76. . I was playing the E special on Anna Niole Smith becuse I wanted to listen again to what Bridget Niven said ehen she found Anna, I also wanted to review Taz comments about that moment. Something clicked on my mind, it has to do with the phone call that Moe made to Taz to check on Anna. Moe said that he called her and she said that Anna was ok, that she was resting and that A few minutes later Taz called him saying "something is wrong with Anna, she is not breathing, she is not responsive "

This is the scenario that was presented by Bridget during the E special :
" Taz was on the phone, I thought it was Anna talking, I walked into the room, I said to Taz , ..Anna is up ..... Taz said....No, Anna is sleepimg, let her rest." Bridget continues, " I looked at Anna, her body wasn't moving , like when you are sleeping you are breathing, the body moves......I walked to the other side or the bed I saw Anna;s face, her mouth was opened, I try to close it, it didn't close, I said Taz,, look at Anna, Taz said, 'leave Anna alone... I said no, come over here, something is wrong with Anna, "

Moe said that he called Taz to check on Anna, that's when Bridget overhear her talking and she thought that Anna has woken up, when Bridget walked into the room, Taz told her that Anna was sleeping, to let her rest, when Bridget walked around to the other side of the bed and found that something was wrong with Anna , Taz told her to leave Anna alone, only because of Bridget 's insistence she moved from the chair where she was seating to see what Bridget was talking about., when she found Anna's lifeless body, she didn't panic, she didn't dial 911, she called Moe in stead, This not the normal reaction.
Bridget, on this video, looked genuinely upsep, she look sincere, her eyes are very telling of how traumatic this experience has been for her, even though she wasn't overly emotional.
Taz on the other hand sounded to me asif she was reciting an script, her eyes got a little watery by the end, but to me she looked more scared than sad.
I think that Bridget stumble into something by accident, It might had changed the entire plan.
If Anna was so sick, why wasn't Taz really checking on her, after all Taz is a nurse, I beliave her job was to watch over Anna, what was her doing ? Guarding Anna's "body ? ".

The metabolism of lorazepam by man and four other species is reviewed. Lorazepam and its metabolites in blood, urine and faeces were identified by thin-layer and gas chromatography and by mass spectrometry. The principal metabolite in man, dog, pig and cat is the glucuronide, but the rat produces other metabolites after small doses of lorazepam, and significant amounts of the glucuronide only after high doses. Since all metabolites, except the glucuronide, occur in small quantities only in man, most studies in man have been confined to an estimation of free and conjugated lorazepam. Blood concentrations of unconjugated lorazepam peak at 1–4 h, significant concentrations persisting for 24 h and decreasing slowly over the next 24 h. About 95% of a dose of lorazepam was accounted for in urine and faeces over a period of 5 days; 74.5% was excreted in the urine as lorazepam glucuronide and 13.5% as minor metabolites. The excretory half-life was 12 h. The blood concentrations and excretion rates are compatible with the clinical effects of lorazepam.

My medical knowledge is very limited. But, I can tell the Lorazepam is over theraputic limits and that it had not metabolized into glucorinide. If she had taken it much earlier she would have been in a coma like state because her concentration would be high and she would have the metabolite in her system

And wanted to "pimped" Daniel's death - to promote the movie
He claimed that it was Anna's wishes (boy, I'm sick of that term)
This is at the same time that we now know that Anna had to be heavily sedated
removed from the hospital and according to Howard and lawyers "had no recollection of what happened"
Oh but she wanted Howard to call the "executive producer" of the film and make sure that they promoted it "using Daniel's death".

JAMES: Larry, I was down visiting Anna with my family here just 10 days ago in Nassau, before the kids went back to school. And we -- I had been on an emotional rollercoaster ride and been whip sawed around from finding out that she had the baby on Friday to an emotional Howard K. Stern calling us on Sunday and my wife crying in the kitchen.

