Criminal Probe Into Anna's Prescriptions

TMZ has learned the California Department of Justice (DOJ) is conducting a criminal investigation into several doctors who prescribed various medicines to Anna Nicole Smith.

Sources tell TMZ the DOJ's Bureau of Narcotics Enforcement has contacted Larry Birkhead, Big Mo (Anna's bodyguard) and others. We're told DOJ is particularly interested in two doctors -- Khristine Eroshevich and Sandeep Kapoor. TMZ broke the story that Dr. Kapoor prescribed methadone to Anna under an assumed name when she was eight months pregnant. Dr. Eroshevich ordered a virtual pharmacy of drugs for Anna, five days after her son Daniel died.

Dr. Eroshevich, who was in the Bahamas with Anna, sent the prescription wish list to Dr. Kapoor. Kapoor's attorney, Ellyn Garofalo, told TMZ "Dr. Kapoor declined the request for prescriptions. He would never prescribe that combination of drugs, in such large dosages, to any patient."

The Medical Board of California launched its own investigation of the two doctors earlier this year. That investigation is pending.

By the way, TMZ has learned Dr. Kapoor is in the process of having twins via a surrogate.

What I dont get about this PI is why change his story from 'PERSONS' associating with his mother and 'ASSOCIATES' taking advantage of her......to Howard Stern, after her death?!

Also if Ray Martino was the one who referred Daniel to Harding, wouldnt he also know if Daniel was in fear of Stern? Therefore if Martino knew of Daniels fear, wouldnt this be important to bring out in his interview for the Investigative Report?

Oh, you figured it out, all right. Harding met with Dan once, that we know of, and he agreed to meet with him only because he was Anna Nicole Smith's son. And essentially, all Harding told him was, "Beat it, kid. I got bigger fish to fry."

And, like the proverbial fisherman who tells the tale of the one that got away, each time he tells it, the fish keeps get bigger and bigger. We found out that Harding may not have even graduated high school. He either has no diploma, or he got his GED.

I never knew Dan to be "terrified" of Howard. Rather, Dan was extremely upset that his mom was going to up and leave CA and leave him behind. You have to understand, he was REALLY upset.

As a whole, though, the older Dan got, the more distant he became -- from all of us. But I wouldn't call that strange behavior. He also started exploring his artistic and creative side, and that tends to put you in a world of your own.

Dan saw a lot of weird things growing up; more than a sensitive kid like him should have seen. No son should have to find out that his mother nearly ODed the night before. But, perhaps because his mom always recovered from these near death episodes, he seemed to learn how to take it in stride. But I think, deep down, it bothered him. I know it really bothered him to see his mom in pain all the time.

For example, when Anna had the liposuction done, one procedure right after the other, she was absolutely beside herself in pain. I remember Dan asking her one time, "Why do you keep doing this to yourself?" and her answer was, "It's showbiz, honey."

I know of two incidents that affected Dan in a profound way and they both involved Mark Hatten. The first one I'm kind of sketchy about because I had already left the house when it supposedly happened and it wasn't discussed much. Mark was essentially dead of alcohol poisoning or drug intoxication after a night of partying and Dan saw Howard giving him a shot. Apparently, it was something to counteract the effects of whatever it was Mark had taken (this is according to Anna). Dan was there when Mark came to. When Mark accused Howard of trying to kill him, (even if Dan didn't believe Mark) it still scared the bejesus out of Dan. Mark warned, concerning Howard, "If he doesn't like you, he can make you disappear."

The next episode was Mark's arrest. Dan cried that day. Howard didn't like Mark. And Mark disappeared.

There are other incidents, of course, but none as traumatic. As okay as Dan seemed with the world around him, the human psyche can only handle so much -- especially when that psyche is in the body of a young, developing teenage boy. As a consequence, Dan had anger management issues and started taking anti-depressants to control his outbursts.

Up until Anna died, I had no idea that all of her scripts were in Howard's name, so I never associated Harding with the drugs. But if Dan knew, maybe he was taking it to Harding to investigate. Dan was upset enough about Anna's leaving to do that, I think, especially because he knew that Howard had arranged it.

30079. No amount of blogging and conjecture can ever CHANGE that fact--two autopsies were done and both came to the same conclusion. Pending toxicology reports were forwarded to Dr. Wecht in his UNOFFICIAL CAPACITY and were privately done--which only verified the death from accidental drug OD--naming more drugs in Daniel's system which did NOT play a part in his cardiac arrest.

