Criminal Probe Into Anna's Prescriptions

TMZ has learned the California Department of Justice (DOJ) is conducting a criminal investigation into several doctors who prescribed various medicines to Anna Nicole Smith.

Sources tell TMZ the DOJ's Bureau of Narcotics Enforcement has contacted Larry Birkhead, Big Mo (Anna's bodyguard) and others. We're told DOJ is particularly interested in two doctors -- Khristine Eroshevich and Sandeep Kapoor. TMZ broke the story that Dr. Kapoor prescribed methadone to Anna under an assumed name when she was eight months pregnant. Dr. Eroshevich ordered a virtual pharmacy of drugs for Anna, five days after her son Daniel died.

Dr. Eroshevich, who was in the Bahamas with Anna, sent the prescription wish list to Dr. Kapoor. Kapoor's attorney, Ellyn Garofalo, told TMZ "Dr. Kapoor declined the request for prescriptions. He would never prescribe that combination of drugs, in such large dosages, to any patient."

The Medical Board of California launched its own investigation of the two doctors earlier this year. That investigation is pending.

By the way, TMZ has learned Dr. Kapoor is in the process of having twins via a surrogate.

30016. 30025. I was not able to post a small paragraph quoting from the Seidlin Court Ruling but I was able to post the link to the ruling itself. It was the bottom of page 10 of the ruling and page 11 in which the credibility of the three witnesses was deemed worthy or not worthy. Anna's mother's credibility regarding the particular issue of burial of her daughter was NOT deemed credible and then it listed WHY. The testimonies of both Birkhead and Stern were deemed to be credible and Stern's, in particular, was deemed to be HIGHLY credible--regarding the issue of Anna's burial and her wish to be near her son.

Are you now off of that nonsensical conversation I read last night about the alleged 'crushed' methadone tablet and the bizarre theory being put forth regarding plastic cups --the whole nine yards of idiotic speculation? Goodness gracious--that conversation read like a wacked out bunch of nonsense.

The tablet that was found along with the soma tablet was DEGRADED--scored means the mark in the center of the pill put there by the pharmaceutical company in order to cut it in half--you can even buy a pill scorer--a little cutting thing.

30020. Well, we all know how credible judge larry is....even the talking heads see how credible he is. They don't call him "Crying Judge Miscarriage of Justice Seidlen" for nothing. I would definitely find any ruling he would write to be as credible as howie's testimony.

YOU ARE WRONG! By the way liquid methadone was most likely easier and there was a huge gallon of it in the fridge so maybe you are on to something?

30022. Jack Harding is a non-entity whose stories will never be told in a public courtroom and/or at inquest.

Belaboring the gist of his stories is an exercise in futility. He is just as peripheral to the case as others who were not present at the death of Daniel, never knew him and make wild claims.

30024. Wondering which type of Methadone was found in Anna's hospital room--if any.

We know:
Anna had liquid Methadone in her fridge
Daniel had Methadone in his body
A Methadone tablet was found by the nurse

Do we know:
If Anna also had Methadone in pill form?

To say that Anna had only liquid Methadone is presumptuous, at best.

Question:
In Anna's Inquest tape--will she admit to using Methadone at all?
What statements did Howard make to the police at the time in reference to access to Methadone?

The Inquest will indeed be interesting. I wonder if Anna will get thrown under the bus since she can't speak for herself anymore.

30026. The small tablet (one of two) was DEGRADED, low dose and was analyzed by a lab as was the soma tablet.

Daniel died of a lethal combination of anti-depressants and low-dose methadone--all of which worked in conjunction to obtain the same and lethal arrythmic cardiac failure.

No amount of blogging and conjecture can ever CHANGE that fact--two autopsies were done and both came to the same conclusion. Pending toxicology reports were forwarded to Dr. Wecht in his UNOFFICIAL CAPACITY and were privately done--which only verified the death from accidental drug OD--naming more drugs in Daniel's system which did NOT play a part in his cardiac arrest.

Howard wrote up an agreement that stipulated that Larry would forfeit any claims to parentage. Howard had him sign it right there on the kitchen table, in front of all of us. Anna was there, too, so she couldn't have been dead.

