The breathalyzer can only test for impairment from the influence of alcohol. I'm sure she was not given the breathalyzer test after failing the field sobriety test because she confessed to smoking marijuana and taking Vicodin before the traffic stop. She was suspected of and charged with driving under the influence of drugs, not alcohol.

The expert they hired will challenge the reliability of the urine test that she was given based on the fact that urine only yields metabolites of the drug substance, traces of the drug after it has been metabolized. A great many experts agree that the urine test given in these DUI drug cases cannot precisely determine when the drug was last used or even reliably determine a person's present impairment. Testing the concentration of THC in the blood stream is the most accurate test for that purpose. A person can smoke a marijuana joint and the metabolites of the drug will begin to be detectable in urine within 10 to 30 minutes, depending on a person's metabolism, but the urine test will also yield a test positive for marijuana metabolites for days, even weeks, after the substance was last used, long after the impairing effects of the drug has ceased.

I think Nicole would have a good chance at acquittal in the jury trial if she had not confessed to the cops that she had smoked marijuana when she failed the field sobriety test. That confession establishes when the drug was used and I think the jury might consider that the confession is "proof beyond a reasonable doubt" that she was presently impaired, something that a police officer's subjective opinion of a field sobriety test and the urinalysis might not convince them of.

I wonder what the plea bargain was that was offered her today and how wise it was to reject it in light of the fact that upon failing the field sobriety test she confessed to smoking marijuana before the traffic stop? And I wonder if what she confessed was a verbal declaration only that will be recounted in the cop's testimony at trial, or if her declaration was written on the traffic ticket she signed? I expect that what she told the cop was written on the traffic ticket she signed, aka a signed confession, and she will have a serious problem if her lawyer is not successful in getting her declaration suppressed.

This is wild I am a bit older than you but also Brown! Graduated in 87! I will go to the Brown Alumni site this afternoon and post so look for me... I will mention TMZ. We have a home in Midtown as well as Camden (Maine) and Jupiter Island... wonder if we have crossed paths? I grew in Kansas City my dad was a farmer and my bother is running the farm.

I hate the Nicole and Paris haters. I have casually met Paris several times and she is a lovely girl. I hope all works out for both of them.