- Mavis Davis noted that Daniel was attending to his mother’s comfort. Subsequently, he was observed to be asleep on multiple occasions.
- Even after everyone finally went to sleep (the room was furnished with two twin beds and a large armchair), Daniel didn't stop tending to the others, checking on Smith, who was recovering from a c-section, and the baby during the night. At 6:20 a.m. a hospital worker saw Daniel help Smith to the bathroom. He complained to no one in particular that he was tired, reports Alex Goen, CEO of Trimspa, (PEOPLE. 9/13/06)

- Dr. M. Baden: (On The Record Wednesday, March 28 2007) If he (Daniel) had taken enough drug to cause his death, he wouldn’t have gotten up. So there’s an implication as to when he was last seen. He was seen moving around 6:30, according to the witnesses. Then some other people saw him allegedly asleep. Now, whether he’s asleep or whether he’s dead after 6:30 is going to be an issue.

- Anna Nicole Smith’s son, 20 year-old Daniel Wayne Smith, had be dead “for some time” before hospital officials were called in to perform advanced life saving procedures. (Bahamian News Accounts):
- According to a statement from officials at Doctor’s Hospital, Daniel was last seen alive on Sunday September 10 at 6:20 am. He was attending to his mother. An alarm was raised at 9:39 am when he was found to be “unresponsive.”

- (hospital president and CEO): “At 9:38 am the nurse was called, following which physicians on the floor were immediately summoned. Recognizing Daniel was unresponsive, they initiated CPR. A code blue was called and the team responded from the Emergency room

I'm very glad you want to take more time to talk cause you know this is case....or should I say cases...well you know what I mean…...it's just so upsetting and it's hard to believe all the details there are.

I was just wondering.... I have been trying to respond to you for days now and never get a confirmation e-mail. I just wanted to let you know how much I look forward to a post from you. You write so eloquently, I am impressed! I also find a peace with the assumption that Anna really did have a friend who genuinely cared about her despite the distance that seems to have transpired between you. I often wonder WHY doesn't anybody come forward with info that would aid in this matter?! There are many people that know alot, where are they? This whole mess just makes me sick. What part of "prescriptions in Howard's name" do some not understand? That in itself IS A CRIME!!

And the thing with Larry...Anna wasn't into Larry in a sexual way, but she thought he was a beautiful man. She loved his looks.

Anna told Larry eventually that she was pregnant with his baby and he was supportive. Then Anna lost the baby and they tried again. And Larry was there by her side the whole time. But then Howard reminded Anna about not having the biological father in the baby's life, and Anna then reminded Larry of that fact. Then the lawsuit. Larry told Opri about the agreement he had signed. Opri told him not to worry because Howard never filed it and he never responded to her request to see it. Anyway, everyone knew the baby was Larry's all along, but Larry didn't want it getting out that he had never had sex with Anna because, by then, the whole world saw him as the "Wronged father" and not the "Wronged Sperm Donor." Two very different things. And, as it turned out, being the "Wronged father" has been very profitable for Larry.

It is that agreement, which spells out very clearly that Larry was only a sperm donor -- one of a half dozen or so -- that was Howard's trump card. With an eye toward a career in show business, Larry didn't want to risk having it leaked; so he didn't fight the executorship.

Q: Now don't get me wrong...I just find this hard to wrap my head around.
You know this Mr. Stern guy is pretty shady. I mean don't you think Mr. Stern intended to keep the baby himself and thought the Bahamian government would back him? You do remember how he didn't want to take the DNA test and he kept saying he was the father? And then he planned on marrying Ms. Smith. I think he would still have that little girl if he hadn't been forced to take the DNA test, yes sir I believe that. So why would he wait to play the agreement card after Ms. Smith died and cause himself all that trouble?

A: Because everyone knew the baby was Larry's. Larry knew and Howard knew. At that point, all Larry wanted was the baby. And all Howard was interested in was control of the estate. Howard figured he'd get automatic control of Anna's -- albeit, Dannielynn's -- estate if he was the baby's father. But Larry still had the upper hand because Dannielynn was really Larry's and Howard knew, eventually, the DNA test would have to be done and he would have to concede that he was not the baby's father, thus, he would lose control over the estate.

So, Howard told Larry he could have the baby, with no further court delays, if Larry allowed Howard to retain control over the estate. And why would it be a great deal? Because Howard has connections in the media and he promised to facilitate deals so that Larry could make lots and lots of money, millions even, just selling pictures of his baby. He'd be portrayed as the doting, loving father, and the media would eat it up.

Plus, if Larry didn't agree, Howard always had his trump card. And if he played it, there would be no millions, no picture deals, no media deals. It would be a lose-lose situation.

Q: And then you go on to say that this guy Larry is really a good guy and he's just gone off the deep end for money. Now if he was a good guy and he had signed the agreements like you said he did,.... well then he has been in this for the money all the time. Now that wouldn't make him a good guy after all, would it?

A: I do think Larry went off the deep end, and I think the promise of millions clouded his judgment. If he was smart, he would have just taken his baby and gone home.

Q: Mr. Delusional I really want to believe you but you have to have the evidence. You know I'd love to see some of the paperwork that would backup these theories. You know, I don't want to be led down the wrong path just because you say so. I mean, I don't even know who you are or how you got this information.

