smith’s residency request, but denies opposition claim that he went to the mansion to collect the $10,000 application fee.

“No check was ever personally collected by me … in connection with Ms. Anna Nicole Smith,” Mr. Gibson insisted. “Anything to the contrary is a vicious lie conceived in ignorance and spread in wickedness.”

Prime Minister Perry Christie defended Mr. Gibson in September, denouncing the contention that the minister collected the check as “an outrageous lie.” But Mr. Christie has not commented publicly on the case since the ownership of the house was called into question.

Miss Smith claimed to own “Horizons,” a gated, waterfront mansion where she has remained largely secluded since her son’s death. But a South Carolina businessman has sued her, saying she failed to make payments on the nearly $1 million mortgage.

Mr. Gibson, fending off demands by the main opposition Free National Movement that he resign, told Parliament that any inaccuracies in her case should be blamed on the lawyers who prepared Miss Smith’s residency application.

Miss Smith’s Bahamian attorney, Wayne Munroe, said politics had blown the dispute out of proportion.

Mr. Christie is obligated to call elections next year. The ruling Progressive Liberal Party will be seeking its second consecutive five-year term in office.

Date Set For Constitutional Challenge To Coroners Act

On July 16, Supreme Court Justice John Lyons will hear arguments from representatives from the Office of the Attorney General and lawyers for Howard K. Stern in Mr. Stern’s Constitutional challenge to the Coroners Act.
Mr. Stern, the lawyer/lover of the late Bahamian permanent resident Anna Nicole Smith, is challenging the Coroners Act as unconstitutional because it doesn’t allow the coroner to question a coroner’s jury.

The inquest into the death of Ms. Smith’s 20-year-old son Daniel Wayne Smith has been on hold since Mr. Stern’s legal team raised the issue of wanting the coroner – in this instance Chief Magistrate Roger Gomez – to make the jury answer a questionnaire.

Mr. Stern’s lawyer, Wayne Munroe, said his client was concerned about the media coverage of the death of Ms. Smith in February, of Daniel’s own death in September 2006 and of the court battles over Ms. Smith’s infant daughter Dannielynn.

Mr. Stern, he said, may have been painted as the villain of the whole affair.

On May 22, the parties met before Justice Lyons for what Mr. Munroe called a "mention" hearing.

"The hearing of arguments is set for the 16th of July," Mr. Munroe told the Journal.

"Both interested parties will put their case. It is estimated to last half a day. It was simply the setting of a date (for arguments to be heard). Nothing was discussed; it was just the setting of a date."

Mr. Stern has challenged the constitutionality of the Coroners Act based on his contention that it contravenes the Constitutional promise of a fair trial before an "impartial" jury.

Since the Act does not allow coroners’ juries to be questioned, Mr. Stern contends that it is impossible to ascertain whether the seven-member jury empanelled in the Daniel Smith inquest is in fact impartial.

Therefore, he argues, the Act is unconstitutional, and he wants a direction from the Supreme Court, which exercises a supervisory function over the Magistrate’s Court (including the Coroners Court), allowing the coroner to compose a questionnaire in consultation with the lawyers for all interested parties.

The court would then allow the lawyers for interested parties to question the jurors based on the answers they give to the questionnaire.

The Crown has opposed this move, as it is outside the ambit of the Coroner’s powers as outlined in the Act.

Daniel Smith died suddenly at Doctors Hospital on September 10, 2006, while visiting his mother and newborn half sister three days after she was born. His death was ruled an accidental drug overdose, and the inquest was called to "answer any unanswered questions," according to Chief Magistrate Gomez.

The inquest could resume in July, depending on the outcome of Mr. Stern’s Constitutional challenge.

It is expected to take months for the inquest to be completed, so it is likely that it will be nearly a year before a legal cause of death is definitively determined in the death of Daniel Smith.

49. Smith Sells Son's Photos to Pay for Funeral
Distraught former Playboy Playmate Anna Nicole Smith was forced to sell photos of her son Daniel taken the night before he died in order to pay for his funeral expenses.

The family portraits were taken in a hospital room in the Bahamas two days after the birth of Anna Nicole's daughter and hours before her 20-year-old son was found dead.