So I can just only imagine -- and by the way, we forgot to mention this, that Howard called to tell us that on Sunday and also that Anna wanted the movie to be in Daniel's memory, to be that dedicated to Daniel. And we heard that on Sunday. So I just can't imagine what she's going through because my wife is very, very devastated as well.

between 12-1:00 p.m. She was found in bed at 1:00 p.m. unresponsive. CPR

registered nurse and later resuscitation efforts by Big Mo and medics were
also unsuccessful and Miss Smith was pronounced deceased at 2:49 p.m. at
Hollywood Memorial Regional Hospital.

helped to bed around 9:00 a.m. by Mr. Stern. At about 11:00 a.m. or 11:15 a.m., Mr. Stern spoke
with the decedent and informed her that he was picking up guests from the airport. At around
12:00 p.m., approximately, the guests arrived at the suite and did not awaken Miss Smith,
assuming she was still sleeping.
Detective Marian Bryant informed me that the party picked up from the airport consisted of a
Bahamian official “King Eric”, his wife and a crewmember of a boat recently purchased by Miss
Smith. They were in Florida to take the vessel and sail back to the Bahamas on Thursday.
At around noon, Mr. Stern and the male guests left for Miami to check on the boat.
Concurrently, Mr. Brighthaupt left to help his brother move furniture. Miss Smith was left with
King Eric’s common-law wife Brigitte Nelsen and Tasma Brighthaupt, Maurice’s wife,

TONY POTTS: Real quick, back to the timeline. I went to the marina where Howard was the day that he arrived for that boat. He was there slightly before 1:00 o`clock. Todd Smith (ph), who is the guy who was going to check out the boat with him, arrived about three minutes afterwards, and they talked for about five to ten minutes, which at that time, Todd Smith tells me that Howard received a phone call, which if you push it -- just pad it, say 1:15 -- at that time, Howard -- I said, What happened? Howard got in that town car.

So I got in a town car. I did the drive from the marina to the Hard Rock hotel there. It`s about a little over five miles, but it takes about 20 minutes. So that would arrive from 1:15 to 1:35.

My question to Ron Rale or anybody else who can answer this -- and I`ve been on this the whole time because the timeline is very critical here -- what happened in the 23 minutes between 1:15 and 1:38, when the first 911 call came in? Who was Howard calling? Who called Howard at 1:15? Who did Howard call in the car?

I mean, you`d imagine, if it`s your loved one, you would be calling somebody at some point. I would tend to think down the road from sources that I know that those phone records of Mr. Todd Smith, who was there with Howard, and also Howard K. Stern -- those phone records will be subpoenaed and they`ll be looked at to see who called whom at the time. And that may help this timeline that you see up on the screen now.

Moe gets a call at 1:30. And then at 1:38, it says that he calls Mr. Stern. I would like to understand what happened to those 23 minutes between 1:15 and 1:38. Even if you give an extra five minutes, say it`s 1:20, what happens in the 18 minutes? What happened -- and why did the boat -- why did the boat they were purchasing have to leave Florida that night, or Friday morning? Because it was seen Friday evening in the Bahamas. I would like to know.

O`NEIL: I spoke last week with Daniel`s godmother, Jackie Hatten (ph), who says that according to her sources in the Bahamas, there were three additional drugs in Daniel`s system that were not part of Cyril Wecht`s toxicology report, and that the methadone levels -- this is the most staggering number we`ve ever heard -- were 20 times the reported level...

DIMOND: My!

O`NEIL: ... from the first toxicology report. And this is where the great mystery is. How much methadone was there really in there? "People" magazine has reported eight times. The tabloids here and the newspapers in the Bahamas have reported 10 times.

And of course, everybody points the finger at Howard Stern because we know that from the testimony of Ray Martino (ph), at least with second-hand sources, he`s the one who got Daniel to the airport and packed his knapsack. He didn`t have drugs on him. Ray, I have heard from my sources, did give him Valium. But yet that wasn`t found in his system. So you have to ask yourself, were those the pills that fell -- that were in his Jeans pocket that Howard flushed down the toilet?

