A Huge Win for Lane Garrison

In a stunning ruling, Judge Elden Fox set the stage for Lane Garrison to become a free man in 90 days.


The judge ordered the former "Prison Break" star to go to state prison for 90 days. The purpose: for shrinks and others to determine if he's a suitable candidate for straight probation. The smart money is now on the judge letting Garrison go free after a mere 3 months in prison.

The order followed dramatic, gut-wrenching testimony during Garrison's sentencing hearing at the 90210 courthouse.

The father of the boy who died in the car Garrison was driving testified that Lane is a self-absorbed person: "He's selfish. He took no responsibility. He could have come to us the next day and apologized, but he didn't."

The father also said he was furious at Garrison's PSA, first run on TMZ. The PSA shows a remorseful Garrison fronting an anti-drinking spot recreating the fatal crash. The dad testified, "He is an actor. He is acting. He killed a human being and he killed our son." The dad said, "Yesterday was one of the hardest days. It was Vahagn's birthday. He would have been 18."


Garrison then testified, "I relive that night every day and I think about the bad decisions I made." Garrison, who plead guilty to vehicular manslaughter, said, "All I can say to you is that I'm sorry. I tried to contact you every day. This PSA was not a publicity stunt." Garrison added, "We can't bring him back, but I'm sorry for my behavior that evening and that is not representative of who I am usually."

Garrison's lawyers, Rich Hutton and Harland Braun, suggested the boy who died was partly responsible. Braun said, "The young man died because he was sitting in a car with a drunk driver." Braun also suggested Garrison may have been a victim as well -- and that before the crash, someone may have slipped him a drink with the date rape drug GHB.


The D.A. vehemently opposed the 90-day diagnostic exam, arguing that Garrison should get four years in prison.

17. Lets blame a 17 year old who can't defend himself who was given alcohol (mind you he is a minor) had a chance to go party with a celeb. Ya, it's so his fault [sic]. Garrison should have told the minors that they can not drive with him becuase he is drunk. Yes, I am guilty of driving drunk when I thought I was invincible. But, never, ever, did I let anyone get in the car with me and I never got in the car with my stupid drunk friends. If I had a chance to go with a celeb I probably would have being that young and niave. I have a question - who bought the alcohol? Last time I checked it was illegal to give alcohol to minors. I've read Garrison did, so did that just go away? Bottom line is, fingers can point in ever direction, we all know the consequences for drinking (it even says it on the bottle), someone died and justice was by no means served.

18. Why isn't anybody questioning the fact that this grown man picked up two 15 year old girls and went on a joyride? What is he doing partying with 15 and 17 year olds? Then trying to blame the victim, who was a minor, for getting in his car! That's outrageous!

20. uNLIKIE ALL OF YOU i AM SOOOOOOOOOOOOOOOOOOOOOOOOO HAPPY!!! i think that he is not completely to blame. The kid who died and his parents are also too blame. Who is stupid enough to get in a car with someone who is drunk? come on people!! THINK!!!

21. This is a suitable punishment.

Keep in mind, folks, this was mistake, an error injudgement. Does he belong in prison with rapists? With people who have murdered families? No, he doesn't.

It is a very sad situation, but intention does have to account for something in heart wrenching cases like this... otherwise.... we would all be in prison at some point for something terrible that we have done while not using good judgement... Because we all have done something assinine and punishable...

This is not a case of money buying a verdict, but rather suitable justice being served.

22. Although I do think he got off easy I think people need to realize that he DID please guilty. He took responsibility for it. Weather or not it was acting doesn't really matter. He plead guilty and that is more the most people do.

What he wrong? Yes. Should he be punished? Yes. But you have to realize that he didn't kill some innocent person walking across the street, or driving another car. The kid in his car was drinking too. Everyone was drinking. Yes, he was wrong to give them beer since they were underage, but the kid got in the car willingly knowing that he was drunk. He STILL got in the car. He still drank underage. He didn't deserve to die, no. Of course not. But he wasn't some innocent victim in it all. If he had only been hurt, he probably would have been charged with underage drinking himself.

It's sad that a young kid had to die and he SHOULD be punished, but he already has done more then most have. Had Paris Hilton just said "i'm sorry, I know I was wrong" and plead guilty, she probably wouldn't have gotten as much time as she did. SHE didn't take responsibility and that is why she got longer then most. If the judge sees that you feel remorse and take responsibility for what you have done, he's going to go easier on you.

It's a sad thing that happened, but if he really is remorseful, this will end up being a good lesson for him and for others. I just hope one person can learn from this and not drink and drive.

24. HERE ARE MY LAST THOUGHTS ON THIS CASE--- (as I know you all want to hear them)

SOME PEOPLE ARE 'GOOD PEOPLE', that bad things happen... I think this is one of those people! I think 90 days is fair. I say this because, if it was 90 days or 6 years, this is one of those people where the lesson is learned already! Now with that said.. I feel that some people, just don't get it, and no matter how much time is spent in the can' they wil never learn... But I just don't see that here.

25. The dad said Lane was a self absorbed person? Gee did he ever stop to think that maybe he was too self absorbed to teach his kid not to drink under age and not to get in a car with a drunk driver?

That's right dad pass the buck for your failure as a parent.

I think everyone evolved her holds responsibility in what happened. It would make a good PSA to teach the importance of not being a drunk drivers passenger.

26. The judge is a joke. Another case of celebrities getting away with MURDER!!!!! This must be the same judge that let OJ off. If the kid that died was my son I would kill someone over this & gladly go to prison for the rest of my life like the defendant should have to. He hasn't learned a lesson - everyone ACTS sorry when they are in trouble. What a freakin' joke our court system is.

29. As much as I like him I think he needs to go to the first church he sees and say Hail Mary's and thank God until his vocal chords shrivel up. I guess the true test will be if after he's done his time, will he still be the major anti drunk driven advocate that he was 2-3 days ago or back to the Hollywood lifestyle. Either way I guess he's always gonna have to live with the fact that a 17 year old kids blood will always be on his hands.

30. the parents of the deceased child should sue Garrison for wrongful death!!
He was a child, and children do not make the best decisions. That's why Garrison should have been thinking as an ADULT that he is suspose to be.