Photo agency Getty Images sold the photos to In Touch magazine for $400,000 after a fierce bidding war.

According to In Touch executive editor Dan Wakeford, "We purchased the photos, beating the competition.

"The photos were extremely emotive, and our readers are incredibly intrigued by this story."

Wakeford says the images show "a perfectly healthy young man."

While it is unclear what portion of the proceeds will go to Anna Nicole, a source tells Us Weekly that the devastated star sold the pictures in order to pay for her son's funeral.

The source says, "She needs the money."

Getty Images claims that a portion of the profits from the sale of the photos will go to a charitable foundation to be set up in Daniel's name.

His body remains at Butler's Funeral Home in the Bahamas and won't be released to the family until the investigation into his death is complete.

50. Anna Nicole's close friend, lawyer and confidante, HOWARD K. STERN, broke his silence Tuesday night on "LARRY KING Live" for the first time on TV following Daniel's sudden death.

In a bombshell interview, Stern claims that he is the proud father of Anna Nicole's baby girl, who he says is named DANNYLYNN HOPE (sic).

"Anna and I have been in a relationship, and we love each other, and it's been going a very long time," he told King. "[Due to the fact that I am her lawyer], we felt it was best to keep everything hidden."

When pressed by King whether or not he is the father of the child, Stern replied, "Yes sir. Proud father. Based on the timing of when the baby was born, there is no doubt on our minds."

Last week, photographer LARRY BIRKHEAD came forward to ET, claiming he is the father of Anna Nicole's child and is willing to take a paternity test. Stern acknowledged that he himself has not yet taken a paternity test, but he won't be doing Birkhead "any favors" and questioned the man's reasoning for the claim.

"First you have to look at what his motives are," said Stern. "It's unforgivable ... that he would go to the media and not wait for Daniel to be put to rest. If he truly felt he was the father, I think he would have handled it differently."

51. I have been doing some research for the Opri Birkhead Bar blog. I have articles showing, Larry Birkhead has a habit of entering into written, legally binding agreements then saying he never signed them. In fact he signed 3 non disclosures with Anna Nicole. But went on Larry King Live and said he never signed any.

One of them states that he signed an agreement with Stern, saying that he will be liable for 10 million dollars if he breaks the agreement.

I am wondering if any of you think that the reason Larry agrees to have Stern in his life and the babies life is simply because he does not want to pay the 10 million because he breeched agreement. Maybe Stern and Rale reminded Larry of this fact, and told him to go after Opri. So Larry gets to keep the baby and his 10 million....and Stern gets to pull the puppet strings from behind the curtain? Seems Larry would do anything for money these days.

Smith’s lawyer Howard K. Stern insists that before Birkhead started working for the model-actress, he had signed a confidentiality agreement with her that he would not talk to the media on the matter.

Birkhead, however, claims ignorance about signing any such agreement, though he contends that the potential financial penalty of appearing on TV news shows will be worth it if he wins the paternity battle.

"This is my child; it doesn’t matter what the penalty is… I’m just defending myself," Contactmusic quoted him as saying.

The "Agreement Not To Communicate With The Media" consent form was obtained by news show ‘Entertainment Tonight’ prior to Birkhead’s latest interview, telecast on Tuesday night.

It features Birkhead’s signature and initials and a handwritten addendum that states, "If I breach this agreement then I will pay a liquidated damages sum of ten million dollars, and any money received would revert back to Anna Nicole Smith as damages from any breach."

If Anna’s money all goes to Howard in the event of her death, then he gets an extra $10 million from his main rival for her money affections. Pretty Machiavellian, I must say, but I guess we’ll see as time goes by.

