Avril Ripped for Allegedly Ripping Off "Girlfriend"

Avril Lavigne has gotten herself into a deeply complicated mess, with two '70s songwriters claiming that she stole their song for her hit single "Girlfriend."

In a lawsuit filed in US District Court in Northern California, songwriters Tommy Dunbar and James Gangwer allege that "Girlfriend" rips off their 1979 song, "I Wanna Be Your Boyfriend," originally performed by The Rubinoos, whose previous claim to fame was penning the theme to "Revenge of the Nerds." Veteran music critic Stephen Thomas Erlewine wrote on Billboard.com that "Girlfriend" was "a total lift" from "Boyfriend."

Lavigne's manager tells the AP that the claim is baseless and that he hired a musicologist to study the two tracks -- and that they've been deemed "completely different songs." Decide for yourself below ...

UPDATE: Tommy Dunbar and James Gangwer, the songwriters who recently brought a legal action against Avril Lavigne and Dr. Luke that claimed that the hit Lavigne/Dr. Luke song "Girlfriend" infringed the copyright in their 1979 song "I Wanna Be Your Boyfriend," have issued the following statement: "We are satisfied that any similarities between the two songs resulted from Avril and Luke's use of certain common and widely used lyrics. We therefore completely exonerate Avril and Luke from any wrongdoing of any kind in connection with the claims made by us in our lawsuit."

I don't get how she can make a statement that only a "few words" were similar when the entire concept of the song--the beat/music and the "hey you, hey you" (which is essentially the entire song) are the same--I mean who is she trying to fool? I hope her fans are not so stupid as to believe that this was some kind of accident.

213. I think that songs are not so simular, like they say. I guess that writer of the song "i Want To Be Your Boyfrend" so how the "Girlfriend" went well, and he wanted to get some money... I think that Avril have never heard this song before. And it's just five words... She would never do something like that. This is just a coincidence. i love Avril Lavigne, she is the best, and i believe that she didn't do this.

220. If you want to tear things apart enough, hardly any music is truly "original." Music is based on compositional techniques that are hundreds (if not thousands) of years old. It would be like trying to sue the author of a book because 99% of their work contains words from the dictionary... or trying to sue the dictionary publishers because their work contains the contents of other writings, which came from even older works...

What's next? Is someone going to copyright the 4/4 time signature or the key of G?

223. sure they have a similar chorus by the two words hey and you and then it's i wanna be your boyfriend instead of girlfriend but they are completely different songs and it not fair to only consider the chorus those '70s songwriters are just trying to get money cause not only did that song suck but they probably didn't make much money if any off of that crap (the lyrics of it suck as well do the vocals) these people are so full of it and pety its from like more than 20 years ago they shouldn't try to compliment themselves by thinking that someone heard there song and actually wanted to make it again

224. OMFG people, chill out! Number one, That song was made in the 70'S Avril was born after that, also, SHE'S FROM CANADA! I doubt she's ever even heard of that song until now! Also, the only things THE SAME between those two songs is the "Hey hey you you" part, and thats one sentence! Cut her some slack! She's an amazing artist, why can't everyone just leave this poor girl alone?
