Nicole Richie Will Fight DUI Charge

TMZ was in court moments ago when Nicole Richie's lawyer Shawn Chapman Holley announced her client will try and beat the rap. A trial date was set for July 11.

Richie was arrested last December after she was driving the wrong way on an L.A. freeway. Cops say she confessed that she had been smoking pot and had taken Vicodin.

The stakes are high for Richie. She has a prior DUI and if she's convicted this time around she faces a minimum 5 days in the pokey. Worst case scenario for Richie -- one year in the slammer.

121. To comment 103: If she is convicted of the DUI and there is no plea that herion conviction will be the thing that gets her more time. The previous DUI conviction will hurt most definitely and add to the time she would have gotten anyway but the herion bust will play into sentencing.

You can only play the rehab card once, maybe twice. At this point there will be no combined punishment/rehab effort, the sentence will be purely for punitive purposes.

122. Although there is a mandatory five day jail sentence for the 2nd DUI in California, judges frequently suspend it in favor of community service. Considering Richie is pregnant, and Nicole has lawyered up, there probably will be a plea deal made that will keep her out of jail.

124. It's NOT confirmed she's pregnant, ONLY assumed by some media outlets.

The fiasco has gone so far, that bloggers are more often than not just cut & paste from eachother (as well as the outlests themselves for that matter).

I think everyone needs to refrain from saying anything about her being pregnant until there is a real confirmation, not hearsay and/or specualtion. Either she or Joel Madden need to set the record straight.

We have another drunk, druggie, coke whore young hollywood type who got caught breaking the law AGAIN, and is looking for any way to weasel out of paying the price of her criminal acts. Except, this one is much more manipulative than others. While others have put together "dream teams" to try to get out of jail, what does Nicole Richey do? SHE GETS PREGNANT, TO TRY TO INVOKE PITY & AVOID JAIL. What a whore.

Well, you know what? Women give birth in jail all the time. I say throw her drug addicted, drunk, coke whore ass in jail, and if she has to give birth there, then so be it. What's more, she should get a much harder penalty for attempting to manipulate her way out of it by potentially hurting another human being (her potentially drug addicted baby). Cut this stupid dumbass no breaks, throw the book at her & let her know that society requires you follow the rules or you go away to jail...

127. I was just fine, I thought every one else was driving the wrong way!!!!

But on the reality side this is a very severe violation. I was almost hit by a driver going the wrong way on a California freeway over 30 years ago and it still makes my knees shake to think about it..

I am sick and tired of people saying Paris got more time because she is famous. She and Nicole deserve more time because they have the money to have someone else drive when they are partying. NO ONE should drive under the influence. We are losing about 500 soldiers per year in Iraq, way way too many but it pales in comparison to the 12 THOUSAND we are losing per year to drivers under the influence.

If we make an example of the high profile people who have easy access to not driving in this condition we will save lives, and this behavior could have very easily ended in a family being killed. I hope by going to trial she brings attention to this problem and gets the maximum allowed by law.

DON'T DRIVE UNDER THE INFLUENCE!!!!!!!!!!!

128. Lots of pregnant women go to jail, some go to prison. She can put up her fight, I respect that more than Paris, but if she is found guilty she should face the possibility of more time in jail than Paris. She would be a perfect release to home criminal at the 30 day point. Getting behind the wheel drunk or high or both is just dumb and hers is even dumber because she can afford a driver.

129. She is so pathetic!!! How the hell is this irresponsible, reckless, spoiled skinny rich girl going to raise a child? There are so many deserving couples trying to get pregnant without success, yet someone like Nicole Ritchie gets knocked up. Next thing you know, Paris will get knocked up and their two daughters will start to party with them. What a great role model Nicole will be, NOT!!! And, I give the marriage 6 months at best.

130. Lets play sentence Nicole:

The judge should work with the sheriff to make this work. She is sentenced to 9 months with no early release just like Paris. That means she will do about 130 days. She is processed into the jail and put in a cell. Ten days later, the judge sends for her, she gets to do a perp walk to the van and the press knows it's coming somehow. She perp walks in orange and chains. The judge changes her sentence... she is to stay under home arrest until labor begins, have extremely frequent drug tests. The number of people who can visit her each day is limited and the number at one time is limited.

131. Can anyone say anything nice a all. I am much to old and wise to even be on this blog. It just amazes me how all can say any mean thing and that makes them feel better. Perhaps God will bring good from all of this. We just have to ask, no comments about a holy rollar, I not and sin like the rest. But, it dose break my heart to see so much hate on these blogs. I only hope that someone with wome sense will thiknk about this a little. No most of us are not rich and spoiled, it is so easy to throw a stone in someone's glass house as long as you keep your secrets and lives to yourself .