UPDATED: What are the legal ramifications of Anna Nicole’s death? Here’s one lawyer’s opinion:

This is assuming CA law controls which is really uncertain right now.
#1 If Anna died without a will, then everything would go to her daughter, UNLESS she and Howard K Stern were legally married.
#2 If she and Howard K Stern were married, and there was not a will, then one half of the estate would go to Howard and the other half to her daughter.
Here are some possible issues-
#1 If Howard believed he married Anna Nicole Smith, but in actuality did not, he could still be afforded the rights of what is known as a putative spouse.
#2 Inherited property is separate property which means that even if she was legally married, the money Anna was receiving from her deceased husband can all be left to her daughter if she provided for her daughter in the will.
#3 Mr. Birkhead is NOT entitled to any money even if he is the father, and would probably not be able to touch any of his daughter’s money except for Health, Education and Welfare. HEW would be her necessary expenses. In this kind of situation, that money will be tremendous and Mr. Birkhead will no doubt live large, but HE will not actually own anything.
#4 Even IF Mr. Birkhead is judged to be the father, he would not automatically gain custody of his daughter. The court would decide who would be the best parent of those who petition the court.
#5 Her son’s death should not have any effect on this proceeding.

#6 The money she is going to get from her deceased husband is still in litigation. The fact that her adversary in that proceeding is also dead will mean that it will be an estate vs estate battle.

How many and how much? That’s what people want to know about Anna Nicole Smith’s drug usage. That, and how it might affect her baby daughter, Dannielynn.

A fax obtained exclusively by this column may shed some light on the still mysterious death of the modern-day pin-up model who accomplished nothing so much as getting the most publicity possible for the fewest achievements.

The fax was written and sent by Khristine Eroshevich, Smith’s personal psychiatrist and, since her death, “best friend.”

It’s a request for a laundry list of drugs that Eroshevich wanted sent to the Bahamas by courier for “M. Chase,” the pseudonym Smith used to obtain drugs.

The list is scary and potentially very harmful. It includes: four bottles of 2 mg Dilaudid; 2 milliliter bottles of Lorazepam (Ativan); two bottles of 350 mg Soma, a total of 180 tablets; one bottle each of 30 mg Dalmane and 400 mg Prexige, the latter a British drug; and one bottle of methadone, 300 5mg tablets. All of them are classified as different types of painkillers.

Eroshevich was with Smith through her pregnancy in the Bahamas, the birth of her daughter and death of her son Daniel.

More recently, Eroshevich has been a regular on “Entertainment Tonight,” giving exclusive interviews about her former patient and sticking closely to the side of Howard K. Stern.

Eroshevich sent the fax on Sept. 15, 2006, a week after the baby was born and five days after Daniel’s death.

At first she sent it from the Bahamas to Sandeep Kapoor, the Los Angeles physician who treated Smith under the pseudonym “Michelle Chase.”

When Kapoor refused to fill the prescriptions, sources say, Eroshevich sent the request directly to Key Pharmacy in North Hollywood, Calif. It was also refused there.

The doctor wrote the fax in her own hand and added a note at the bottom: “You have my local number here. Please call if half of the amounts can be prepared, I’ll have someone take them to a courier to bring to me and he can [illegible] Fedex the rest, except for the Intensol, which has to be on ice.”

She signed it “Kris,” even though it seemed from the fax that she didn’t actually know Kapoor.

One pharmacist, to whom I read this list, noted that all the dosages requested were much higher than usual.

“That’s 12 times the amount of Dalmane. All together, these drugs potentially will kill you. I would have refused to fill the order.”

All of the drugs carry warnings for pregnant women and those who are breastfeeding especially not to take them.

The directions for Prexige read: “Tell your doctor if you are breast-feeding a baby. Ask your doctor about the risks and benefits of taking Prexige in this case. It is not known if lumiracoxib, the active ingredient of Prexige, passes into the breast milk and could affect your baby.”

In a brief conversation last night with Eroshevich, the psychiatrist acknowledged the existence of the fax, but declined to comment on it, citing "patient confidentiality."

Howard K. Stern destroys his reputation

Many in the media have suggested that Howard K. Stern was an “enabler” in terms of Anna Nicole Smith’s drug abuse. Others have speculated that he may have directly caused the death of Anna Nicole. But that charge is nothing compared to the damage that Stern has done to his own reputation by hiring attorney Lin Wood - a man who has made a legal career out of filing frivoulous defamation lawsuits.