O`NEIL: This mystery is fascinating!

DIMOND: There are so many characters here. And you know, Tom, to me, one of the most interesting and unsubstantiated things this man, Harding, the private detective in LA that Daniel went to and unburdened himself, so to speak. Let`s hear what he has to say, and then I have a question for you

Livor mortis or postmortem lividity (Latin: livor—bluish color, mortis—of death), one of the signs of death, is a settling of the blood in the lower (dependent) portion of the body, causing a purplish red discoloration of the skin: when the heart is no longer agitating the blood, heavy red blood cells sink through the serum by action of gravity. This discoloration does not occur in the areas of the body that are in contact with the ground or another object, as the capillaries are compressed.

Coroners can use the presence or absence of livor mortis as a means of determining an approximate time of death. The presence of livor mortis is an indication not to start CPR, or to stop it if it is in progress. It can also be used by forensic investigators to determine whether or not a body has been moved (for instance, if the body is found lying face down but the pooling is present on its back, investigators can determine that the body was originally positioned face up).

Livor mortis starts 20 minutes to 3 hours after death and is congealed in the capillaries in 4 to 5 hours. Maximum lividity occurs within 6-12 hours.

DOES HOWARD K. STERN'S BODY LANGUAGE SAY THAT HE MAY HAVE CONTRIBUTED TO ANNA NICHOLE'S DEATH?

I was asked to analyze the body language of Howard K. Stern during his interview with ET when he was flying to the Bahamas. It was most revealing To me it seemed that his tears were crocodile tears. To me it seemed like there was no facial emotion associated with those tears.

He NEVER once looked at his interviewer Mark Steinetz when he was asked questions. He consistently looked down as though he had a paper with notes on them . He was completely disconnected. He looked as though he may be guilty about something—like perhaps doling out too many drugs to her and enabling her drug addict behavior and thereby contributing in a huge way, if not causing, her premature death.

The one thing he said that literally made the hairs on the back of my neck stand up was when he said “I WANT HER TO BE WITH DANNY” He did not say as most people would, “I HOPE SHE IS WITH DANNY” Instead he said "I WANT HER TO BE WITH DANNY”

This arises many questions. Did he WANT her to be with Danny and therefore perhaps kill her by giving her an overdose of drugs so that she could actually be with Danny? In his mind was he committing a compassionate act for Anna? Or was it a self serving evil act?Only Howard knows that for sure.

Since he was so manipulative and controlling in every aspect of her life, including how much drugs she took,as referenced in various interviews on television by people who evidently saw him dole out drugs to her, Anna was now at his mercy. During her not too often lucid moments when she was not drugged out, she perhaps may have had the wherewithall to remember what she was witnessed to have said that day Danny died and couldn’t be revived. She was overheard saying to Howard "THIS HAPPENED BECAUSE OF YOU! IT IS YOUR FAULT!"

Is this perhaps why Howard encouraged her drug use to keep her silent and submissive and to never again bring up what she was overheard as saying in the hospital room when she found Danny dead? Was his aim to silence her by providing her with just one too many pills so she would be silenced forever? Only Howard knows the answer to this question.

Also where in the world was Howard when Anna was so ill? Why wasn’t a physician called? Why was a nurse there? Who is this nurse and why was she hired? Did Howard hire this nurse to diffuse any link to him regarding Anna’s death? After all the nurse was there-- not Howard when Anna Nichole died.It seems ironic ince Howard was always seen hoovering around Anna and never leaving her side.

