Angry Avril Responds to Rip-Off Claims

Earlier this week, TMZ reported that attitudinal Avril Lavigne's song "Girlfriend" was a rip off of a 1979 song by the Rubinoos called "I Wanna Be Your Boyfriend." Avril's management flatly denied the band's claims, and now Avril's called BS too.


Writes Avril:

"You may have heard some news that two guys who wrote for some band from the 1970s I have never in my life heard of called the "Rubinoos" are trying to sue me. They have a song called "I Want To Be Your Boyfriend" that has no musical similarities to the song "Girlfriend" that Luke Gottwald and I wrote together. They claim that a small part of the lyrics are the same and are saying that I took these from them. I had never heard this song in my life and their claim is based on 5 words! All songs share similar lyrics and emotions. As humans we speak one language.

Off the top of my head, two other songs that I can immediately think of with this type of lyric are "Hey, hey, you, you get off of my cloud" by the Rolling Stones and "Hey little girl I want to be your boyfriend" by the Ramones. Simply put, I have been falsely accused of ripping their song off. Luke and I have done nothing wrong and there is no merit to their claim."

107. If George Harrison can lose a copyright infringement case because it was determined his song My Sweet Lord was stolen from the people who wrote He's so fine by the Chiffons, Avril is screwed.

You sound like a typical douche-bag lawyer. And the fact that you took a couple music theory classes doesn't make you an authority on music originality. I don't care how much you talk about 3rds and 5ths (like that makes you so cool) and disparage the band who wrote the song. WE ALL HAVE EARS!!!! The 4 notes that she stole are the basis of the entire song! All Avril did was raise the key to accomodate her annoying high-pitched voice and rearrange the notes to the hook a tiny bit.

110. Funny how so many here and Avril herself try to diminish the Rubinoos claim because they haven't heard of them. I'm sure there's plenty of fine acts you've never heard of kids. Just as I'm sure that 20 years from now it'll be Avril who? Time marches on... Everything old becomes new again... Now go work on your little skater punk "image" and wardrobe and practice those tired old barre chords.

113. Magnadoodle et al - Quoting from Paris Hilton, who was being interviewed about her CD project: "I know a lot about music. I've been listening to it all my life." Sounds like you are almost as qualified as Paris to judge the similarities, or lack thereof, between two songs.

If you don't know what a third or a fifth is, then it doesn't matter how many ears you have - they ain't worth crap in analysing anything musical. You're right, the songs are in a different key, but that is immaterial. The notes themselves are completely different, there's only one line in common in the lyrics, it's been in older songs that were more famous, and Avril has understandably never heard of the Rubinoos. The end. No case.

If I were her, I'd countersue and then drag both cases out until the legal fees make the Rubinoos lose their houses.

JOohn - You think she's screwed if she loses? Just like George Harrison -- he just disappeared after that case ended, huh.

114. What an absolute surprise! Who knew she was going to deny and act like she "never" heard the song. It doesn't matter if she heard the song or not, it's the record exec croonie telling her what to sing on his record!! I smell Vanilla Ice. Bad. In my opinion it's her career that's melting the ice caps. Did anyone see her on Live Earth? My point exactly.

115. You know, I think the Rubinoos have a great idea: try to copyright the words 'hey you' and then sue anyone who uses them. Bet you'd make a ton of money, because those words are extremely distinctive and rarely used! Sarcasm free of charge.

116. I just listened to the rubinoo version and the hook in the song is exactly the same.
for all you young unsigned bands. get your music on myspace and video on youtube, and you too will have money coming when someone rips you off.

118. Regardless of the outcome on this case, this chick really sucks. Every picture I've seen of her is of her scowling and flipping people off or spitting. Very classy! Every interview she manages to bash people, either her fans or other stars. That's why people hate her, not because they're jealous.

I will agree about this song sucking, "Girlfriend", but there are other songs that are actually good, e.g. Innocence. And frankly I don't really care much about her personal life, and wonder what the fact that she scowls in her pictures has anything to do with her singin. It's well knwn thathe paparazzi take the pics of celebs when they are doing bad things, it gets them the necessary cash.

LOLThere are so many songs that have the same words or the same content...
And to the Second writer..ARE YOU DELUSIONAL..her song & theirs sound NOTHING alike....except for the hey hey you you..the beat is way slower....I really DOUBT you even listen to it.....They are 2 completely
differnt sounding songs.....