Memo to Stern: If you actually care what the media says about you, then simply make yourself accessible to outlets other than Entertainment Tonight and tell the truth to the best of your recollection. Hiring Wood indicates that you have a lot to hide and that you are determined to try and bully the media into silence and submission.

This is my favorite part of Wood’s statement (I can’t help but chuckle every time I read it):

To those considering making future false accusations against Mr. Stern, please consider the following advice: don’t do it. You are not immune from suit if you are not a member of the traditional media. Redress for false attacks on reputation is available for Internet accusations as well as those published in print or uttered on television and radio broadcasts.

And to those who believe that Mr. Stern is hesitant to bring suit and thereby open up his life on cross examination during the discovery process, you are wrong. Mr. Stern has nothing to hide and he correctly views civil litigation not only as the forum for obtaining accountability for wrongdoing, but also as a forum for the public to learn the truth.

Why chose a courthouse as a “forum for the public to learn the truth” when you have unprecedented access to the media (in both traditional and new forms)? I don’t believe that Stern caused the death of Anna Nicole. But given his status as a public figure, his incessant need to be around Anna Nicole, and the fact that some of the prescription medications were reportedly in Stern’s name, it is not unreasonable for people to speculate about Stern’s role in recent events.

It is similar to the Jon-Bennet Ramsey situation. I ultimately don’t believe that the Ramsey’s had anything to do with their daughter’s death - but I think it is perfectly reasonable for people to speculate about what may have happened. Wood also represented the Ramseys in their attempts to browbeat the media. The way the Ramseys reacted to the media speculation and investigation ultimately did more to harm their reputations - not less. (It goes without saying that this same dynamic also applied to Wood’s client Gary Condit in relation to the death of Chandra Levy.)

The forum to redress unfounded speculation is the public sphere - not a courtroom. In a world with the blogosphere and unprecedented access to mass communication for the masses, the reckless gossip does more harm to his or her own reputation, rather than the target of their speculation.

So says I. So endeth the sermon.

Daniel Smith, 20, died Sept. 10 in the Bahamian hospital where his mother had given birth four days earlier. Both a private autopsy as well as an autopsy ordered by Bahamas officials had indicated the young man died as a result of a fatal mixture of three prescription drugs.

But Court TV correspondent Michel Bryant has learned from a source connected to the official investigation that there was also evidence of four additional drugs, causing a lethal combination.

Toxicology reports now being reviewed by Bahamian law enforcement showed the drugs to be eight times the lethal dose, although the results of this review have not been released, Bryant's source said.

It's being revealed that Anna Nicole Smith's son Daniel's autopsy shows he had up to 7 different drugs in his system at his time of death, with three of them causing a lethal combination. It's also being revealed that he had eight times the lethal dose of the drugs in his system, which means he was either really bad at following his prescription or we've got another mystery on our hands.

57. On February 8, 2007, Dr. Wecht said on Fox News that there was still no information available as to how Daniel obtained methadone. Although methadone is prescribed in place of other opioids for pain relief and is used in the treatment of heroin and morphine addiction, Wecht had said he had no information to make any conclusion about why Daniel was using it. On February 14, it was reported that his mother Anna Nicole Smith had been given a prescription for methadone under a false name while she was in her eighth month of pregnancy.

The senior police officer remained cryptic as to what precisely the officers were investigating, but said that the investigation was wide-ranging.

Asked specifically about the allegations that Ms. Smith’s California doctor had mailed her methadone, Mr. Hanna confirmed that it is illegal to either import or export that particular drug into or out of The Bahamas.

"Anyone who seeks to send them to this country or to export them from this country has committed a criminal offence, but again, these matters have to be properly and thoroughly investigated," he said.

"Let me say that everything that has come to our attention, that we have concluded is worthy of our investigation, we have looked at everything and we continue to look at everything.

60. Prescriptions for controlled substances, such as methadone, or ANY opiate narcotic, cannot be faxed or called in. You must have the actual prescription in order to fill it.

Unless you're a physician who is LICENSED TO PRACTICE MEDICINE IN THE BAHAMAS, you CANNOT prescribe in the Bahamas.

Methadone is an illegal drug in the Bahamas and is not offered for heroin withdrawal.