Howard was completing his transaction for a yacht purchase when Anna Nichole died! Why would anyone leave a woman whom he supposedly loved who was running a life threatening high fever days earler?,

Howard professes his love for Anna Nichole on the ET interview but as a body language and voice expert,and as a communication psychologist, I am not buying it !I don' believe that he loved Anna Nichole. I do believe that he loved the excitement of her life—the whirlwind of the parties she attended to which he tagged along , the coming off as Mr. Bigshot—“Anna Nichole’s—manager/ lawyer”. He loved that role because it gave him power he didn’t have. I have seen this all too often in my private practice where managers often feel like they are the stars and try to dominate the real star’s life. While everyone wanted Nichole for photo shoots, tv shows, films,and commercials, they all had to go through her “manager/ attorney” which made him feel like he was the real star. After all, without him, Anna couldn’t do any of these things he thought. Finally I believe loved her millions she was about to get from her husband the late Howard Marshall’s estate.

A man who really loves a woman does not leave her in the hands of a nurse when the person is so ill that they require a nurses assistance. He gets a doctor immediately! He takes her to a hospital. When a man loves a woman he doesn’t sedate her and enable her to continue self destructive behavior. When a man really loves a woman he doesn’t try to keep her away from others like Howard apparently did. In fact a best friend of Anna's said that she couldn't get near Anna since Howard came on the picture.

Because Howard was in total control of Anna Nichole, he definitely had her ear but definitely did NOT have her back, so to speak.
He just had his own back! Did he dole out a little too many drugs to Daniel as well? Why would an otherwise healthy boy be taking methadone? Were they his mother’s pills that Howard was dolling out to him? Was Howard trying to get rid of him now that Danilynn was born so that he could his stake claim to Anna’s upcoming multi-millions by registering as the “father” of the baby? Did he know full well that he wasn’t the father? Did he think that with Danny in the picture as well as a new baby, there would be even less time for him? Was this a motivation in perhaps doing away with Daniel? I am not accusing Howard but these questions concern me.

Another thing that bothers me is that why did he and Anna Nichole go to the Bahamas in the first place? It certainly wasn’t to get away from the press! In fact they filmed the baby’s birth and sold it to the press immediately. They even sickly invited the press to film their bogus “wedding ceremony” where an incoherent Anna Nichole jumps off he boat into the water. She did not appear to be coherent and may have possibly been on drugs at the time as most people would not jump into the ocean fully clothed and act the way she did especially after just losing their child.

Was it perhaps Howard's plan all along to do away with Daniel? Who knows? Was it perhaps why he insisted that Anna Nichole come to the Bahams to have the baby? Did he perhaps believe that no one would investigate him in the Bahamas or that Bahamians were not as sophisticated and would never discover what he may have possibly done?

Also when Anna was grieving when she talked about Danny, she was breaking down in sobs and was emotionally overcome with grief. Howard just sat there emotionless. To me, that appears to be another body language hint that makes me think that there is a lot more than meets the eye that is going on with Howard-especially emotionally.

Another thing I find strange is the fact that Howard won’t submit himself to a paternity test. Why not? If anyone is sure that they are the father they would gladly oblige so that they could be done with all of the speculation and focus their energy on caring for their child. But not Howard.! Is that because he is clearly NOT the father? This little baby in no way resembles Howard? To me the baby looks more like Larry Birkhold. Whomever the father is-it seems to me that it is not Howard's. He acts too evasive.

Another point which I found very chilling after watching the ET interview was that when he was crying what I believe to be his alligator tears, one of the producers came up to him and hugged him. If someone was truly that distraught they would have responded and clung on to the person and responded to their tactile kindness no matter if they were male or female. Howard did not do that. He was pulling away as if to say—" look get away from me . I’m not really that upset."

The only thing that Howard may seem upset about is that his master plan to legally marry Anna Nichole fell through. He perhaps thought that he could keep her sedated and messed up just long enough for her to say "I DO" and then he would have TOTAL control not only of her but of her multi millions and TOTAL control of the baby!

