A Huge Win for Lane Garrison

In a stunning ruling, Judge Elden Fox set the stage for Lane Garrison to become a free man in 90 days.


The judge ordered the former "Prison Break" star to go to state prison for 90 days. The purpose: for shrinks and others to determine if he's a suitable candidate for straight probation. The smart money is now on the judge letting Garrison go free after a mere 3 months in prison.

The order followed dramatic, gut-wrenching testimony during Garrison's sentencing hearing at the 90210 courthouse.

The father of the boy who died in the car Garrison was driving testified that Lane is a self-absorbed person: "He's selfish. He took no responsibility. He could have come to us the next day and apologized, but he didn't."

The father also said he was furious at Garrison's PSA, first run on TMZ. The PSA shows a remorseful Garrison fronting an anti-drinking spot recreating the fatal crash. The dad testified, "He is an actor. He is acting. He killed a human being and he killed our son." The dad said, "Yesterday was one of the hardest days. It was Vahagn's birthday. He would have been 18."


Garrison then testified, "I relive that night every day and I think about the bad decisions I made." Garrison, who plead guilty to vehicular manslaughter, said, "All I can say to you is that I'm sorry. I tried to contact you every day. This PSA was not a publicity stunt." Garrison added, "We can't bring him back, but I'm sorry for my behavior that evening and that is not representative of who I am usually."

Garrison's lawyers, Rich Hutton and Harland Braun, suggested the boy who died was partly responsible. Braun said, "The young man died because he was sitting in a car with a drunk driver." Braun also suggested Garrison may have been a victim as well -- and that before the crash, someone may have slipped him a drink with the date rape drug GHB.


The D.A. vehemently opposed the 90-day diagnostic exam, arguing that Garrison should get four years in prison.

46. Why should someone go to jail and have their life ruined for an ACCIDENT? If he had killed someone in another car, perhaps there's an argument, but he killed someone who got drunk and allowed some drunk person to kill him. Never get in the car with a drunk driver. Take ownership for it if you do.

Prison for vehicular manslaughter isn't justice, it's revenge.

48. I think most normal people would have the same thing happen to them. People get all outraged about what they think is injustice, but they have no idea. We had a similar case locally, the drive got less then Lane did. And that was jsut a college student.
Also, people read the story, he was hanging out with them, it was their party, he just happened to be the driver. It wasn't some Hollywood kid looking to show off. It was kids looking to show off to their friends.
Also, I don't think a season and a half as in an ensemble cast makes you a celebrity. It just makes you a working actor.

49. I feel bad for all of them. I feel bad for him. He's in a living hell of his own. I don't blame the loved ones for being madder than heck! But I just wanted to give him a hug. He's not a malicious human being, like Michael Vick or OJ Simpson. He messed up BAD, but something like that could have happened to many of us. He's still a human being, and people should learn some compassion.

Judges need to be held accountable!

This is the most disgusting thing i have seen in a long time, In LA they have there own set of laws and if your a celebrity well you get away with murder , i hope he rots in hell, the PSA was nothing but a well planned ploy , and to say the victim was somewhat to blame as part of his defense what a vile human being , he was not sorry he was just sorry that he may have been going to prison . 52. Did someone hold a gun to this kids head and make him get in the vehicle? NO!!! So I think at 17yrs. old you should be able to make a better choice then get into a vehicle with a drunk guy and I don't care how famous he may be. So yes it's horribly sad that he was killed and yes it was wrong for Lane Garrison to drive drunk but it was also a choice of this kids to get in the vehicle.

Our legal system only exists for the poor, unfortunate and uneducated - the people who can't afford to buy their way out of consequences. The PSA was nothing but a publicity campaign for this jerk.

That has to be the most insane thing I've ever heard anyone say. To blame the kid who died because he got into the car of a drunk....chances are he was drunk too and wasn't thinking. As a driver YOU and YOU alone are ulitmately responsible for the passengers in your vehicle. To blame the parents and passengers...YOU'RE AN IDIOT!

56. To all you idiots saying that this is a suitable sentence b/c it was a "mistake"...are you guys INSANE?!? A HUMAN LIFE was LOST! Good Lord! How would you feel if this was YOUR child who was killed in this accident?!?

I'm sorry this happened. And yes, I see that Lane feels remorse for his actions which is good, but he still deserves to be punished for what he did: DRIVING UNDER THE INFLUENCE AND KILLING SOMEONE! Saying you're sorry does NOT negate your reprehensible actions.

60. I do believe he will not repeat his crime. Just my impression of the man. The thing we are not exposed to is the complete testimony, and the human element that comes across in a trial. I have been to many trials, mostly to testify as an expert witness. I respect the judge's experience to conclude that this man may be able to repay more of his debt by being out sooner. I believe his penalty should be severe, but not at the expense of taxpayers. His remorse and attitude account for the judge's decision to give him a chance to get well. I really do feel for the family. There is no sentence including death that will reduce their pain.
