Say you, say me ... say guilty!

TMZ was in L.A. County Superior Courtroom moments ago, where a pregnant Nicole Richie faced the music for her wrong-way DUI bust in December -- her second DUI conviction in 4 years.

A court commissioner sentenced Richie, represented by uber-lawyer Shawn Chapman Holley, to serve four days in the City or County Jail (her choice!) -- she got credit for one day, based on the six hours she served after being busted. So when she goes back in to the pokey, she'll only serve three days.

Richie was also fined $2,048, was ordered back to school for an alcohol education course and on three years probation.

Richie must report to serve her time by September 28.

The commissioner issued Richie a stern warning, telling her if she drove drunk again and she actually killed someone, she could be charged with murder -- not manslaughter. That's because after her first DUI, Richie agreed that if she drove under the influence and killed someone, she'd be nailed for murder.

The 25-year-old is expected to give birth sometime in January.

A source close to Richie said at today's sentencing she was "stoic and serious, but not emotional."

nope...she's not required to serve her time in the overcrowded L.A. County system..she serves it in a city jail so will do all the time.

(a) Punishment If any person is convicted of a violation of Section 23152 and the offense occurred within ten (10) years of a separate violation of Section 23103, as specified in Section 23103.5, 23152, or 23153, which resulted in a conviction, that person shall be punished by imprisonment in the county jail for not less than 90 days nor more than one year and by a fine of not less than three hundred ninety dollars ($390) nor more than one thousand dollars ($1,000).

154. at least some people on here get that she entered into a pea bargain. It has nothing to do with being famous. It is something that goes on everyday in the court system. You hear all these people bitching, but how many of you have screwed up and done something stupid. The girl is owning up to what she did, and i would think the fact of knowing that you have a guaranteed murder charge if she goes out there again, and does kill someone, i think will weigh heavy on her mind. I wish her good luck.

Her new man seems to have a calming effect on her, a baby too should give Nicole the added incentive to remain drug free.
Addicts are unpredictable but I have more hope for her then the others in the mix.

158. #156: Plea bargain or not, this is not in line what people in general get for a second DUI. All people that I ever met in CA who had a second DUI without an accident and blew below .15 got about 90 days in jail, 100 days of Sherrif's work program and a fine of about $5.000, even while using a specialized lawyer.

159. #157: This is her second DUI within ten years. A pregnancy is no excuse. Good behavior since the first DUI is no excuse.

A second DUI is a second DUI, and there are strict laws on how to handle a second DUI. 90 days in jail, dozens of days in charity work or the Sheriff's work program plus a multi-thousand dollar fine.

Nicole Richie got off way to easy.

160. Oh, I forget to add: For your second DUI in CA you also have to absolve 18 months of DUI school. Plus an 18 months suspension of your drivers license after your court date. Plus three to five years of probation after re-approval of your license.

Nicole got off way, way, way too easy.

161. For all of you people outraged that Paris received a harsher punishment, get over it, she violated probation and also didn't take responsibility for her actions. And three years probation (in Nicole's case) is NOT getting off easy. You aren't in jail, yes, but one violation and you're gonna pay for it. I hope Nicole can make a turn around, and I still don't believe she's pregnant, but whatever...

163. She will probably do all of an hour after they consider overcrowding. Because of who she is she will only get a slap on the wrist! Anybody else would have gotten a much stiffer sentence! There is no justice here! This is so unfair! The justice system totally sucks!