Anna told Larry eventually that she was pregnant with his baby and he was supportive. Then Anna lost the baby and they tried again. And Larry was there by her side the whole time. But then Howard reminded Anna about not having the biological father in the baby's life, and Anna then reminded Larry of that fact. Larry resented Howard's interference and was upset that Anna wouldn't change her mind.

Then the lawsuit. Larry told Opri about the agreement he had signed. Opri told him not to worry because Howard never filed it and he never responded to her request to see it. Anyway, everyone knew the baby was Larry's all along, but Larry didn't want it getting out that he had never had sex with Anna because, by then, the whole world saw him as the "Wronged father" and not the "Wronged Sperm Donor." Two very different things. And, as it turned out, being the "Wronged father" has been very profitable for Larry.

It is that agreement, which spells out very clearly that Larry was only a sperm donor -- one of a half dozen or so -- that was Howard's trump card. With an eye toward a career in show business, Larry didn't want to risk having it leaked; so he didn't fight the executorship.

I think he would still have that little girl if he hadn't been forced to take the DNA test, yes sir I believe that. So why would he wait to play the agreement card after Ms. Smith died and cause himself all that trouble?

A: Because everyone knew the baby was Larry's. Larry knew and Howard knew. At that point, all Larry wanted was the baby. And all Howard was interested in was control of the estate. Howard figured he'd get automatic control of Anna's -- albeit, Dannielynn's -- estate if he was the baby's father. But Larry still had the upper hand because Dannielynn was really Larry's and Howard knew, eventually, the DNA test would have to be done and he would have to concede that he was not the baby's father, thus, he would lose control over the estate.

So, Howard told Larry he could have the baby, with no further court delays, if Larry allowed Howard to retain control over the estate. And why would it be a great deal? Because Howard has connections in the media and he promised to facilitate deals so that Larry could make lots and lots of money, millions even, just selling pictures of his baby. He'd be portrayed as the doting, loving father, and the media would eat it up.

Plus, if Larry didn't agree, Howard always had his trump card. And if he played it, there would be no millions, no picture deals, no media deals. It would be a lose-lose situation.

Q: And then you go on to say that this guy Larry is really a good guy and he's just gone off the deep end for money. Now if he was a good guy and he had signed the agreements like you said he did,.... well then he has been in this for the money all the time. Now that wouldn't make him a good guy after all, would it?

Because Howard has connections in the media and he promised to facilitate deals so that Larry could make lots and lots of money, millions even, just selling pictures of his baby. He'd be portrayed as the doting, loving father, and the media would eat it up.

Plus, if Larry didn't agree, Howard always had his trump card. And if he played it, there would be no millions, no picture deals, no media deals. It would be a lose-lose situation.

Q: And then you go on to say that this guy Larry is really a good guy and he's just gone off the deep end for money. Now if he was a good guy and he had signed the agreements like you said he did,.... well then he has been in this for the money all the time. Now that wouldn't make him a good guy after all, would it?

A: I do think Larry went off the deep end, and I think the promise of millions clouded his judgment. If he was smart, he would have just taken his baby and gone home.

Q: Mr. Delusional I really want to believe you but you have to have the evidence. You know I'd love to see some of the paperwork that would backup these theories. You know, I don't want to be led down the wrong path just because you say so. I mean, I don't even know who you are or how you got this information.

Daniel died of a lethal combination of anti-depressants and low-dose methadone--all of which worked in conjunction to obtain the same and lethal arrythmic cardiac failure.

No amount of blogging and conjecture can ever CHANGE that fact--two autopsies were done and both came to the same conclusion. Pending toxicology reports were forwarded to Dr. Wecht in his UNOFFICIAL CAPACITY and were privately done--which only verified the death from accidental drug OD--naming more drugs in Daniel's system which did NOT play a part in his cardiac arrest.

30030. 30024. 30023. PI Harding first story was that they met at Starbucks [this is left out of Rita's book]. I THINK it was both Ray Martino and Daniel and was in regards to Daniel's interest in the military.

Suddenly after ANS's death, the private investigator said he met Daniel again ALONE and this is where stories started going haywire with PI Harding. Changing stories, Changing meeting places, what they discussed, etc. Martino does NOT collabarate any other meetings except for the first.

IMO The Bahamian Police interviewed him and got the military meeting story, it had no relevance to the investigation NOT on inquest list. Then after ANS's death it suddenly became more meetings etc.