But it all backfired on him. She couldn’t hang on to life that long. She checked out earlier than he anticipated. Even the policemen and the firemen on the scene possibly knew that something was suspicious with Howard when he fell to his knees and wailed. They did not even comfort him. That is what policemen and firemen are trained to do—comfort people during times of extreme emotional distress. Instead they left him alone and just watched what they may have felt was his charade. They just waited until he finished with his seeming theatrics so that they could proceed and ask him questions. Evidently, they too must have read Howard's body language that something was just not right as far as what happened to Anna Nichole and his possible involvement.

Now about Howard and his new cash cow- Dannilynn. With Daniel gone,and Anna Nichole gone, little baby Dannilynn is the billion dollar baby. Howard says he is the father. After all it says so on the birth certificate. He is also the executor of Anna’s estate. So now, he has control over everything.
But he did not anticipate that Larry Birkhold would be such a tough opponent doing all that he can to get to the bottom of this paternity issue.
Most of us do NOT want to even consider what I am going to bring up next because it is unconscionable to even think about. It is revolting and nauseating. In our society things like this are considered taboo! But here goes---What if Howard is not the father? What if Larry Birkhold is not the father? What if Howard Marshall’s sperm is not the sperm that fathered Dannilynn? What if Za Za Gabor's husband is not the father? What if everyone else who claims to be the father is not the father? What IF the father was her own son, Daniel Smith? I know it sounds like a horrible thought but it may be possible.

Because Anna Nichole was so consistenly drugged out and because her son evidently was as well, perhaps the two of them, not being totally conscious of what they were really doing, ended up having sex which ended up creating Danilynn. Whether we want to admit it, it is a possibility. Recent video has surfaced of each of them being totally out of control and disoriented. Anything can happen when people are in this state. All mores and what is socially acceptable flys out the window. It is just something to consider.

Is this perhaps why Anna Nichole was so desperate to pin the paternity on her friend whom she said “gave” her the house in the Bahamas? However ,her plan or perhaps Howard’s plan backfired when they found out this man- Mr. Thompson had a vasectomy and couldn’t father any child.
Was this perhaps Howard's reasoning in his desperation, for providing Daniel too many “feel good” pills to possibly get rid of him in case Daniel’s paternity was brought into question? Is this perhaps why he had Daniel come to the Bahamas after the birth—to intentionally or unintentionally do him in? Who knows? Only Howard knows for sure. Now with Daniel gone, no one could pin any paternity on Daniel’s part.

So if no one is found to be the father and with Daniel buried six feet under, Howard may have thought that can claim that he is Anna Nichole’s common law husband even though they are not legally married in the US. Apparently they may be legally married in the Bahamas. So as long as Dannilynn stays in the Bahamas he is her legal Bahamian daddy.

Howard wanted desperately to put this into action by letting the world know that he and Anna Nichole were married in a civil ceremony in the Bahamas. Hence the jumping off the boat in wedding clothing around 10 days after Daniel’s body was still in the refridgerator.

In order to lay claim to Anna, the multi million dollar baby and to the estate, Howard may be able to fight it out in a court of law that he is Anna Nichole’s common law husband. In any event, if no baby daddy can be found, cleaver Howard may have found a way to become a multi-multi millionaire . It is all speculation but these questions surface.

Howard I believe that you may go to your grave knowing that you did nothing to help a person who was drowing- drowining in the sea of drugs. In fact you may have pushed them further down into the oceanby doing nothing to save them such as putting them into rehab or gettingthem appropriate help. . You did not offer them a life raft. Instead, you offered them a steel anvil so that they could sink quickly and drown faster by letting her drug use get more and more out of hand.

87. About the will

"I intentionally omitted to provide for my spouse and other heirs including future children and other descendants now leaving and those hereafter botn or adopted. "

When was this will really written, can anyone prove that it was in 2001 and if it was why wasn't there a codicil to modify the will ? A provision should had been made that included Dannielynn. If that provision wasn't made by Anna the will should be invalidated.

