The Commissioner in the Nicole Richie DUI case did not grant the continuance Nicole Richie wanted. Period.

As TMZ first reported, Richie's lawyer asked for a continuance until August 5th, because her expert witness, Dr. Terence McGee, was not available to testify then. Commissioner Steven Lubell was visibly upset and ordered both Nicole's lawyer, Shawn Chapman Holley, and the prosecutor into chambers. When the Commissioner came out, he said he would not rule on the continuance and ordered all parties into court tomorrow morning at 8:30 AM -- that's when the trial is scheduled to begin.

Seems like Nicole is in a pickle. She flew to Calgary last night with baby daddy Joel Madden, who is performing a gig in the Great White North. Will Nicole bail on the concert and come back to face the Commish?

31. Now we're going to play the pregnancy card? Don't think so Nicole.
Paris went to jail and so will you. There are lots of pregnant ladies
in prison and they get no special treatment.
I wonder if you got pregnant on purpose??? If you did, you're really stupid.

34. just because she can afford trips everywhere does not make her special. In a court room shes the same as you and me, and should be held accountable for her actions.... If she does not appear a bench warrant will go into play and she will be arrested. She would be stupid to not show, shes crazy if she thinks shes not going behind bars... Paris set the stage... next its Lindsay. I hope this changes their behavior.

36. And her lawyers told her, "Sure, Nicole, fly to Calgary with your boyfriend for a concert the night before your trial which the judge said he wouldn't continue. Sure, no problem." Or Nicole didn't even tell her lawyers she was going. I suspect she'll be back pronto for her trial tomorrow if she knows what's good for her.

39. She and all the other broads are just dumb as brass. Leaving the country without getting the continuance approved first. Just may be why the judge declined it. Richie's daddy doesn't seem to take any of this seriously. Pregnant, unmarried, druggie and jail bound. She deserves sympathy from no one.

43. 29. Does Canada also have seperate laws for celebrities??
A DUI charge is considered a felony in Canada and this makes a person inadmissable to the country under their normal laws.
I have seen people turned away at the border because they have a DUI charge but it seems that Nciole has no such problems.

Its a matter of innocent until proven guilty. Once she's been found guilty it'll be on her record but until then, she's free as a bird to travel here...

44. according to People.com, she doesn't have to be in court tomorrow. they're just arguing why the trial should be delayed. still looks bad to take so little interest that you fly out of the country. this is what killed Paris. judge got tired of her bored with it attitude.