A: Well, I hope I was able to answer your questions.

So, Howard told Larry he could have the baby, with no further court delays, if Larry allowed Howard to retain control over the estate. And why would it be a great deal? Because Howard has connections in the media and he promised to facilitate deals so that Larry could make lots and lots of money, millions even, just selling pictures of his baby. He'd be portrayed as the doting, loving father, and the media would eat it up.

Plus, if Larry didn't agree, Howard always had his trump card. And if he played it, there would be no millions, no picture deals, no media deals. It would be a lose-lose situation.

Q: And then you go on to say that this guy Larry is really a good guy and he's just gone off the deep end for money. Now if he was a good guy and he had signed the agreements like you said he did,.... well then he has been in this for the money all the time. Now that wouldn't make him a good guy after all, would it?

A: I do think Larry went off the deep end, and I think the promise of millions clouded his judgment. If he was smart, he would have just taken his baby and gone home.

Q: Mr. Delusional I really want to believe you but you have to have the evidence. You know I'd love to see some of the paperwork that would backup these theories. You know, I don't want to be led down the wrong path just because you say so. I mean, I don't even know who you are or how you got this information.

You know I have believed most of the stuff you have said and well I....believe you are an honest man but some of this well, sir it just doesn't sit well with me. I mean how do you know this information? Did Ms. Smith tell you all this?

A: Well, Sir, what I know is what I know. I was told some things; Anna told me some things; and I was there and witnessed things myself.

Q: Now are you saying that Ms. Anna Nicole's Smith, who was sleeping with many men like those guys in the 'Millionaires Club,' would chose to be artificially inseminated by some Kentucky boy with no money? Do you know this for a fact sir?

A: I do know about the quote-unquote Millionaires Club, yes, Sir. But it was more like, "Spend some time with a celebrity," you know? Most -- if not all -- the guys who visited with Anna were gay, and it was more about drugs and partying than it was about sex. It was one of the ways that Howard and Anna raised cash.

And the thing with Larry...Anna wasn't into Larry in a sexual way, but she thought he was a beautiful man. She loved his looks.

Q: And you mean to tell me this Larry guy.... ah....this Mr. Birkhead, he actually signed an agreement? I mean sir I would love to see the paperwork. Do you think he signed the agreement before Ms. Smith died or after? Cause that would really be something.

A: I personally don't know where Howard keeps his paperwork. I imagine he keeps it in safety deposit boxes all over the place.

Larry didn't know if Anna was going to use his sperm specimen; but when she asked him to provide one, he agreed. Howard wrote up an agreement that stipulated that Larry would forfeit any claims to parentage. Howard had him sign it right there on the kitchen table, in front of all of us. Anna was there, too, so she couldn't have been dead.

Anna told Larry eventually that she was pregnant with his baby and he was supportive. Then Anna lost the baby and they tried again. And Larry was there by her side the whole time. But then Howard reminded Anna about not having the biological father in the baby's life, and Anna then reminded Larry of that fact. Larry resented Howard's interference and was upset that Anna wouldn't change her mind.

Then the lawsuit. Larry told Opri about the agreement he had signed. Opri told him not to worry because Howard never filed it and he never responded to her request to see it. Anyway, everyone knew the baby was Larry's all along, but Larry didn't want it getting out that he had never had sex with Anna because, by then, the whole world saw him as the "Wronged father" and not the "Wronged Sperm Donor." Two very different things. And, as it turned out, being the "Wronged father" has been very profitable for Larry.

It is that agreement, which spells out very clearly that Larry was only a sperm donor -- one of a half dozen or so -- that was Howard's trump card. With an eye toward a career in show business, Larry didn't want to risk having it leaked; so he didn't fight the executorship.

I want to believe everything you say, but you need to understand we have been fooled many, many times. If you don't mind I'd like to ask you a few questions.

1. If you are serious about your close connection to all the players in this saga, why does Howard allow you to share with us what you have? You stated you were one of 5 friends Howard could not remove from Anna's life. So it would have to be fairly easy for him to figure out who you are..correct?

2.Have you talked to Howard since Anna died?

3. Have you ever considered writting a book?

4.Will we ever know who you are?

Thank you for your questions. I will try to answer your questions as forthrightly as I can.

1. Why does Howard allow you to share with us what you have? ...It would have to be fairly easy for him to figure out who you are..correct?

I got a little chuckle out of how you phrased your question. "Why does Howard 'allow' you to...?" Try as he might, Howard cannot control what anybody says about him. If I manage to go and get myself sued, so be it. I will proudly and unhesitantly get up on the stand and repeat everything I have said here.

2. Have you talked to Howard since Anna died?

Yes.

3. Have you ever considered writing a book?

You mean like friend Mo B. and family member Donna Hogan have? Absolutely not. I think they call that blood money.

4. Will we ever know who you are?

Maybe someday, when all of the investigations are concluded.