Stern lawyers can make any kind of arguments to make the will stand in orrer to help his client to keep his "self proclaimed" Executor of the estate position and, continue to retain control of everything

Obviously it was Rale an also Stern who wrote that will. Were they protecting Anna's interest by adding that crazy provision ?. I don't think so, I believe Stern was protecting the interest that he personally has in the estate, He is the person who stands to benefit the most. I'm extremely concern about Dannielynn, Larry might be completely blinded by the camera flashes, He needs to stand up for his daughter and her interest s on her mother's estate.

Dannielyn has already been cheated of a lot of her assets, Howard made himself a partner in the corporations, after Anna's death , he inherited them, it doesn't make part of the estate, how much money did Anna earn that was deposited in offshore accounts ? What kind of investments Anna had that no one knows about except for Stern ?.

Larry should have contested the will and he should have demanded an investigation. Larry is making a great mistake, he doesn't realize it now ,but he will find out later and is going to be too late. What a pity !

I wanted to add that there is a new twist regarding Anna's estate, when Stern come up with the 710.000 us, that figure was highly questionable and many people expressed their suspicions over the networks, then The Bald Truth, Tmz, ET, come to Howard defense, they all said that the sum was going to be much more higher once all the other assets in the Bahamas were added to the estate but first the will needed to clear the California court for Howard to proceed to put all her other assets in order in the Bahamas.

Today, I didn't hear any mention of this from Stern lawyers, and in all the articles that were published about it , they only talked about the 710.000 figure, and of the possibility that it could be more if they can add the 500.000 of the Marshall estate. This is awful !!!

Opri and Larry sitting side by side on Larry King's show back in January talking about Howard, Opri states that to date Larry incurred up to $300,000 in costs, I assume these costs were with her since she had been funding everything to that point. If she was working for him for free I don't think she would of made that comment back than right in front of him. I don't remember Larry complaining back than!!

But I told her several times that it was, you know, basically her home, she needed to tell him that, you know, what his place was as her attorney, friend, whatever, but not to overstep those bounds and to kind of give us our space.

And several times she did. And one time in particular, while she was pregnant, I had to basically rescue her at a hotel because Howard gave her so much grief about me being the father and saying that he was never going to accept me. And he told her to make a choice -- her -- him or me.

And she called me crying hysterical and she drove herself barefoot to a hotel down the street and I had to basically help her.

KING: Why is she copping out on you?

BIRKHEAD: Because, you know, she's under the influence in many ways. And one of the reasons is Howard Stern is basically telling her that she needs to get away from me. He's telling her...

KING: He's a Svengali? You know, he controls her?

BIRKHEAD: You know he -- exactly. I mean it's almost, to be honest with you, you would almost think she has like Stockholm Syndrome or something. She's in another place, under his influence and she just doesn't...

Anna Nicole Smith’s lawyer finally admitted what his client has always denied but everyone else took for granted: his client was in it for the money. In closing arguments before Judge David O. Carter, Smith’s attorney told the court that of course she married J. Howard for the money. “What is he offering?” her attorney asked. “Does this court really believe a man reputed to be the richest man in Texas offered her his good looks, longevity, fatherhood?”

Most attorneys would try not to contradict their clients. Smith has always claimed she wasn’t a gold digger. But Smith’s attorney has been dissing her throughout this trial, first telling the court she did not need to testify at all. In closing arguments he urged the court to remember that, “her testimony is not what this case lives or dies on.”

Smith didn’t even bother to stay in the courtroom during all of her own attorney’s closing arguments.

Smith’s Attorneys Pull Out All The Stops
J. Howard Marshall was an educator, government official, corporate executive and successful independent oilman – but if you believe Smith’s attorneys, their client became his reason for living and “the most important thing in his life.”

They also repeated the claim that Smith saved J. Howard’s life. Smith actually testified that when she found her husband looking ill with “the face of death,” in early 1995, she sat with him instead of calling a physician or an ambulance.

Attorneys for E. Pierce Marshall fired back; pointing out that Smith has claimed virtually everyone connected with J. Howard was guilty of perjury and plotting against her.
